국제인권법을 기준으로 바라본 북한의 정치범 수용소 (North Korean Political Prison Camps: A View From International Norms of Human Rights)

초록

북한에는 다양한 종류의 집단수용소들이 있다. 그 중에서 가장 심각한 인권유린은 정치범 수용소에서 벌어지고 있다. 시민적⋅정치적 권리, 종교나 의사 및 표현의 자유와 같이 정상적인 국가에서는 허용되어 있는 기본적 권리들도 북한 주민이 누리려 하면 일탈(逸脫)로 간주된다. 이는 북한당국이 체제의 안전과 시스템의 유지를 추구하기 때문이다. 그래서 반체제 인사나 시스템 비판자, 종교인, 중국에서 체포되어 북한으로 송환 된 월경⋅탈북자들과 같은 일탈 추정자들은 체포, 예심 및 수감 과정에서 적법한 절차를 거치지 않고, 극단적인 고문과 다양한 형태의 비인격적 대우를 받는 것으로 알려져 있다. 이 인권침해들은 제도적이고 체계적으로 이루어지지만, 많은 경우 가해자들(inflictors)에 의해 자의적으로 행해지기도 한다. 그런데 국내 구제절차가 작동하지 않아 상황이 더욱 심각하다. 본 연구는 북한의 정치범 수용소와 관련하여 자행되는 각종 인권유린들을 로마규약을 비롯한 국제인권규범과 북한 국내법에 따라 분석하였다. 북한의 인권상황을 규정하는 국제 및 국내 규범들은 마련되어 있다. 그런데 이 규범들이 지켜지지 않는 것이다. 문제해결의 핵심은 정치적⋅외교적 협상을 통해 이 규범들이 지켜지도록 하는 것이다. 현실성을 고려하면 사안 별로 접근하는 것이 바람직 할 것이다. 그래서 개별 사안 해결이 모여 일반적 구속력을 발휘 할 수 있도록 노력해야 될 것이다. 인권의식 결여가 북한에서의 인권신장에 가장 큰 장애인 점을 고려하여 인권 교육과 확산에 주안점을 두어야 한다. 그래서 인권단체들이 정기적으로 북한을 방문하여 그 단체들이 제공하는 인권교육 프로그램과 교재 및 안내서들을 북한주민들이 접근 할 수 있도록 북한정부에 강력히 촉구해야 된다.

영어초록

There are various kinds of detention camps in North Korea. Among these detention camps, the most serious human rights abuses occur in the political prison camps.
Basic rights taken for granted in a normal state such as civil and political rights and the freedom of religion, opinion, and expressions are considered to be deviations when attempted to be enjoyed by North Korean civilians. This is for the security of the regime and the maintenance of the system on part of the DPRK’s authorities. Therefore, the suspects of such ‘deviation’, such as dissents of the regime or the system, people with religions, escapees or border crossers, and repatriates arrested in China and returned to North Korea, are known to not even undergo due process of arrest or preliminary hearing in the process of detaining them and also to put them under extreme forms of torture and various forms of inhumane treatment. These human rights violations do take place institutionally or systematically, but, in many cases, by arbitrary acts by the inflictors. The situation is made even worse as the domestic remedial procedures do not work. The current research examines the infringements of human rights in North Korea based on international norms, especially Rome Statute, and North Korean domestic norms. The international and domestic norms which define North Korean human rights conditions have been established. Yet these norms are not being adhered to. The key to solving this problem is political / diplomatic negotiation which will persuade others to follows these norms. In realistic terms, a case-by-case approach would be appropriate. Efforts should be aimed at establishing a general binding force through a succession of disparate consensual resolutions. Assuming that the lack of human rights awareness is the most serious obstacle to improving the North Korean situation, education and the dissemination of human rights should have first priority. Therefore, the North Korean government should be urged to accept regular visits from human rights organizations and allow its people access to the educational programs, guidebooks,or manuals provided by such organizations.
