국가사이버안전법제의 방향에 관한 연구 (Study on the Legislative Direction of National Security Laws)

초록

현재를 비롯하여 다가올 세상은 사이버를 매개로 하는 초연결사회로 정의되고 있으며, 개인과 사회 및 국가의 상호연동하게 되는 이러한 사회에 있어서는개인에 대한 사이버위협은 사회 및 국가에 대한 위협으로 이어지게 된다. 따라서, 국민을 보호할 책무를 지닌 국가로서는 초연결사회가 갖는 고도화된 위험에 대한 막연한 두려움을 떨치고 국민의 안전하고 자유로운 초연결사회의 이익을 향유할 수 있도록 사이버의 보안을 유지할 필요성이 있다. 이와같이 사이버의 보안을 보장하고자 할 경우에는 ‘미국자유법’에 의한 ‘미국애국자법’의 일부 규정에 대한 폐지의 예에서 보듯이 국가차원의 일방적인 사이버보안은 국가에의한 개인감시와 같은 국민적 불신에 직면함을 고려하여야 한다.
이러한 인식을 바탕으로 사이버위협에 대한 대국민 홍보.설득작업을 전제로 사이버보안법제는 다음과 같이 설계되어야 할 것이다. 첫째, 사이버보안의총괄청은 국민의 사생활보호와 긴장관계에 있다는 점에서 국가원수인 대통령직속기관을 총괄책임청으로 삼아야 한다. 둘째, 사이버위협에 대한 국가총력적대응을 위해서는 민관협치를 구현할 수 있는 독립행정법인이 설립되어야 한다. 셋째, 사이버위협의 수준에 따른 국가기관의 대응조치(표준조치)를 담은“국가사이버안전법”이 제정되어야 한다. 넷째, 사이버위협이 갖는 특성을 고려하여 악성프로그램방지법을 제정함과 아울러 사이버공격에 대한 실시간으로인적 대응을 가능하게 하도록 “비상대비자원관리법”이 개정되어야 한다. 끝으로, 민관 허브기관으로서 독립행정법인은 국가기관이 대민접점으로서 갈등을갖게 되는 사이버위협 관련사무를 위탁받아 수행하도록 하면서 사이버위협에언제든지 대응할 수 있는 민간 전문인력의 훈련과 대응기술의 개발에 노력할수 있도록 해야 한다.

Today’s society is becoming the technology advances of the past 100 years made are implemented in a year or two years, such speed is more accelerated and that direction is the real-time supplies on demands through ICT convergence products that can meet the human needs of all regions(political economy.
healthy.welfare, culture and so on) based on Internet. Individuals, communities and Nation under the hyper connected society are connected each other like the same organism. That is why the cyber-attacks on private premises is threatening the social and national security. In other words, Individuals, Communities and nation are the same destiny from the cyber threatens, so National Cyber Security is also true for personal safety and vice versa.
Shortly, there are conflicts between demand for cyber security and privacy requirements, the elimination of these conflicts is a key element of national cyber security strategy. Neglecting the cyber security in order to maximize personal privacy is meant to entrust our fate to the tyranny of hostile forces. On the other hand, if oriented to maximize the cyber security will fade democracy and to establish a totalitarian environment. As a result of the investment of our domestic and foreign enterprises and are kkichige an adverse effect on economic activity will result in undermining the country’s economic security. Therefore, legislation for the National Cyber Security requires a balance between the legal interest of national security and personal privacy.
Based on this recognition, legislation for the National Cyber Security will be designed as follows: 1. Executive Agency for the Safety of National Cyber shall belong to the President as a head of state that is responsible for the entire nation. 2. As a hub to connect the private and public institutions is an independent administrative entity to be established and this allows corporations to respond in real time to allow cyber threats. 3. The National Cyber Security Act to be enacted defines the standard precautions that can be taken, depending on the level and the level of cyber crisis. and so let the people know the contents of the right limited by the level of the cyber risk. 4. Malware Prevention Act considering the nature of cyber threats should be enacted to supported a “National Cyber Security Act”. In addition to the highest levels of national cyber crisis response is to enable national total war “Emergency Preparedness Resource Management Act” should also be amended. 5. On the one hand, an independent administrative corporation share information on national cyber threat as a public authority and, on the other hand, should be trained civilian experts to respond to cyber threats.
