초록

우리민족의 번영을 위해서 남북통일은 꼭 필요하고, 지금이 바로 통일을 대비할 시점이다. 이때, 남북통일과 관련하여 북한주민을 대상으로 남한의 법체계를 이해시키는 것이 중요하게 요청된다. 통일을 준비하는 차원에서 통일 전 북한 이탈주민과 통일 후 북한주민들로 하여금 대한민국 제도를 이해하도록 하는 것이 필요하다. 왜냐하면 북한주민은 사회주의체제 하에서 살면서 행동양식이 북한에서 학습한 정치사회화와 정치사상 교육에 의해 형성되었다고 할 수 있기 때문이다. 북한이탈주민의 남한 정착도 탈북을 촉진하는 하나의 요인이라 할 수 있다. 그리고 북한에 거주하는 주민 중에는 남한의 법제도에 대한 잘못된 지식과 두려움으로 인하여 탈북을 망설이고 있는 자가 더러 있을 것이다. 그러므로 현재의 북한주민과 탈북자들 대상으로 남한의 법제도를 알기 쉽게 이해시키는 것이 중요하다. 결국, 통일을 전후하여 북한주민이 남한의 제도를 이해하는 것만큼 우리 남한이 부담해야할 통일 비용은 낮아지고 국가의 결속력은 단단해 질 것이다.
북한에서 북한주민의 제도에 대한 인식 형성에 작용하는 핵심요인들을 분석하는 연구가 선행되어야 할 것이다. 왜냐하면 이 연구가 북한주민의 의식구조를 올바르게 바로잡아 줄 효과적인 전략의 수립에 근간이 되기 때문이다. 그러므로 북한주민의 법제도에 대한 인식 형성에 영향을 끼치는 중대한 요인들을 포착하여, 이들이 이질적으로 느끼거나 비합리적이라고 느끼는 부분에 있어서는 법제도의 기초부터 교정하여야 제대로 남한의 법제도를 이해하고 적응할 수 있게 될 것이다.
북한주민에 대한 남한의 법에 대한 이해는 자유민주주의와 법의 관계를 헌법에 대한 것에 기반 하여야 한다. 한편, 여기서 대상으로서의 북한주민에는 현재 남한에 거주하고 있는 사람, 북한에 거주자하고 있는 자, 그 외의 국가에 거주하고 있는 자등을 말한다.
북한주민이 알고 있는 사회주의국가에서 말하는 법에 대한 지식과 관련하여, 첫째, 사회주의에서 법을 바라보는 시각을, 남한의 법은 계급의지와 무관한 것이며 헌법상의 질서에 따라야 하는 모든 사회구성의 사회적 합의에 따라 법이 만들어진다는 사실을 통하여 바꿔주어야 한다. 둘째, 민족주의와 관련된 시각을, 과거에도 미래에도 민족민주의 개념에서 정립된 법은 없었고 없을 것이며 우리에게 있어서의 민족은 문화적인 정체성과 자긍심 차원에서만 의미가 있을 뿐이라는 설명을 통하여 바로 잡아야 한다. 셋째, 사회주의에서 말하는 법의식에 대한 관점은 우리법은 처음부터 계급은 인정하고 있지 않으므로 우리법체계 어디에도 계급에 대한 인식이 반영될 틈이 없다는 것을 통하여 깨뜨려 주어야 할 것이다. 넷째, 사회주의에서 비판하는 자본주의의 사법과 공법에 대한 오해는 제3의 법영역이라고 하는 사회법이 있어 이러한 주장은 전혀 사실이 아님을 알려야 한다.
또한, 북한주민이 법에 대한 구체적인 기준으로 작용하고 있는 북한법 관련하여 우리법은 지도이념, 권력자의 언행이나 의지, 당의 정책과 무관한 것임을 이해시켜야 한다. 즉, 남한에는 주체사상과 같은 없고, 남한의 대통령은 북한인 김일성, 김정일, 김정은 등과 본질적으로 다르며, 남한의 집권당은 북한의 노동당과 전혀 다름을 인식시켜야 한다.

For the prosperity of our nation, the unification of the North and South is indispensable and it is time to prepare for unification. At this time, it is important to understand the legal system of South Korea with regard to the North-South unification. In order to prepare for unification, it is necessary to make North Korean defectors and North Korean defectors understand the Korean system before unification. This is because North Koreans can be said to have been formed by political socialization and political thought education, which they learned in North Korea while living under the socialist system. The settlement of North Korean defectors in South Korea is also one of the factors that promote North Korean defectors. And some of the inhabitants of North Korea are hesitant to escape due to misinformation and fear of South Korea 's legal system. Therefore, it is important to understand South Korea 's legal system as an object of current North Korean defectors and refugees. A study should be conducted to analyze the key factors affecting the formation of the North Korean people's system in North Korea. This is because this research is based on the establishment of an effective strategy to correct the structure of consciousness of North Koreans. Therefore, it is necessary to capture the important factors affecting the formation of the perception of the North Korean people's legal system so that they will be able to understand and adapt the legal system of South Korea properly if they feel heterogeneous or unreasonable. will be.
Understanding South Korea's law on North Koreans should be based on the constitutional relationship between liberal democracy and law. On the other hand, North Korean residents as the object here refer to those who are currently residing in South Korea, those who are residents of North Korea, and those living in other countries.
In relation to the knowledge of law in the socialist state known to the North Korean people, first, the viewpoint of law in socialism, the law of South Korea is irrelevant to the will of the class, and the social consensus of all social constitution The law should be changed according to the fact that the law is made according to. Second, we must correct the viewpoint related to nationalism through the explanation that there is no law established in the concept of national democracy in the past or future, and that the nation for us is only meaningful in terms of cultural identity and pride.
