중재법 개정과 환경분쟁 조정법상 중재의 활성화를 위한 고찰 (A Study on the Arbitration Law Revise and invigoration of arbitration for Environmental Dispute Adjustment Act)

초록

환경관련 분쟁이 발생한 경우 당사자간의 합의를 통해서 원만하게 해결하는 것이 제일 바람직한 방법이 되겠지만, 환경분쟁의 특성상 합의를 이끌어 내는 것이 쉽지 않다. 환경관련 분쟁이 발생한 경우 법원에서 소송을 통해서 해결하는 방법과 민간기구나 정부기관에 의한 소송을 대체하는 분쟁해결수단(Alternative Dispute Resolution; 이하 ADR이라 한다)을 통해서 조정이나 중재 등으로 해결하는 방법 두 가지 중에서 하나의 방법을 선택하여 해결을 하여야 한다.
환경분쟁 조정법은 조정의 방법으로 알선과 조정 그리고 재정의 3가지 방법을 두고 있다가 2016년에 중재를 도입하여 시행하고 있다. 하지만 통계자료에 따르면 환경관련 분쟁에 대한 조정의 한 방법으로서 중재제도가 도입된 후 2년의 기간 동안 환경관련 분쟁을 조정하기 위한 방법으로 중재는 아직 한 번도 활용된 기록이 없다.
이와 관련하여 눈여겨 볼 점은 비슷한 시기에 중재법의 개정이 있었다는 것이다. 환경분쟁 조정법의 개정법이 시행되기도 전인 2016년 5월 29일에 중재법이 개정되고 같은 해 11월 30일 시행되면서 중재판정에 대해서 효과를 달리하게 되었다.
이에 본 연구에서는 우선 환경분쟁 조정에서 중재가 활용되지 못하고 있는 이유에 대해서 검토하고, 개정된 중재법과의 정합성에 대한 검토를 통해서 중재의 활성화 방안을 모색하여 보고자 하였다.
이러한 연구목적을 수행하기 위해서 우선 환경피해의 특징을 살펴보고, 환경분쟁에 대한 일본과 대만 그리고 우리나라의 ADR을 통한 분쟁해결 현황에 대해서 검토하여 그 원인을 비교 분석하였고, 환경분쟁 조정법에서 규정하고 있는 4가지 조정방법에 대한 비교 분석을 통하여 중재가 활성화되지 못하고 있는 원인을 분석하였다. 마지막으로 개정된 중재법상 중재와 환경분쟁 조정법상 중재와의 비교검토를 통하여 문제점을 검토한 결과를 가지고 환경분쟁 조정법의 개정을 통한 해결방안을 제시하였다.

영어초록

When a dispute arises regarding an environmental issue, the best way to solve the problem is making an amicable settlement through the agreement between the parties. But because of the environmental dispute’s characteristics, it is not easy to reach settlement.
If the environmental dispute arises, there is two optional way to solve the problem. One is settling in court via litigation, other one is mediation or arbitration, etc through the Alternative Dispute Resolution (hereinafter ‘ADR’) which substitutes for litigation of private organization or government agencies. The environmental dispute adjustment act, there are on the three methods of conciliation, mediation and arbitration, and it has an arbitration in 2016. But according to statistics, after the arbitration system was established as a way of the environmental dispute arises, there are no written records of the arbitration used for 2years.
It is noteworthy that there was an amendment of the arbitration act around the same time. Even before the revision of Environmental Dispute Adjustment Act was enforced, Arbitration Law was amended on 29th of May 29, 2016. And it was enforced on Nov 30 the same year that it occurred different effects in the arbitral award.
Hereupon on this Study, we've reviewed the reason why arbitration is not being used on environmental dispute adjustment first, then seek for activation plan through the reviewing of consistency with revised arbitration law.
To conduct this study’s purpose, We’ve looked into features of environmental damages first, then analyzed the cause from reviewing current dispute resolution states through the ADR of environmental dispute for Japan, Taiwan and Korea. And also we’ve analyzed the cause of de-activated arbitration through the comparative analysis for 4 kinds of adjustment methods which are provided in the environmental dispute adjustment act. Finally, we have looked into the issue through contrast and comparison of the arbitration under the Environmental Dispute Adjustment Act, and offered a solution through the amendment of the environmental dispute adjustment act.
