범국가적 산업기술유출수사체계 구축 방안에 대한 연구 – 산업기술유출사건의 특성 및 외국 사례 중심으로 - (A Study on the Establishment of the National Industrial Espionage Investigation System)

초록

4차 산업혁명 시대를 맞아 기술력 확보를 위한 각국의 경쟁이 심화되고 있어 기술보호가 그 어느 때보다 중요한 시기이다. 사전 예방활동이 무엇보다 중요하지만 이미 발생한 기술유출 사건을 신속하게 인지하고 수사하여 범인을 검거함으로써 기술유출을 조기에 차단하고 피해 확산을 방지하는 것도 기술보호의 중요한 축이라고 할 수 있다.
기술유출을 조기에 차단하기 위해서는 정보‧수사기관의 신속한 첩보 수집과 수사가 핵심이지만, 현재 우리나라의 정부기관의 기술유출 수사체계는 기술유출 사건의 특성을 고려하지 않은 중복적인 첩보 수집, 수사 시스템으로 이루어져 있다. 기술유출 사건에 대한 첩보수집과 수사를 담당하는 국정원, 경찰, 검찰 등 여러 기관이 관할의 구분 없이 이중, 삼중으로 존재함으로 인해 생기는 가장 큰 문제점은 정보 공유 및 업무 협조의 어려움이다. 이러한 문제는 기술유출 사건의 수사 및 재판의 장기화를 야기하여 피해기업에게 상당한 심리적·비용적 부담을 주게 되어 기술유출 피해를 알더라도 아무런 조치를 취하지 않거나 사건 진행을 중간에 포기하게 하기도 한다. 그간 정부는 정보 공유 및 업무 협조 문제를 개선하기 위해 여러 차례 개선 방안을 마련하여 왔지만 정부기관의 구조적인 문제로 인해 개선이 쉽지 않다.
본 연구에서는 이러한 구조적인 문제를 근본적으로 해소하고 기술유출 사건에 보다 효과적이고 강력하게 대응할 수 있는 방안으로 범국가적 수사기관인 가칭 국가산업기술유출수사단 설치를 제안하였다. 이를 위해 산업기술유출 사건의 특성과 외국의 기술유출사건 처리 체계를 검토한 후 현재 우리나라 기술유출 사건 수사체계의 문제점을 분석하였다.
기술유출사건은 일반 형사사건과 다른 특성을 갖고 있는데 이러한 특성 때문에 수사 절차도 일반 형사사건과 다소 다르게 전개된다. 기술유출사건의 특성을 분석하면 어떠한 관점에서 어떠한 방식으로 수사체계가 설계되어야 기술유출 범죄를 차단하는데 효과적일 수 있는지 파악하는데 도움이 될 것이다. 외국 사례의 경우 미국, 영국, 일본, 중국의 기술유출 수사체계를 살펴보았는데 특히 미국은 정부 차원의 관심과 지원을 받으며 정보기관, 경찰과 검찰이 신속한 수사와 기소 처리를 위해 강력한 범국가적 협력모델을 기반으로 산업기술유출 사건에 대응하고 있어 미국의 모델을 벤치마킹할 필요가 있다. 국가산업기술유출수사단은 기술유출 사건의 특성을 기반으로 미국의 범국가적 협력모델을 적극적으로 참고하여 첩보수집·수사·기소까지 모든 단계가 유기적으로 연결될 수 있도록 구성한 범국가적 수사기관이라고 볼 수 있다.

영어초록

In the era of the 4th Industrial Revolution, competition among nations for securing technological power is intensifying. This indicates that technology protection is more important than ever. Proactive prevention is important, but it is also an important axis of technology protection to stop technology leaks at an early stage and to prevent the spread of damage by quickly detecting and investigating industrial espionage cases.
In order to prevent the outflow of technology early, prompt intelligence collection and investigation by intelligence and investigation agencies are the key, but the current technology leakage investigation system involves duplicate processes in terms of intelligence collection and investigation without considering the characteristics of technology leakage incidents. The biggest problem of the industrial espionage investigation system in South Korea is the difficulty of information sharing and cooperation with relevant organizations such as National Intelligence Service, police, and prosecutors who are in charge of collecting information and investigating industrial espionage cases. These problems lead to the prolongation of investigation and trial periods, which in turn gives victims a considerable psychological and financial burden. Even if victims become aware of their technology leaks, they are not able to take any action or abandon the investigative process. The Korean government has attempted to improve the information sharing and cooperation, but it is not easy to improve due to the structural problems of the relevant government agencies.
In this study, we proposed the establishment of the national industrial espionage investigation organization as a way to solve the structural problems fundamentally and to cope more effectively with technology leakage cases. Before reaching this proposal, characteristics of the industrial espionage cases and problems of the current industrial espionage investigation system were examined, and some foreign systems were reviewed.
Espionage cases have different characteristics from general criminal cases. Due to these characteristics, the investigation process develops somewhat differently from general criminal cases. Analyzing the nature of espionage cases will help to identify effective ways of how the investigation system should be designed to prevent future damage. In this paper, various foreign models, such as the US, the UK, Japan, and China, have been examined. In particular, in the US industrial espionage receives governmental attention and support, and intelligence agencies, police and prosecutors respond to industrial espionage incidents based on a strong nationwide cooperation model for swift investigation and prosecution.
In consideration of the US model, the national industrial espionage investigation organization is conceptualized as a national investigative body that organically connects all the phases from intelligence gathering, investigation and prosecution.
