사이버공간에서의 법익침해에 관한 형사법적 고찰 (A Criminal Study on Infringement of legal interests in the Cyber Space)

초록

형사법은 사회생활영역에서 공존질서를 유지하고 침해된 법익질서를 회복시키기 위해서 적정한 형사제재수단으로 법공동체를 수호하는 기능을 한다. 현대사회는 위험사회로 지칭되는데 사이버공간이라는 새로운 생활공간에서 발생하는 사이버범죄는 기존에는 인식되지 못했지만 인터넷의 빠른 확대와 더불어 이에 대한 역기능으로 발생한 새로운 위험원에 의해 사회질서를 혼란시키고 있다. 사이버범죄는 가상공간에서 범죄가 행해진다는 점에서 전통적 형사법을 그대로 적용하기에는 한계를 드러내고 있지만 사이버공간을 중심으로 새로운 범죄현상의 증가를 방치할 수 없다. 이러한 위험사회에서 나타날 공존질서를 위협하는 위험에 대해서 효율적으로 대처하기 위해서는 위험의 발생을 사전에 차단하는 등의 형사법의 조기투입을 고려해 볼 수 있으나 형사법은 형벌이라는 강력한 제재수단을 사용하는 만큼 보충적이고 최후수단으로 사용해야 한다는 것이 법치국가 형법의 요청임을 종합적으로 고려해야 한다.
그러므로 사이버범죄의 법익개념의 재구성을 통해 위험사회에서 사이버공간에서 발생하는 법익침해에 관해 살펴보고 전통적 형사법의 적용의 한계를 검토한 후 형사법적 대응을 모색하고자 한다.

영어초록

Modern society can be defined as a risk society. The risk society has the common problem which can not grope for the appropriate measures by the ground of tradition principles and law concepts.
We live in the information society enjoying the benefits from various information technology including internet. The information took root as a more precious resoruce than any other values in our daily life. However, in the inside of the function of informatization, its dysfunction also reached such level where it can not be neglected any more. In this regard, it is the main purpose of this study to discuss the question regarding what the Criminal Law should function and play a role in this new current of change.
Especially the risk of cyber space is on the increase. Criminal responses against cyber crime in modern society and the concept of legal interest has become flexible. Moreover the criminal policy which is being tested in the risk society is trying to divide a field of risk criminal law from that of traditional criminal law.
Cyber crime is different from traditional crimes, because of the particular situation. it is facing new problems that cannot be solved by the dogma of traditional criminal law. We can not abandon the principle of the benefit and protection of law as the justificaftion principle of modern criminal law, but can not neglect the new objects of criminal protection in the new era. The liberal and the law ruled state viewpoint of criminal law has developed many normal principles to guarantee citizen’s freedom from the state.
In other worlds, If the concept of cyber space implies new society which has new structure, the legal countermove should be prepared by the modification or supplementation of the established legal concept.
Therefore it includes to clarify the distinctions between the nature of cyber crime and that of real crime at physical space. Also it deal with the regulation or improvement of cyber crime considering the speciality of cyber space. Reasonable and justifiable legal system should be introduced with the development of scientific technology.
