사이버 경제간첩 현황과 미국 경제간첩법의 교훈 (Foreign Power Economic Espionage in Cyberspace Now and Lessons of the U.S.A Economic Espionage Act)

초록

인류 역사적으로 사회(社會)가 있는 곳에 경쟁(競爭)이 있었다. 그리고 경쟁이 있는 곳에 스파이가 있었다. 냉전 이후 현대사회에서 가장 치열한 경쟁이 전개되는 곳이 경제영역이다. 이에 눈부신 과학 기술이 발달한 오늘날에도 각국 정부는 자국의 공식적인 정보기구를 동원하거나 아니면 다양한 우호세력을 확보하여 경제정보(經濟情報) 활동을 전개한다. 다양한 경제정보 활동 가운데 일국의 국가안보에 직접적인 위협을 초래하거나 기업의 존망을 위협하는 것이 산업스파이다. 본 논문은 미국 정보공동체가 2018년도에 미국 의회에 보고한 사이버 경제간첩의 현황을 참조하여 현대사회에서 사이버 경제간첩의 위중함과 더욱 활발해지는 현상을 제시하고 그 대처의 중심에 있는 미국 경제간첩법을 개괄적으로 소개한다. 더불어서 사이버 경제간첩 세력은 대한민국만을 예외로 둘 아무런 이유가 없을 것으로, 현실에서 막강한 저력을 발휘하고 정보수사공동체의 주요무기로 기능하는 미국 경제간첩법을 본받아 가칭 사이버안전 기본법 제정을 비롯한 우리의 대책(對策)을 제기하여 사이버 국가안정책과 정보활동에 보탬이 되고자 한다.

영어초록

Through human history, Where there is a society, there is competition. And where there is competition, there was a spy. In the post-Cold War era, the most intense competition on going in modern society is in the economy sector. Even in today's era of brilliant technological advances, Governments do mobilize their own intelligence agencies or develop diverse economic friendly forces to secure economic intelligence. Among the various economic intelligence activities, industrial espionage is the one that directly threatens national security or threatens corporate Survival.
Economic espionage is foreign power-sponsored or coordinated intelligence activity directed at the competitive government or some corporations, establishments, or persons, designed to unlawfully or clandestinely influence sensitive economic policy decisions or to unlawfully obtain sensitive financial, trade, or economic policy information; proprietary economic information; or critical technologies. This theft, through open and clandestine methods, can provide foreign entities with vital proprietary economic information at a fraction of the true cost of its research and development, causing significant economic losses. For that reasons, Industrial espionage causes direct threats to national security or threatens the survival of businesses.
Cyberspace remains a preferred operational domain for a wide range of industrial espionage threat actors, from adversarial nation-states, to commercial enterprises operating under state influence, to sponsored activities conducted by proxy hacker groups. Next-generation technologies, such as Artificial Intelligence(AI) and the Internet-of-Things (IoT) will introduce new vulnerabilities to U.S. networks for which the cybersecurity community remains largely unprepared. Building an effective response will require understanding economic espionage as a worldwide, multi-vector threat to the integrity of the U.S. economy and global trade. From all those point of vies, this thesis suggests and emphases to rethink its pros and cons and make a agreed rules through United Nation System. In those circumstances This thesis presents the gravity and increasing phenomenon of cyber economic espionage, and provides an overview of the U.S. Economic Espionage Act at the center of its response, referring to the current status of the cyber economic initiative reported to Congress in 2018. The cyber-economic espionage force will have no reason to exclude the Republic of Korea alone. Therefore, this article aims to contribute to cyber national policy and information activities by raising our measures including the enactment of the Basic Law on Cyber Security.
