초록

항공사고의 대부분은 인적오류에 의해 발생한다는 연구 결과가 있으며, 이러한 인적오류는 행위자의 의도가 포함되지 아니함을 의미한다. 행위자의 의도없이 발생한 인적오류는 처벌을 강화한다고 하여 예방효과나 사고 및 사건의 발생이 감소한다고 보기는 어렵다. 이와 관련하여, 중벌화가 범죄억지의 효과에 유의미한 영향력을 가지기는 어려울 것이라고 보는 다수의 견해가 있으며 형벌의강화를 통하여 위하(威嚇)가 수행할 수 있는 것이 일부분에 지나지 않는다면, 그러한 요인을 찾아내고 관리함으로써 예방하는 데에 집중되어야 함을 의미한다. 공정문화는 항공분야에서 사고(accident) 및 사건(incident)의 대부분을 차지하고있는 인적오류의 실질적인 감소를 위한 새로운 안전관리 방식을 말한다. 전통적인 처벌 위주의 정책과 사후 조치적인 안전관리 방식에서 벗어나, 실무자들의자율보고 활성화와 적극적인 참여를 도모하기 위하여 인적오류에 처벌보다는재발방지를 위한 시정조치를 취하도록 하고, 안전정보를 보호하는 법과 정책을마련함으로써, 좁게는 수집된 안전정보를 활용하여 안전사건의 발생을 예방하고, 궁극적으로는 사고를 예방할 수 있도록 하기 위한 것이다.
본고는 공정문화 접근방식을 통한 우리나라 항공분야의 행정규제 개선방안을제시하였다. 먼저, 항공규제의 개선을 위하여 자율준수 접근방식을 도입하고, 용인할 수 있는 행위의 경우 처벌보다는 시정조치를 통한 재발 방지에 초점을 두도록 하였다. 또한, 이를 위한 구체적 방안으로 용인의 범주 결정을 위한 판단절차를 제시하였다. 이 판단절차는 형법과의 조화를 고려하여 행위자의 객관적 주의의무뿐만 아니라 주관적 요소 및 비난 가능성을 판단하도록 하는 것이다. 주관적 요소는 행위자가 인식과 의지를 가지고 행하였는지를 판단하는 것이며, 비난 가능성은 위반행위자의 구체적 상황, 사정, 행위 당시의 여건 등을 고려하여판단하도록 하는 것이다. 이러한 판단절차는 현재 규정위반 해당여부에 초점을맞춘 규제기관의 판단방식에서 탈피하여 공정문화의 접근방식으로 행위자의 당시 상황과 사정을 구체적으로 고려하여 판단하도록 하는 것으로 과실에 대한 모호한 판단기준에 중요한 대안이 될 것이다.
공정문화 접근방식은 현재 안전정보의 남용과 처벌의 두려움으로 안전과 관련된 중요한 정보를 항공실무자가 제공하지 않는 현실적인 문제점에 대한 대안이며, 적절한 균형과 타협을 통하여 항공안전을 위한 공익과 적절한 실행방안을찾고자 하는 것이다. 즉, 항공안전을 개선해야 할 필요성과 법적 정의를 적절하게 관리해야 할 필요성이라는 상충되는 이해관계 사이에서 적절한 균형을 유지하도록 하는 것이며, 이를 위한 지속적인 연구와 관련자들의 적극적인 참여가요구되는 상황이다. 본고에서 제시하고 있는 방안이 국내 항공분야 공정문화의실효성 제고를 위하여 기여할 수 있기를 희망하며, 이를 통하여 향후 항공분야에서 공정문화 구현을 위한 논의가 활발하게 진행되길 기대해본다.

영어초록

Studies have shown that most airline accidents are caused by human errors, which means that the intention of the actor is not included. It is difficult to say that human errors that occur without the intention of the actor reduce the preventive effect or the occurrence of accidents and events just because punishment is strengthened. In this regard, there are many opinions that it will be difficult for heavy punishment to have a significant influence on the effect of crime suppression, and if only a part of what deterrence can do through strengthening punishment, it means that it should be focused on preventing by finding and managing such factors. Just culture refers to a new safety management method for substantially reducing human errors, which account for the majority of accidents and incidents in the aviation sector. In order to promote voluntury reporting and active participation of working-level officials, corrective measures are taken to prevent recurrence rather than punishment, and safety information is prepared to prevent safety incidents and eventually prevent accidents.
This study proposed a plan to change the paradigm of administrative regulation in the aviation sector in Korea through a just culture approach. First, an autonomous compliance approach was introduced to improve aviation regulations, and in the case of acceptable acts, the focus was on preventing recurrence through corrective measures rather than punishment. In addition, as a specific plan for this, a judgment procedure for determining the category of tolerance was presented. This judgment procedure is to judge the subjective factors and the possibility of criticism as well as the actor's objective duty of care in consideration of harmony with the criminal law. The subjective factor is to determine whether the actor performed with awareness and will, and the possibility of criticism is to judge in consideration of the specific situation, circumstances, and conditions at the time of the act. This judgment procedure will be an important alternative to ambiguous judgment standards for negligence by taking into account the actor's situation and circumstances in detail through a just culture approach, breaking away from the regulatory agency's judgment method that focuses on whether it violates the current regulations.
The just culture approach is an alternative to the practical problem that aviation practitioners do not provide important safety-related information due to fear of abuse and punishment of safety information. In other words, it is necessary to maintain an appropriate balance between the conflicting interests of the need to improve aviation safety and the need to properly manage legal justice, and continuous research and active participation of those involved are required. We hope that the measures proposed in this paper can contribute to improving the effectiveness of the process culture in the korea aviation sector, and we hope that discussions on the implementation of a process culture in the aviation sector will be actively conducted in the future.
