초록

본 연구는 북한의 토지법의 변천과 통일시 남북 토지법제의 과제를 검토하는데 주된 목적이 있다. 최근 북한은 중국의 경제지대의 개방과 개혁 경험을 바탕으로 북한 내에 경제특구를 설치하고 있다. 동시에 경제특구의 지정과 개발에 따라 북한의 토지제도에도 변화가 일어나고 있다. 북한의 사적소유제도가 부분적으로 부활되고 있는 것이다. 특히 중국의 개방정책에 영향을 받아 자유경제무역지대의 설치와 토지임대법의 제정 그리고 경제특구 법제도의 구축을 구체화하고 있는 점에 주목해야 한다. 최근 북한은 중국과 함께 황금평과 나선지대에 새로운 경제지대 모델을 추진하고 있다.
본 논문에서는 북한의 통치기반을 이루고 있는 북한의 토지개혁과 토지 소유 제도를 검토하고, 개방정책에 따른 북한의 사적소유제도 부활, 북한의 경제특구의 설치, 중국의 경제지대 모델과 토지법제 등의 검토를 통해 향후 남북한 토지제도의 통합방향과 과제를 검토하는데 주된 목적이 있다. 남북한의 통일과 통합의 시각에서 볼 때 토지제도와 소유권 제도를 기본적으로 어떻게 설정할 것인가 하는 점은 매우 중요하기 때문이다.
본 연구에서는 남북한 소유권제도는 사유화를 대전제로 하되 남북한 통합의 시점에서는 1국가 2체제 토지제도를 기본으로 해야 한다는 점을 제안하고 있다. 통일의 시점과 통일 이후 안정기의 토지제도는 분리되어 검토되어야 한다. 이와 관련하여 통일이후 남북한의 토지제도의 기본방향으로 중국의 토지제도 운용 경험을 적극 검토할 필요가 있다. 중국의 토지영구임대제와 토지주식공유제도 그리고 토지사용권제도의 적용 가능성이 그것이다.
향후 남북한은 토지제도의 운영과 관련하여 다음의 과제에 대해 보다 적극적으로 대응전략을 수립해야 할 것이다. 첫째, 농촌과 도시의 발전을 위해 토지제도를 어떻게 변화시킬 것인가. 이에 대한 가능성이 토지사용권제도의 도입이다. 토지제도의 보완을 전제로 영구임대제나 토지주식공유제도 등을 대안으로 모색할 필요가 있다. 둘째, 경제특구 개발에 필수적인 노동공급의 문제를 어떻게 해결할 것인가. 이점은 중국의 경험에서 보는 것처럼 농촌인력의 도시진출에 의해 해결할 수 밖에 없다. 이를 위해서는 농촌의 농민의 이동 문제, 즉 북한판 ‘농민공’들의 문제에 어떻게 대처할 것인가 하는 점이 제시되어야 한다. 셋째, 경제특구와 북․중 경제 지대의 모델을 어떻게 할 것인가. 현 단계에서는 수립된 경제특구와 경제지대 모델을 정착시키는 것이 급선무이다. 그러나 이들 특구의 발전방향이나 경제지대의 활성화 여부가 남한의 경제상황과도 직결되게 된다. 또한 북․중 간 경제특구 전략과 경제지대 전략이 북한의 토지제도는 물론 향후 통일시 남북한 토지제도에도 큰 영향을 줄 것이다.
남북한의 토지제도 통합은 결국 남북한의 경제통합, 통일비용, 인구이동, 인프라 구축, 경제성장 등과 직결되는 과제인 동시에 남북 통합 시 등장하게 될 국가의 기반과 권력의 원천이 된다. 통일의 시점에서 남북한 토지제도는 1국가 2체제의 경제 질서와 토지제도를 기반으로 통합하는 방안을 준비해야 한다는 점을 강조하였다. 북한의 국유 토지 중심제도와 남한의 개인 토지 중심제도를 완전히 뒤흔들어서는 경제 질서와 국가체계를 유지할 수 없기 때문이다. 남북한의 토지제도와 토지법제의 통합이 결국은 통일비용의 감소와 남북갈등을 해소시키는 주요한 변수라는 점을 모두가 인식할 때다.

영어초록

This study is the main purpose to the change of land legislation in the North Korea and review of legal issues of land consolidation at the time of the unification of North and South Korea. The government of North Korea has developed special economic zones based on the China's opening policy and reform experience.
Depending on the development of special economic zones, the North Korea is appearing to changes in land system. Partially, system of private ownership of land is being resurrected in North Korea. Especially, free economic trade zone designation and land lease legislation, and legal framework for the establishment of special economic zones influenced by the open-door policy in China, it should be noted that we are North Korea's policies. Point of view on the unification and integration of North and South Korea, it is very important that how will you set on the system of land ownership.
In this paper, I examined the North Korean system of land reform and land ownership for the foundation of the politics of North Korea. In this paper, I have studied on the direction and integration issues for the land system of the North and South Korea at the time of unification. Specifically, the open-door policy with North Korea, the resurrection of the private property system, the design and development of a special economic zone in North Korea, China's economic zone model and legislation for land.
About legislation for the land of North and South Korea, I studied on the possibility of its application for one country and two systems. A condition that Korea should be system of private property, after the reunification, Korea should be on the basis of the legal institution for one country and two systems. Also, direction with respect to the base of the land system of unified Korea, we will need to review the experience of China's land system operation. In this paper, we examined the applicability about the long-term land lease system, shared system of land, and land use rights.
Unified Korea should be prepared about the following issues. First, how will really change on the land system for the development of rural and urban of North Korea. Second, what will solve the problem of labor supply on essential condition for the development of a special economic zone in North Korea. And third, how reliable do need to settle model of special economic zones and economic zones in China and North Korea.
Why is important to note that upon the land system, it is a source of state power. At the same time issues to the surrounding land system are directly linked economic integration, unification costs, migration, infrastructure, economic development of North and South Korea. The integration of land legislation of North and South Korea will be built on a realistic basis. Therefore we are interested to have a land for the establishment of institutions for future-oriented. In the end, it will reduce the Unification costs of North and South Korea.
