‘감청’ 허용 기준과 ‘감청’ 범위에 관한 입법적 제언 ― 우리나라와 미국의 법제 비교를 중심으로 ― (Comparative review of laws and precedents related to ‘wiretapping’ in the US and Korea)

초록

과거 무분별한 도청장치 설치에 대한 규제로부터 시작된 감청 규제는 이동전화와 인터넷의 발달로 SNS와 VoIP 감청 규제로까지 확대되고 있다. 이러한 기술의 경우 특히 전기통신사업자의 협조를 얻어야 수사기관의 감청이 가능하게 됨으로써, 감청 기준에 대한 유형별 규제와 전기통신사업자의 협조의무에 대한 논의가 집중되고 있다.
이러한 전기통신사업자의 협조의무 구체화, 감청의 대상 범죄 및 절차의 구체화, 감청 기준 세분화 등을 이유로 보다 구체적인 「통신비밀보호법」상의 정보의 수집 및 관리 절차 마련이 요구된다. 또한 이를 감독할 독립된 기구 설립 등을 통해 반복적인 검토 과정을 거칠 것도 하나의 대안으로 제시될 수 있다.
현행 「통신비밀보호법」상 범죄수사를 위한 감청의 대상 범죄는 형법 전반에 걸쳐 광범위하게 규정되어 있음을 감안하여, 사회적 논의를 통해 감청을 통한 정보수집 대상 범죄를 한정하는 것 또한 고려될 수 있다. 다만 그 감청의 필요성을 고려하여 대상 범죄의 예외를 법률의 규정에 따라 감독기구 등의 허가 등을 통해 확대할 수도 있을 것이다. 최근의 범죄가 매우 빠르게 진화, 변화되는 것을 감안할 때 법률의 규정만으로 실시간 대응이 어려울 수 있다. 이에 독립된 감청 지원 기구의 마련도 고려될 수 있을 것이다.
정보수집의 대상이 되었다는 점과 그 사유, 이의제기 절차 등을 통지하도록 하는 방안, 수집된 정보가 수집의 목적에 부합하는지를 검토하는 절차 및 수집목적 범위를 벗어나거나 활용이 종료된 정보를 삭제, 폐기하는 절차, 기술의 발전 및 정보수집 필요성 변화에 따라 새롭게 감청의 기준을 제･개정하기 위한 절차 등을 마련하여 감독기구가 그러한 기준 하에 검토하도록 하고, 국정 조사나 국정 감사를 통해 입법부의 관리 감독을 받게 한다면 감청으로 인한 기본권 침해를 최소화하면서도 수사에 적극적으로 대응할 수 있는 역량도 확보할 수 있을 것이라고 판단된다. 이러한 감독기관은 정보수집 요건의 준수와 적법성 판단, 정보수집 대상자에 대한 통지의무 이행, 수집 정보 이용 및 관리의 적정성, 감청 표준 제･개정 등과 관련하여 감독 및 조정을 수행하게 될 것이다.
다만, 특정의 기준을 제시하는 것이 하나의 틀이 되어 그 틀을 제외하고는 모조리 허용되는 것으로 해석되어 자칫 법망을 벗어날 수 있는 수단이 되어서는 아니될 것이므로 보다 정교한 규제를 전제로 한 기준과 감독기구가 수립하여야 한다. 또한 그 과정에서 국민 기본권 제한을 최소화하여야 하는 방향으로 정비되어야 할 것이다.

영어초록

Wiretapping regulations, which began with regulations on indiscriminate installation of wiretapping devices in the past, are expanding to SNS and VoIP wiretapping regulations with the development of mobile phones and the Internet. In the case of these technologies, especially with the cooperation of the telecommunications service provider, it is possible for the investigative agency to intercept the wiretapping, so discussions are focused on the regulation of each type of wiretapping standards and the duty of cooperation of the telecommunications service provider.
It is required to prepare more specific information collection and management procedures under the Protection of Communications Secrets Act for reasons such as specifying the duty of cooperation of telecommunications service providers, specifying crimes and procedures subject to wiretapping, and subdividing wiretapping standards. Also, going through a repetitive review process through the establishment of an independent organization to supervise this can be suggested as an alternative.
Considering that the crimes subject to wiretapping for criminal investigation under the current Protection of Communications Secrets Act are widely stipulated throughout the criminal law, it may also be considered to limit the crimes subject to information collection through wiretapping through social discussion. However, in consideration of the need for wiretapping, exceptions to target crimes may be expanded through permission from supervisory organizations, etc., in accordance with the provisions of the law. Given that recent crimes evolve and change very quickly, it may be difficult to respond in real time only with the provisions of the law. Accordingly, preparation of an independent wiretapping support organization may be considered.
The fact that it has been subject to information collection, the reason for it, the method to notify the objection procedure, etc., the procedure for reviewing whether the collected information meets the purpose of collection, and the deletion or disposal of information that goes beyond the scope of the purpose of collection or whose use has been terminated In accordance with the development of technology and changes in the need for information collection, a procedure for establishing and revising the standards for wiretapping is prepared so that the supervisory body reviews them based on those standards, and if it is subject to management and supervision of the legislative branch through a government investigation or inspection of government affairs It is judged that it will be possible to secure the ability to actively respond to investigations while minimizing violations of basic rights due to wiretapping. These supervisory agencies will supervise and coordinate compliance with information collection requirements, judging legitimacy, fulfillment of notification obligations to persons subject to information collection, appropriateness of use and management of collected information, and establishment/revision of wiretapping standards.
However, since presenting a specific standard becomes a framework and is interpreted as allowing everything except that framework, it should not be a means of escaping the law. should be established. Also, in the process, it should be organized so that the restrictions on the people's basic rights can be minimized.
