초록

한-중 FTA 체결로 양국 간 사회 경제적 교류가 더욱 활발해 질것으로 예상된다. 특히 한-중 FTA의 체결은 양국의 경제협력에 있어 새로운 전기가 마련하였다는 점에서 매우 의미가 있다. 지금까지 한국이 15개 국가 및 경제공동체와 FTA를 체결하면서 전례가 없던 ‘지방정부 간 경제협력’과 ‘한-중 FTA 산업단지’ 건설에 합의한 것이다. 중국의 경우, 이미 다른 국가와의 FTA에서 지방정부 간 경제협력을 통해 한국의 산업단지 격인 공업원을 건설한 바 있다. 하지만 한국은 이에 대한 경험이 전혀 없다. 따라서 FTA에 따른 한중 간 경제 협력이 성공적으로 이행되기 위해서는 향후 발생 가능성이 있는 법률문제에 대해 제고해 볼 필요가 있다. 특히, 한중 경제협력의 일환으로 진행되는 한-중 FTA 산업단지 개발을 더욱 촉진하기 위하여 한국정부는 이 지역의 기업 및 산업에 대한 파격적이고 대대적인 지원을 계획하고 있다. 이러한 정부의 조치는 대부분 세금 감면 및 보조금 교부의 내용을 포함하고 있어, 향후 WTO 보조금협정 위반을 초래할 가능성이 매우 높다. 산업단지 개발에 앞서 이에 대한 대비책을 마련할 필요가 있다.
따라서 본 논문에서는 우선 한-중 FTA 경제협력의 내용을 한-중 FTA 산업단지를 중심으로 살펴본다. 다음으로 WTO 보조금협정 상의 주요 의무를 간략하게 파악한 후, 새만금에 개발될 한-중 FTA 산업단지에 보조금협정 상의 어떤 의무가 적용되는지 분석해 본다. 마지막으로 한중 양국 간 경제협력의 일환으로 개발되는 한-중 FTA 산업단지 건설에 있어 보조금협정과의 주요쟁점에 대해서 분석해 본다. 특히, 새만금 산업단지에 제공되는 정부의 다양한 조치들이 보조금협정 상 ‘특정성’ 있는 보조금으로 판단될 수 있는 문제에 대해서 집중적으로 살펴보도록 한다. 이를 통해 향후 발생 가능성 있는 보조금 분쟁에 대비하고, 국가가 정책적 목적을 가지고 진행하는 사업의 법률 제정 및 정비에 있어서 국제법적으로 고려되어야 하는 쟁점에 대한 대응방안을 제시할 수 있을 것이다.

영어초록

According to the conclusion of the Korea-China FTA, it is expected that both social and economic exchange become more active. The Economic Cooperation Chapter under Korea-China FTA includes new negotiation issues─the articles for Local Economic Cooperate and Korea-China Industrial Complexes/Parks─with which Korea has never dealt before in other FTAs concluded with other countries. China already has and experience to establish industrial parks with FTA counterparts with purpose of China’s regional development. Unlike China, Korea has never discussed promoting either establishment of industrial complex jointly by two countries through a bilateral agreement, or economic cooperation between the local governments of FTA counterpart country. Accordingly, it is expected to raise several legal problems arising from implementing economic cooperation chapter in Korea-China FTA.
In particular, Sae Man Geum where Korea-China FTA Industrial complex will be built is directly related to the development project of central and local governments. The governments, in order for facilitating development of this area, have providing various benefits as a policy. Additionally, the central government plans to provide another government measures such as incredible deregulation and various incentives. These measures, however, are more likely to be considered as the ‘subsidy’ regulated by WTO Agreement on Subsidies and Countervailing Measures(SCM). This can be found easily in recent case happened in China that various incentives which Chinese government provided to special economic zone have been counted as the subsidies in the dispute. Taking into account the trend of subsidy dispute, Korea cannot completely rule out the possibility to be complained by the third country by the reason of violation of SCM agreement. Therefore, Korea needs to prepare for an effective response to the situation that may arise in the future.
Thus, the paper will investigate the content of the economic cooperation stated on Korea-China FTA focused on industry complex at first. Next, after briefly studying main obligations under SCM agreement, it will examine which obligation is applied to the Sae Man Geum industry complex. The paper, finally, will analyze the legal issues related with SCM agreement when developing Korea-China FTA industry complex. Especially, it will look deep into the matter whether Korean government’s measures given to Sae Man Geum industry complex are regarded as the subsidy with ‘specificity’. Through the study, it can provide the corresponding measures for the international issues that the government should take into account when it launches policy project as well as help to prepare a subsidy dispute occurring in the future.
