초록

본 논문은 흄의 법사상을 역사적 구성의 관점에서 해석하고자 한다. 이는 기존의 자연주의적 해석과 달리 자연과 역사를 단절적으로 보지 않고 자연의 성장이란 관점에서 법의 발달을 추적한다. 법의 역사적 구성의 관점을 구체적으로 보여주기 위해서 흄의 <영국사>에 드러난 영국헌정사 이야기를 중심으로 시민적 유대를 구성하는 관행이 어떻게 구성되고 성장하였는지를 기술한다. 그리고 본 논문은 역사적 구성의 관점에서 법을 보는 시각이 홈즈 판사의 보통법적 시선과 동일한 지점을 가리키고 있음을 논할 것이다. 특히 흄에 있어서 시민적 주체의 구성 문제는 보통법에서 보통의 판단력을 가진 “일반인”으로 구체화됨을 보여줄 것이다.

영어초록

This article aims to describe some general scheme of Hume's legal philosophy, in relation to O. W. Holmes's thought of the common law. The main argument is that Hume's legal philosophy is founded upon a constitutive method, in a sharp contrast to constructivism that has prevailed in political science since Hobbes. It gives the priority to the historical constitution of community over the rights of the individual; the legal or moral sentiments grow up with the development of community. And the common sense of interest gradually arises from the general sense of common interest and becomes solid in the long tract of time. The common law is founded on this sense of interest, while the prevailing modern legal theory tries, in vain, to compromise conflicting rights or self-interests.
The radical difference between Hume's constitutive and Hobbes's constructive methods can be revealed in their guiding questions. The former question is how the civil subject has been constituted in history, while the latter how to construct a political system that regulates the conflicting tendencies of “free” individuals. Due to the lack of the historical constitution of the subject, the constructed political system remains external to individuals. From the constructive point of view, the stability of a political system is derived from without; for this reason, there is a persistent concern about its internal stability, which compels the social contract theorists following Hobbes to search for a way to turn the individual into a citizen. In contrast, Hume's constitutive method traces back to the constitution of civil union and opens up the way to evaluate historical acts, in relevance to the historical situation.
