공항에서의 경호 운영 체제에 대한 대통령경호법과 항공보안법 비교 법적 연구 : 특별법 우선의 원칙과 행정규칙 제정을 중심으로 (A Legal Study Comparing the Presidential Guard Act and the Aviation Security Act for Security Operations at Airports : Focusing on the Principle of Supremacy of Special Laws and Administrative Rulemak)

초록

본 연구는 국가의 대통령을 안전하고 보위하기 위한 주요 핵심의 경호로서 민간항공에 서의 행사시 대통령 등의 경호에 관한 법률과 항공보안법의 법률 이해충돌에 대한 문제점을 해결하기 위한 방안을 제시하고자 한다. 대통령 등의 경호에 관한 법률(약칭“대통령경호법”이라 한다)은 대통령 등에 대한 경호 임무 수행을 위한 경호의 조직과 직무 범위 등 그밖에 필요한 사항에 대하여 규정한 목적이며, 민간항공에서의 적용되는 항공보안법은 국제협약에 의거 공항에 대한 시설, 항공기 운항에 따른 항행시설과 항공기 내에서의 불법 방해 행위를 예방 및 보안을 보장하기 위한 기준과 절차에 대한 의무사항이다. 이에 따라 민간항공 구역에서의 경호 행사시 법률적 이해가 상충되는 부분이 있다. 첫 번째로 공항 내에서 경호 행사의 효율적인 업무 수행을 위한 경호주체와 민간항공 책임주체 기관과의 사전 협의 시 상호 주장에 대한 법률적 우선의 원칙에 대한 이해 충돌, 두 번째로 경호구역 지정 후 대통령 이동 동선 과 대통령전용기(Code-One) 안전을 위한 출입 시 대통령 등의 경호에 관한 법률의 경호구역에서 항공보안법에 적용되는 공항운영자가 출입통제 임무 수행, 세 번째 경호행사시 경호요원 임무 수행에 따른 보안사항 처리 절차에 대하여 문제점을 살펴보고 양 법률적 이해충돌을 해결하기 위한 개선방안으로 특별법에 대한 우선의 원칙과 행정규칙 제정에 대하여 고찰하고자 한다.

영어초록

This study aims to propose a solution to resolve the problem of conflicts between the Act on the Protection of the President and the Aviation Security Act during events in civil aviation as the main core protection for the safety and security of the President of the Republic of Korea. The Act on the Protection of the President and Others (hereinafter referred to as the “Presidential Security Act”) is intended to regulate the organization, scope of duties, and other matters necessary for the performance of security duties for the President and others, while the Aviation Security Act, which is applied in civil aviation, is an obligation for standards and procedures to ensure security and prevent illegal interference with facilities at airports, navigation facilities for aircraft operations, and aircraft in accordance with international agreements. As a result, there are conflicting legal interests when it comes to security in civil aviation areas. First, the conflict of interest in the principle of legal priority of mutual claims in prior consultation with the body responsible for civil aviation for the efficient conduct of security events at the airport; second, the airport operator subject to the Aviation Security Act performs access control duties in the security zone of the Law on the Protection of the President and Others when entering and exiting the security zone for the safety of the President's movement and the President's private aircraft (Code-One) after the designation of the security zone, third, the procedures for handling security matters in the performance of bodyguard duties during security events. This paper will examine the problems and discuss the principle of priority for special laws and the enactment of administrative rules as a way to resolve the conflicts of interests between the two laws.
