초록

2019년 3월 18일 과학혁신판은 공식적으로 설립되었으며 설립 초기부터 투자자의 권리와 이익을 보호한다는 이념에 초점을 두고 설립된 것이다. 과학혁신판의 건설 및 발전과 함께 투자자 보호를 위한 법률 및 규정 문서도 점차개선되었다. 2020년 3월 1일, 신“증권법”이 공식적으로 시행되었으며, 그 포인트 중 하나는 투자자 보호를 위한 특별 규칙을 설정한 것이다. 이는 과학혁신판 건설과 기타 규제 작업의 경험을 바탕으로, 입증된 유효한 투자자 보호 시스템을 하위의 부문 규제에서 상위의 법률로 승진시켰으며 사법재판과 증권감독에 적절하고 강력한 법률상의 보장을 제공한다.
이 연구는 신“증권법”의 시행과 과학혁신판의 번영 발전이라는 현실에서 출발하여, 중국 자본시장 개혁 및 투자자 보호, 과학혁신판의 투자자 보호와 신“증권법”의 투자자 보호의 세 가지 측면에서 새로운 시대에 중국 투자자의 보호 문제를 검토한다. 우선, 중국 자본 시장의 개혁이 제안되고 등록 시스템이완전히 시행되었으며, 투자자 보호의 중요성과 이에 대한 관심도가 크게 늘었다는 사실을 밝힌다. 다음으로, 과학혁신판의 투자자 보호와 관련하여 법률 규정, 규제 문서 및 특정 경로의 두 가지 측면에서 분석한다. 마지막으로, 신“증권법”이 과학혁신판 투자자 보호의 경험을 총화하는 과정에서 받은 새로운 변화와 혁신을 분석한다. 그러나 과학혁신판은 새로운 시도이며, 신“증권법”도실천으로 검증받아야 하는 실정이다. 중국은 투자자 집단이 크고 중소 투자자가 대다수이며, 투자자 권익에 대한 보호가 완비되지 못한 부분이 있다. 중국자본시장이 급속히 변화하고 있기에 투자자에 대한 보호는 임중이도원(任重 而道遠)이라는 실정이다.

영어초록

On March 18, 2019, the Sci-Tech Innovation Board was officially established, and it was established with the idea of protecting the rights and interests of investors. With the construction and development of Sci-Tech Innovation Board, the relevant legal provisions and normative documents for investor protection are gradually improved. On March 1, 2020, the new Securities Law was amended to come into force, and one of its bright spots is the establishment of a special chapter on investor protection. This is based on summing up the experience of Sci-Tech Innovation board construction and other supervision work, and raises a set of investor protection system which has proved to be effective from lower-ranked regulations to higher-ranked laws. The new Security Law provides sufficient and strong legal protection for judicial trial and securities supervision.
Based on the implementation of the new Securities Law and the reality of the vigorous development of the Sci-Tech Innovation Board, this paper studies the protection of Chinese investors in the new period from three aspects of the reform of China's capital market and investor protection, the protection of investors in the Sci-Tech Innovation Board and the protection of investors in the new Securities Law. First of all, the paper analyzes the reform of China's capital market, such as the full implementation of the registration system, the attention and importance of investor protection, and so on. Secondly, from the aspects of the relevant legal provisions, normative documents and specific paths, the paper analyses the investor protection in the Sci-Tech Innovation Board. Finally, the study analyzes the new “Securities Law” which is amended on the base of summing up the experience of investor protection of Sci-Tech Innovation Board and made some new changes and innovations. However, the Sci-Tech Innovation Board is a new thing to China, and the new Securities Law also needs to be tested. In China's large group of investors, small and medium-sized investors are in the majority. The protection of investors' rights and interests is still not perfect, and China's capital market is changing rapidly.
Therefore, investor protection has a long way to go.
