미국 연방행정절차법상 정책의 일반적 설명과 재량준칙의 비교법 연구 (A Comparative Law Study of the APA’s General Statement of Policy and the Korea’s Discretion Directive)

초록

본 연구는 미국 연방행정절차법상 규칙의 일종인 정책의 일반적 설명과 한국법상 재량준칙에 대한 비교법 연구를 목적으로 한다. 재량준칙과 정책의 일반적 설명을 비교대상으로 삼은 것은 두 개념의 정의와 기능이 유사하기 때문에 이들 사이의 비교법 연구를 통해 법 해석론과 법제의 향상을 도모할 수 있기 때문이다. 비교법 연구의 중요 쟁점은 정책의 일반적 설명의 개념, 기능과 이에 대한 사법심사관련 문제를 초점으로 삼아 학설 및 연방법원의 판례를 조사･분석한다. 이러한 연구목적을 위해, 첫째부분에선 연방행정절차법상 정책의 일반적 설명에 대한 법률규정과 이에 대한 일반적 해석론을 조사･분석한다. 세부적으로 연방행정절차법상 규칙의 개념과 범주를 살펴보고 그의 구별기준을 분석하고, 정책의 일반적 설명의 정의와 기능 및 비판을 조사･분석한다.
두 번째 장에서는 정책의 일반적 설명에 대한 사법심사에서 발생하는 여러 쟁점사항을 조사하고 이에 대한 연방법원의 판례를 분석한다. 정책의 일반적 설명의 사법심사의 쟁점은 연방행정절차법상 법규명령과의 구별기준, 사법심사에서의 상황성숙성 독트린을 충족하는지 여부, 그리고 사법심사의 범위에 관한 것이다.
세 번째 장에서는 한국법상 재량준칙과의 비교법 연구를 수행한다. 우선 한국법제에서 재량준칙의 개념과 분류 및 그 법규성에 관한 학설 및 판례의 해석론을 조사･분석한다. 이를 바탕으로 재량준칙의 범주화 및 법규성을 연방행정절차법상 정책의 일반적 설명에 관한 해석론을 통해 분석하고 연방법원의 사법심사관련 문제에 대한 판례를 사용하여 이에 대한 해석론을 도출한다.

영어초록

The purpose of this study is to perform comparative law study methodology concerning the general statement policy in APA and the discretion directive in the korean legal system. The reason of choosing the general statement of policy and the discretion directive as comparative law study object dues to the similarity the definition and function of these. Addition to this reason, these comparative law studies enhance the legal interpretative theory and the legal system in the korea. The focus of comparative law study is to research the definition, function, and related problem of the judicial review of general statement of policy. In order to this researches, this article researches the related theory and case law and analysis these materials.
The 1st chapter researches the provision of the general statement of policy in Administrative Procedure Act and analyzes the interpretation of that provision. Additionally, 1st chapter reviews the APA’s definition of the rule and the criteria of the classification of rules, analyzes the criteria, definition, and the function of general statement of policy.
The 2nd chapter researches the issues related to the judicial review of general statement of policy and analyzes the federal court’s cases. These issues includes the classification criteria of rules, whether the general statement of policy meets the ripeness doctrine, and the scope of the judicial review.
The 3rd chapter carries out the comparative legal study of the discretion directive in korean jurisprudence and the general statement of policy in U.S. administrative law system. Through these comparative law study of discretion directive and general statement of policy, this article induces the legal interpretation of the issues related to discretion directive that includes the definition, function, and judicial review of the discretion directive.
