초록

The rapid development of Information and Communications makes our lives rich, and contributed to the enjoyment of freedom of information in cyberspace. The point in question has no room for further discussion. However, freedom of much information may infringe personal information, and further raises an issue to live in the pain to have no way out. Everyone makes mistakes or error for judgment. In the world of Offline, the semis takes or error can be forgotten by people as time passes. However, it will not be never tolerated in the age of Online. Once any information is entered, it will be never erased, cancelled of itself, or changed in quality. In addition it will be preserved forever. People all over the world loudly express their concerns regarding erasion of information or block of search in cyberspace, and it is called Right to be forgotten.
Each country shows different attitude to acknowledgement of Right to be forgotten. The United States of America which traditionally puts weight on freedom of expression expresses concern over the infringement of freedom of expression resulted from the guarantee of Right to be forgotten, on the other hand, EU which regards Right to be forgotten as right of personality devotes all their energy to the enactment of law to guarantee Right to be forgotten. And in the judgment of Gonzales, Spanish lawyers v. Google by International Court of Justice, it was decided in favor of Gonzales. It means International Court of Justice officially admits Right to be forgotten in cyberspace. There is a sharp division of opinion to adopt Right to be forgotten in Korea In this research, the validity of argument as right to control self-information management will be investigated in cyberspace, the solution to the issue that the guarantee of Right to be forgotten is connected to infringement of freedom of expression will be found, and the alternative will be suggested by seeking for the possibility that Right to be forgotten can be adopted to our legal system.
