초록

행정의 민주화, 행정의 능률화, 행정의 적정화, 사전적 권리구제의 기능을 가지는 행정절차는 독립된 실체의 존재를 이념적 전제로 한 직선적 사고에 기초한 조건명제의 전통적 법학과 연역적 방법론에 기반한 법치주의원리와 밀접한 관련성을 가진다. 그러나 다원화된 현대 사회에서 모든 것이 주체이자 객체인 연결망의 순환론적 관념에 기반한 절차관이 행정절차의 이념적 기초로서 작용해야 할 것이다. 그러므로 행정절차는 인간존엄성의 실현수단, 법적 결정의 정당성 확보수단, 행정쟁송과의 상호보완재적 수단으로서의 성격을 지닌다. 행정실체법에 대한 도구적ㆍ봉사적 기능에 국한한 행정절차법이 아닌 국민의 기본권실현을 포함한 헌법 제10조의 인간의 존엄과 가치를 긍극적 이념으로 하는 행정절차에 관한 일반법과 기본법으로서의 좌표설정과 함께 행정절차를 통한 민주주의원리의 구체화, 거버넌스를 통한 전통적 행정법의 극복의 관점에서 규율대상과 적용범위, 행정절차 조례, 의견청취절차상의 문제, 처분과 관련된 문제 등이 개정되어 진정한 행정절차법의 미래 방향이 정립되어야 할 것이다.

영어초록

Administrative procedures with the function of democratization of administration, efficiencies of administration, appropriation of administration, and prior rights relief are closely related to the rule of law based on the traditional law of conditional propositions based on the linear thinking which premises the existence of independent reality ideologically, and the deductive methodology. In the modern pluralistic society the idea of procedural system based on the cyclical idea of the network system, in which all is the subject and the object at the same time, however, should function as the ideological basis of the administrative procedure. Therefore, the administrative procedure is a means of realizing human dignity, a means of securing legitimacy of legal decision, and a complementary means to administrative litigation systems. The administrative procedure law is not limited to the instrumental and service functions for the administrative substantive law, but it has the ultimate idea of human dignity of Article 10 of the Constitution including realization of basic human rights of the people and functions as the ordinance of the general law and the basic law on the administrative procedure simultaneously. Furthermore, from the perspective of the materialization of the principle of democracy through administrative procedure and overcoming the traditional administrative law through governance, the object of rule and scope of application, autonomy ordinances of administrative procedure, problems in the process of hearing of opinion, etc. are remended and future direction of administrative procedure law should be really established.
