북한 법제정비지원의 법적 성격과 기능적 수용주체 (The Legal Characteristics and the Functional Recipients of the Support for Improving the North Korean Legal System)

초록

북한에 대한 법제정비지원은 그 내용상 특히 체제전환국에 대한 법제정비지원의 성격을 지니는 ODA로서의 법제정비지원과 통일과정에서의 법제통합(준비작업)의 일환으로서의 법제정비지원으로 그 성격을 구분하여 볼 수 있다. 우리 대한민국이 북한에 대하여 의도하는 법제정비의 지원은 바로 현재 발생해 있는 남북한 법체계 상호 간의 간극이 더 이상 심화되지 않도록 하고, 남북 상호 간의 교류가 보다 확대･정착되어 향후 통일로 가는 과정이 진행될 때 야기될 수 있는 혼란과 충돌을 사전에 감소시키고자 하는 정지작업의 의미를 지니게 된다. 그리고 이는 궁극적으로는 남북 상호 간의 법제통합을 지향하게 될 것이다. 또한 북한에 대하여 지원되는 법제정비는 법치주의의 정착과 확립을 그 목적으로 할 수밖에 없으므로, 이는 점진적으로 북한을 국제적 차원에서의 정상국가로 유도하게 될 것이다.
이와 같은 법제정비지원의 성공적인 안착을 위하여 수원국인 북한에서의 법제정비지원사업의 수용주체에 대한 연구와 검토가 필요하다. 조직법적 차원에서 이러한 사업의 직접적 담당자는 국가의 기능을 수행하기 위하여 조직된 국가기관이 되겠으나, 그 실질적인 역할의 수행은 법률가가 행하게 될 것이다. 따라서 법제정비지원에 대한 수용의 기능적 주체는 마땅히 법률가로 파악하여야 할 것이고, 이러한 법률가의 일반적인 범주로서 우리는 북한의 변호사에 대해서 살펴볼 필요가 있다.
북한은 《변호사법》에서 변호사는 변호활동과 법률상 방조를 통하여 인권을 보장하고 국가의 법률제도를 옹호한다고 규정하고 있으나, 사회주의 및 집단주의가 지배하는 북한의 체제상 북한 변호사제도의 본질은 그 인민적 성격에서 표출되어 있다고 할 것이다. 그리고 이 부분에서 우리의 변호사제도와 본질적인 차이점을 드러낸다. 따라서 향후 법제정비지원 과정에서 북한의 변호사와의 교류를 시도하고 진행함에 있어서 이와 같은 본질적 차이점을 염두에 두고 접근할 것이 요청된다.

In terms of its contents, the support for improving the North Korean legal system is divided into two types: the support for improving the legal system as an ODA, which has the characteristics of aid to transitional countries, and the support for improving the legal system as part of the integration (preparation work) of law and legal system in the unification process. The South Korea's intended support for improving the North Korean legal system ensures that the current inter-Korean legal system gap no longer deepens. It also means preparatory work to reduce in advance the confusion and conflicts that may arise when the inter-Korean exchanges expand and settle in the process of unification. And this will ultimately be oriented toward the integration of law and legal system between the two Koreas. In addition, since the support for improving the North Korean legal system is inherently aimed at the establishment of the rule of law, this will gradually lead North Korea to a normal country.
In order to ensure the successful settlement of such support for improving the legal system, research and review of the recipients, namely counterparts in the recipient country of North Korea is required. At the level of organizational law, the persons who are directly responsible for these projects will be state agencies organized to carry out the functions of the state, but the practical role will be played by lawyers. Therefore, the functional recipients of the support for improving the legal system should be identified as lawyers, and as a general category of such lawyers, we need to look at North Korean attorneys.
The 《Attorney-at-Law Act》 of North Korea stipulates that attorneys guarantee human rights and advocate the national legal system through their defense activities and legal aid. However, the nature of the North Korean attorney system under North Korea's regime, which is dominated by socialism and collectivism, is expressed in its characteristic of the people. And this part reveals the essential differences from our attorney system. Therefore, it is required to approach with such intrinsic differences in mind in attempting and proceeding exchanges with North Korean lawyers in the process of the support for improving the legal system in the future.
