여성살인범의 통계적 특성에 관한 연구 (A Study on the Statistical Peculiarity of Female Murderers)

초록

우리나라 전체 범죄의 약 16%는 여성에 의해 이루어지고 있다. 그리고 전체 살인범 중 여성이 차지하는 비율은 약 12% 정도에 달하고 있으며, 가정불화로 인한 남편살해 등이 상당한 비중을 차지하고 있다. 지금까지 범죄에 대한 대부분의 이론 및 연구는 남성을 중심으로 이루어져 왔으며, 특히 여성범죄의 특성에 대한 연구는 잘 이루어져 오지 않고 있다. 전체 범죄자 중 여성이 차지하는 비율이 지속적인 증가 추세를 보이고 있는 점을 감안하면 여성범죄의 특성을 별도로 파악해볼 필요성이 높다. 여기서는 우리나라의 여성범죄 중 특히 살인범죄에 한정하여 공식적 통계자료를 통해 남성과 대비되는 통계적 특성을 도출해보고자 하였다.
이 연구에서 도출된 우리나라 여성살인범의 통계적 특성은 다음과 같다. ① 개요: 전체 살인범 중 여성이 차지하는 비율은 여타 범죄자 중 여성이 차지하는 비율에 비해 다소 낮은 것으로 나타난다. ② 연령: 여성살인범은 남성살인범에 비해 40세 이하 저연령대의 비율이 더 높게 나타난다. ③ 직업: 남성살인범의 직업은 무직자와 피고용자의 비율이 가장 높게 나타나나, 여성살인범의 직업은 무직자와 주부의 비율이 가장 높게 나타난다. ④ 범행동기: 남성살인범의범행동기는 우발적인 경우가 가장 많으나, 여성살인범의 범행동기는 가정불화인 경우가 가장 많다. ⑤ 혼인관계: 남성살인범의 혼인관계는 이혼이 동거보다 높으나, 여성살인범의 혼인관계는 동거가 이혼보다 높게 나타난다. ⑥ 전과: 남성살인범의 경우에는 전과 5범 이상이 가장 많은 비중을 차지하고 있으나, 여성살인범의 경우에는 전과가 없는 경우가 월등히 높은 비중을 차지하고 있다. ⑦ 공범관계: 여성살인범은 남성살인범보다 공범의 비중이 높게 나타난다. 또한 남성살인범의 공범과의 관계는 동네친구나 직장동료 등인 경우가 많으나, 여성살인범의 공범과의 관계는 애인이나 친ㆍ인척 등인 경우가 많다. ⑧ 처분결과: 불기소처분(특히 혐의없음)에 있어 여성살인범의 경우가 남성살인범의 경우보다 더 높게 나타난다. ⑨ 재범기간: 여성살인범은 남성살인범보다 재범자의 비율이 월등히 적게 나타나며, 특히 동종 재범은 거의 전무하다. 한편 이 연구에서 여성살인범죄의 주요 원인은 가정폭력인 것으로 나타났으므로 가정폭력을 방지하는 것이 여성살인범죄에 대한 주요 대책이 될 수 있을 것으로 보인다.

영어초록

In Korea, about 16% of the whole crime is committed by female. The ratio of female in the whole murderers is about 12%. And female murders are mainly due to the quarrel between husband and wife. Until now, most of theory and study about crime is with male as the central figure, especially the study on the peculiarity of female offender has not been accomplished in effect. Taking the circumstances into consideration about the lasting increase in the ratio of female crime, separative grasping the peculiarity of female crime is necessary. In this study, I drew the statistical peculiarities of female murderers compared with male murderers through analyzing the official statistical data.
The statistical peculiarities of female murderers drawn in this study are as follows. ① Outline: The ratio of female in the whole murderers is lower than the ratio of female in the others. ② Age: The ratio of low age group(under 40 years) of female murderers is higher than the ratio of low age group(under 40 years) of male murderers. ③ Occupation: Jobless man and employee are given a great deal of weight on the male murderers" occupation, but Jobless man and housewife are given a great deal of weight on the female murderers" occupation. ④ The motive for the crime: The chance occurrence is given a great deal of weight on the male murderers" motive for the crime, but the quarrel between husband and wife is given a great deal of weight on the female murderers" motive for the crime. ⑤ Marital relations: The ratio of divorce is higher than the ratio of cohabitation in male murderers" marital relations, but the ratio of cohabitation is higher than the ratio of divorce in female murderers" marital relations. ⑥ Criminal record: With over 5 previous convictions is given a great deal of weight on the male murderers" criminal record, but without previous convictions is given a great deal of weight on the female murderers" criminal record. ⑦ Complicity in a crime: The ratio of female murderers" complicity in a crime is higher than male murderers" complicity in a crime. And neighborhood friend or coworker is given a great deal of weight on the male murderers" complicity in a crime, but lover or relative is given a great deal of weight on the female murderers" complicity in a crime. ⑧ Disposition result: The ratio of female murderers" is higher than the ratio of male murderers" at disposition not to institute a public action(especially no suspicion). ⑨ Second offense term: The ratio of female murderers at second offense is far lower than the ratio of male murderers at second offense, and second offense of the same kind especially don"t exist at all. In the end, female murders are mainly caused by domestic violence, its prevention can be important countermeasure.
