초록

현대 사회에서 전파의 중요성은 더 이상 재론의 여지가 없는바, 그 자체로 공공성의 중요한 근거가 되고 있으며, 전파의 희소성, 공익성 등을 매개로 통신사업자들은 현대 정보통신사회에서 행정권에 못지않은 권력적 지위를 누리고 있다. 이러한 상황에서 전파의 공공성 자체에서는 물론, 전파를 매개로 하는 국민의 생활 및 안전이라는 공익의 실현이라는 관점에서의 전파이용에 대한 적절한 규제가 불가피함에도 불구하고, 현행 전파법상 무선국 검사제도는 계속적으로 규제완화를 지향하고 있는바, 그러한 경향이 전파의 공익성에 부합하는 적절한 규제와 감독의 제도화인지에 대한 의문이 이 글의 출발점이다.
규제(Regulation)의 개념 및 본질에 대해서는 여전히 논란이 있으나, 규제 개념을 어떻게 이해하여야 하는지와는 별개로, 공익실현을 목적으로 하는 행정에 있어서는 사인의 자유에 대한 제한과 제약이라는 전통적 규제는 행정의 본질적인 부분이라고 하여야 할 것이다. 행정의 본질이 사익간의 이해조정이 아닌 공익의 실현에 있다는 점에서, 행정에 있어 사익에 대한 적절한 제약과 조정은 필연적으로 요구될 수밖에 없으며, 그러한 조정이 없는 무조건적인 사익의 보호와 보장은 오히려 행정의 본질을 방기하는 결과가 될 것이기 때문이다.
행정에 있어 규제의 궁극적인 문제는 규제의 허용성 자체의 문제보다는 규제의 정도의 문제라고 할 것으로, 규제의 정도에는 비례원칙이 적용되는바, 비례원칙에 부합하지 못하는 과도한 규제는 철폐 내지 완화의 대상이 된다고 할 것이다. 이는 역으로 규제의 제도화에 있어서는 규제의 대상영역이 가지는 공익성 내지 공공성의 보호에 부합하는 정도의 규제가 요구된다는 것을 본원적 원리로 한다고 할 것인바, 전파의 공익성, 국민의 생활 및 안전에 대한 관련성은 공법적 규제의 정도와 필연적 관련성을 갖는다.
현대 사회에서 전파 및 이를 이용한 통신의 공익성은 지극히 크다고 할 것으로, 이는 통신의 자유라는 기본권적 문제를 넘어, ‘사물인터넷’이라고 표현될 정도로 현대 사회의 거의 모든 생활영역에 영향력을 미치고 있고, 이는 역으로 전파의 적정한 이용의 교란은 국민의 생활 및 안전에 대한 중대한 위협이 될 수 있다. 그럼에도 불구하고 현행 전파법상 무선국에 대한 규제는 규제완화 경향에 편승하여 진입규제는 물론 사후적 규제로서 검사제도 역시 표본검사제도의 도입을 통해 규제완화의 일로를 달리고 있다. 전파의 공익성은 물론, 국민의 생활 및 안전에 대한 관련성을 고려할 때, 전파에 대한 공익성의 보장 및 실현에 대해 궁극적인 책임을 지는 행정의 대응이 적절한지에 대해서는 우려를 지울 수 없다. 더 이상 막연한 규제개혁, 특히 규제완화가 행정법제에 있어 바이블이자 공리인 것처럼 되풀이 되어서는 안 될 것이다. 공익에 부합하는 적절한 규제는 오히려 행정의 책무이기도 하다.

영어초록

In Korea, the Radio Waves Act stipulates for the inspection system of radio stations as follows; Any of the following persons shall, if the installation of wireless facilities and equipment is completed, file a report of completion with the Minister of Science, ICT and Future Planning and then undergo an inspection to determine whether the wireless facilities and equipment installed are in conformity with the technical standards and the standards for the qualification and placement of a fixed number of persons engaged in wireless work (hereinafter referred to as “completion inspection”): Provided, That the Minister of Science, ICT and Future Planning may inspect samples of the wireless stations that are subject to establishment after filing a report thereon under Article 19-2 (1) 3 (hereinafter referred to as “sampling inspection”), when Presidential Decree so prescribes.
The current Radio Waves law adopts the sampling inspection system as a normal system of completion inspection, and that means institutionalization of deregulation as a modern trend.
This study begins with the question, whether the current inspection system of radio stations is adequate regulation that corresponds with public interest of radio waves.
The object of the administration shall be realize public interest. It may not be obvious, what is the concept or substance of public interest, but it is clear that natural freedom of individuals are regulated to realize certain public interest, to say the least of it. Consequently, the regulatory administration is a essential part of the administration aims at public interest.
Regulations are not in descretion of the administration, but applied for the proportionality that they should be minimized according to the constitutional principles. Therfore, although the lawmaking-political aspect has to be considered in institutionalization of regulations, there is the restriction that the proportionality should be applied for the necessity and the degree of regulations, in order to realize the public interest. It is a problem of much more importance, that the proportionality demands not unconditional deregulation, but reasonable degree of regulation which exactly corresponds to public peculiarity of the regulatory object.
Above all, the modern administration has an obligation to protect the people's basic legal rights of life, health and property from the diverse damages. That is should be a important basis for the necessity of regulations.
It is conspicuous trend in recently management policy of radio waves to symmetrize the spectrum usage rights of private with the public interest of spectrum. The sampling inspection system of the current Radio Waves Act may be one of the reflection of this trend. Nevertheless, legal problem remains still, whether the sampling inspection system is correspond to public peculiarity of wireless stations. Because, the management of radio waves and is typically characterized by public interest.
In conclusion, it is necessary in the present Radio Waves Act to try to raise the public interest in the management of radio waves including the inspection system of radio stations. The subject to deregulation in the inspection system of radio stations demands further investigation.
