보험자대위 및 국민건강보험공단의 구상권 인정범위에 대한 판례 연구 - 대법원 2021. 3. 18. 2018다287935 전원합의체 판결 - (Case study on the scope of insurer’s subrogation and right to indemnity of National Health Insurance Corporation)

초록

일부보험에서 피보험자의 제3자에 대한 청구권이 과실상계 등에 의해 피보험자의 손해액에 미치지 못하는 경우 피보험자의 제3자에 대한 권리와 보험자가 지급보험금 한도에서 대위취득한 제3자에 대한 권리가 경합하는 문제가 발생한다. 피보험자가 초과이득을 얻지도 않고 부당하게 이익을 침해당하지도 않는 합리적인 방법은 비례책임방식의 일부보험의 경우 상대설, 보험금액을 한도로 손해액 전부에 대해 보상하는 방식의 일부보험의 경우 차액설을 따르는 것이다.
국민건강보험공단과 근로복지공단 역시 사회보험의 보험자로서 피보험자에 대한 급여를 지급한 후 제3자에게 구상하게 되는데 종래 판례는 국민건강보험법상의 보험자대위와 산업재해보상보험법상 보험자대위를 동일하게 취급하면서 피보험자의 손해배상청구권과 비교해 절대적 우위를 인정하고 있었다. 대상판결은 이를 변경하여 국민건강보험공단의 대위범위가 가해자의 책임비율에 해당하는 금액으로 제한된다고 판결하였다(상대설과 같은 결론). 국민건강보험법상 요양급여는 비례책임방식의 일부보험에 해당하므로 결론적으로 타당하다. 피해자인 수급권자의 권리를 지나치게 제한한 기존 판례를 변경한 것은 큰 의미가 있으나, 보험자의 청구권대위 범위의 법리와 손익상계의 법리는 구분되어야 할 것이다.

영어초록

In under insurance, if the insured's right to claim against a third party does not reach the insured's amount of damage due to negligence, etc., the insured's right to the third party and the insured's right to a third party acquired by subrogation within the limit of the amount of insurance payable collide a problem arises. In the case of ‘an under insurance that fixes the ratio of indemnification’, the relative theory, and in the case of partial insurance that compensates the entire amount of damage to the extent of the insured amount, the difference theory is a reasonable way to ensure that the insured does not receive excess profits or unfairly infringed on its profits.
National Health Insurance Corporation and Labor Welfare Corporation pays expenses to a insured, victim of a accident resulting in injury or death and then asks the assailant for compensation of its share in the expenses. The precedent treated the subrogation of a claim set by National Health Insurance Act the same as that set by Industrial Accident Compensation Insurance Act. And it drew the range of its compensation from the range of deduction, in accordance with the principle of deduction after offsetting and determined the compensation of all expenses borne by the Corporation, within the amount of compensation claimed by the insured(so-called “deduction after consideration of comparative negligence” method). The subject case changed prior Supreme Court decisions to limit to a reasonable extent the scope, the amount corresponding to the perpetrator's liability ratio, of which the Corporation can exercise the right of subrogation. According to the National Health Insurance Act, medical care benefits have a character of ‘an under insurance that fixes the ratio of indemnification’, so it is conclusively reasonable(relative theory). It is significant to change the existing precedent that excessively restricts the rights of health insurance beneficiaries who are victims, but the legal principle of the precedent concerning the legal principle of the precedent following the prinꠓciple of deduction after offsetting should be reconsidered.
