인공지능에 대한 법인격 인정에 관한 법적 쟁점 (Legal Issues Regarding the Recognition of Artificial Intelligence as a Legal Personhood)

초록

1973년 개발된 스마트폰은 불과 50여년 만에 전 세계 50억 명의 인구가 사용하게 되었으며, 스마트폰을 신체의 일부처럼 사용하는 소위 ‘포노 사피엔스’라는 신조어까지 등장시켰다. 이들은 지금까지 쌓아놓은 문명 양식의 약 30% 정도를 바꾸었으며, 이는 문명의 전환 혹은 문명의 교체라는 평가가 있다. 인공지능 기술 역시 스마트홈, 챗봇, 자율주행차량과 같이 생활에 밀접하게 스며들어 우리 일상을 변화시키고 있다. 앞으로 과학과기술의 발전에 따라 정말 인간과 동일한 지능과 감정을 가지고 있는 강한 인공지능, 나아가 인간을 지능을 뛰어넘는 초인공지능 기술이 등장하여 문명의 전환을 이루어낼 지 그 누구도 예측할 수 없는 것이 사실이다. 따라서 이러한 인공지능 또는 인공지능이 탑재된 로봇 등에 의하여 사고 또는 손해가 발생할 경우, 자연인을 중심으로 한 현재의 법규범으로는 이를 온전히 해결할 수 없으므로 인공지능에게도 법인격을 부여하여 그 책임을 부과하자는 의견이 등장하였다.
본고에서는 인공지능에 대한 법인격 인정과 관련된 논의에 대하여 살펴본 후, 인공지능에 대한 법인격 인정에 관한 긍정설, 부정설에 이어 총론적 논의를 통해 인공지능의 시기와 종기에 대하여 살펴보았다. 이어 형법, 저작권법, 조세법 등 각각의 법에서 논의되고 있는 부분에 대하여 연구하였다. 이어 인공지능에 대한 법인격 인정이 인공지능 관련 사고 및 관련 문제들을 해결하는데 있어 유효적절한 것인지에 대하여 회의적임을 밝히며 ‘무과실 책임’과 ‘책임보험제도의 도입 및 가입의 의무화’를 대안으로 제시하였다. 나아가 장기적으로 인공지능에 대한 법인격 문제를 논의함에 있어서 권리능력, 책임능력, 행위능력과 의사표시 등 관련 문제를 함께 논의하여 정치한 민사법 체계에 잘 부합하는 법리를 형성해 나가야 할 것임을 밝혔다.

영어초록

Smartphones, developed in 1973, have been used by 5 billion people around the world in just 50 years, and even introduced a new term, the so-called ‘Phono Sapiens’, which uses Smartphones as if they were part of the body. They have changed about 30% of the civilization patterns accumulated by the older generations so far, and this is evaluated as a transition of civilization or a replacement of civilization. Artificial intelligence technology, such as smart homes, chatbots, and self-driving vehicles, is closely permeating our lives and changing our daily lives. In the future, with the development of science and technology, it is true that no one can predict whether strong artificial intelligence that has the same intelligence and emotions as humans, and super artificial intelligence technology that surpasses human intelligence will emerge and achieve a transition in civilization. Therefore, in the event of an accident or damage caused by artificial intelligence or a Robot equipped with artificial intelligence, the current law norms centered on natural persons cannot completely solve it, so the opinion that artificial intel- ligence should be given legal personality and its responsibility should be imposed appeared.
In this paper, after examining the discussion related to the recognition of legal personality for artificial intelligence, the timing and end of artificial intelligence were examined through general discussions following positive and negative theories on the recognition of legal personality for artificial intelligence. Subsequently, the parts discussed in each law, such as criminal law, copyright law, and tax law, were studied.
And then, expressed skepticism about whether the recognition of the legal personality of artificial intelligence is effective in solving artificial intelligence-related accidents and related problems, and suggested "no- fault liability" and "mandation of the introduction and subscription of the liability insurance system." Furthermore, in discussing the legal personality of artificial intel- ligence in the long run, related issues such as rights, responsibility, behavior, and expression of intention should be discussed together to form legal principles that are well in line with the political civil law system.
