막스 베버 법사회학에서 로마법과 영국법의 위상 : 법유형론과 법발달론의 법제사적 재구성 (The Status of Roman Law and English Law in Max Weber’s Sociology of Law : A Reconstruction of Typology and Development of Law from the Legal History Perspective)

초록

형식성과 합리성이라는 두 개의 축으로 구성된 사분면에 법질서들을 분류하는 것은 베버의 본뜻이 아니었다. 그의 법유형론은 역사적･현실적 법질서들에서 이념형을 추출하여 이 이념형들의 발달과정과 그것이 정치적 및 경제적 요인과 갖는 인과연관을 역사사회학적으로 해명하기 위한 것이었다. 베버에게 법유형론은 법발달론과 불가분의 관계에 있다.
이 글은 베버 법사회학을 법제사적 관점에서 재해석하려는 시도의 하나다. 서구법의 발달은, 법유형론적으로 표현하면, 절차비합리적 법에서 경험적 형식합리적 법을 거쳐 논리적 형식합리적 법으로 발달했는데 그 과정에서 실질합리적 법과 긴밀한 상호작용이 이루어졌다. 이를 법발달론으로 표현하면, 법예언자의 카리스마적 법계시에서 법명망가의 경험적 법발견과 법창조를 거쳐 학문적 형식논리적 훈련에 기반한 전문가적 사법에 이르는데 그 과정에서 세속적･신정적 정치권력에 의한 법부과(法賦課)와 큰 영향을 주고받았다고 말할 수 있다.
법유형론과 법발달론을 연결짓는 논의과정에서 고대 로마법의 발달은 경험적 형식합리적인 시민법과 실질합리적인 만민법(자연법) 및 칙법 간의 상호작용의 산물이고, 영국법의 발달은 경험적 형식합리적인 보통법과 실질합리적인 형평법 및 제정법 간의 상호작용의 산물이라는 점이 드러난다. 영국법을 실질비합리적 법에 가깝다고 보는 입장은 베버 법사회학에 대한 잘못된 이해에 기초한 것이다.

영어초록

It was not Weber's original intention to classify legal orders into four quadrants composed of two axes: formality and rationality. His typology of law was intended to extract Idealtypen from historical and contemporary legal orders and to explain the development process of these Idealtypen and their causal relationship with political and economic factors from the perspective of historical sociology. For Weber, the typology of law is inseparable from the theory of legal development.
This article is an attempt to reinterpret Weber's Sociology of Law from the legal history perspective. The development of Western law, expressed in terms of legal typology, progressed from procedural irrational law to empirical formal rational law and to logical formal rational law, having close interaction with substantive rational law in this process. Expressing this in terms of the legal development, it can be said that from the charismatic revelation of law by the law prophets, via the empirical discovery and creation of law by the legal honoratioren, it reaches professional judicial decision based on academic and formal logical training, having in the process mutual influence with the imposition of law by secular and theocratic political power.
In the discussion that connects the typology and the developmental theory of law, it is revealed that the development of ancient Roman law is the product of the interaction between empirical formal rationality of ius civile and substantive rationality of ius gentium (natural law) and imperial constitutiones. Again, the development of English law is the product of the interaction between empirical formal rational Common Law and substantive rationality of Equity and statutory law. The position that English law is close to substantive irrational law seems to be based on a misunderstanding of Weber's sociology of law.
