경찰단계에서의 소년범 위험성 평가에 의한 재범예측 연구 : 소년사건 처리시 전문가참여제 (A Study on Prediction of Recidivism by a Risk Assessment for Juvenile Offender at Police Investigation : The Specialist Participation System on Investigation of Juvenile Offenders)

초록

소년범죄가 질적으로 흉포화되고 있으며, 재범이 줄지 않는 상황에서 기존 소년사법체계는 더 이상 소년범죄를 줄이는데 한계가 있다고 볼 수 있다. 이러한 시점에서 제기된 다양한 선도프로그램 중 ‘소년범 전문가 참여제’의 측정방법이 통계적으로 유의미한지 분석하였다. 따라서 본 연구의 모집단은 2011년 1월부터 2011년 9월까지 서울지방경찰청 소속 31개의 경찰서에 검거된 소년범 중, 소년범 조사시 전문가 참여제를 가장 많이 실시한 3개의 경찰서에서 조사된 소년범 533명을 대상으로 했다. 소년범 수사시 전문가 참여제를 실시하는 목적은 경찰단계에서 소년범의 특성 및 심리 등을 파악함으로써 범죄위험성을 평가하고 재비행 가능성이 있는지를 판별하는 것이다.
분석결과, 대부분 소년범죄는 충동적이며, 단순 호기심으로 시작한 범죄이기 때문에 범죄유형에 따른 비행촉발요인에는 유의미한 차이가 나타나지 않았다. 하지만 저위험군과 고위험군에 따른 범죄유형별 재비행 가능성을 분석한 결과, 비행촉발요인 6개의 항목 모두 유의미한 결과를 보여주었다. 또한, PAI 성격 분석에 있어서 현저하게 저위험군보다 고위험군의 평균이 높게 나타났다. 하지만 이러한 소년범에 대해서 별다른 선도대책 없이 사건을 검찰에 송치하거나 단순훈방 조치함으로써 청소년의 재범률을 높여주는데 영향이 미칠 것이라고 판단하였다. 따라서 경찰단계에서의 범죄위험성을 평가하여 재범가능성을 예측하는데 평가하고 있는 전문가참여제가 의미가 있는지 알아보기 위해 판별분석을 하였다. 소년범 수사시 전문가 참여제로 인해 수사 초기에 저위험군과 고위험으로 나누어 재비행 가능성을 예측하는데 의미가 있는지 판별분석한 결과, 94.9%의 적중률을 보여주었다. 이러한 연구결과를 토대로 수사 초기에 전문가 참여제를 활성화시켜 소년범의 개인적 특성이나 환경적인 특성을 고려한 개별적 처우가 필요함을 제기했다.

영어초록

The situation that juvenile crimes get more and more ferocious in substance and recidivism rate is not being lowered suggests that the existing juvenile Justice system is not effective any more in reducing the number of juvenile crimes. In this research, I analyzed whether ‘the specialist participation system in the investigation of juvenile offenders’, one of the various guidance programs suggested at this point of time, is statistically meaningful. Therefore, among juvenile offenders rounded up at the 31 police stations under the Seoul Metropolitan Police Agency from January to September 2011, a population of this research is 533 juvenile offenders investigated at three police stations where specialist participation system was used most often while investigating juvenile offenders. The ultimate objective of this research is to assess whether the specialist participation system is effective in figuring out the recidivism possibility by grasping the characteristics and mentality of the juvenile offender at the initial phase of investigation.
The result of the analysis shows that, as most of juvenile offences are triggered by mere impulse or curiosity, there was no meaningful difference in delinquency triggering factors according to the types of offences. However, the analysis of recidivism possibility of respective low-risk and high-risk groups by each type of offence showed that all of six delinquency triggering factors are statistically meaningful. Besides that, it could be inferred that, without appropriate action or treatment, cases are being sent to the prosecutors’ office or juvenile offenders are being freed after admonition although the average of high-risk group is outstandingly higher than that of low-risk group in PAI. That is, it was assessed that the freeing of juvenile offenders without additional guidance measures had influence on the increase of recidivism. Lastly, the analysis of whether the specialist participation system in the investigation of juvenile offenders is meaningful in prospecting the recidivism possibility of respective low-risk and high-risk groups by grasping the characteristics and mentality of the juvenile offender at the initial phase of investigation showed 94.9% of accuracy rate. On the basis of the research results, I suggested the necessity of appropriate treatment considering the individual or environmental nature by revitalizing the specialist participation system at the initial phase of investigation.
