초록

이 글은 조용수 사건의 재심판결에 대한 분석과 비판이다. 조용수는 4ㆍ19 이후 민족일보를 창간하고 이를 통해 진보적인 입장을 전파하였다. 1961년 군사반란에 성공한 박정희는 특수범죄처벌법을 공포하여 민주화의 공간에서 이루어진 정치적 표현들을 소급하여 처벌하였다. 조용수는 혁명재판소로부터 사형을 선고받고 1961년에 형이 집행되었다. 그후 2008년 법원은 재심재판을 통해 조용수에게 무죄를 선고하였다. 그러나 판결은 몇 가지 논리적 약점을 안고 있다. 법원은 특수범죄처벌법에 대해 위헌심판을 제청하지 않고 1962년 헌법부칙조항을 근거로 이 법이 현재에도 유효하다고 전제하였다. 하지만 법원이 1987년 현행헌법과 상충하는 1962년 헌법에 복종하는 것은 규범이론상 정당화될 수 없다. 또한 법원이 특수범죄처벌법의 유효성을 전제하면서, 동시에 법치국가적인 해석방법을 통해 이 법의 공격성을 완화시키는 것은 연대기착오이자 관점혼동이다. 특수범죄처벌법의 유효성을 전제할 때에는 강권적 확장해석만 가능하고, 무효라고 볼 때에만 법치국가적 해석이 허용되기 때문이다. 재판부가 무죄판결을 편의적으로 획득한 것이다.

영어초록

This study intends to give some comments on the judgement of the retrial concerning the Cho Yong-Su case. Cho ran for National Assembly in 1960 general election as a candidate of Social People Party, which was deemed as highly progressive. After Cho was defeated in the election, he founded the Minzok Daily News that spread the progressive opinions to the world.
In 1961, Park Jung-Hee succeeded in the military coup and illegally organized the Highest State Reconstruction Committee(HSRC). Cho was sentenced to death and executed by the Revolutionary Court on the ground of contravention of the special criminal act laid down by the HSRC. The special criminal act extremely denied the freedom of political expression and punished progressive people retroactively. Recently, Cho’s brother submitted the application for truth-finding of the case to the Truth and Reconciliation Commission. The Commission released the result of investigation and simultaneously recommended that the government should restore victim’s honor including the resumption of judicial retrial in 2006.
Thereafter, the retrial court declared Cho not guilty. But there are some serious logical inconsistencies or doubts in the judgement of retrial court. The court presupposed the validity of the retroactive special criminal law on account of additional clause of 1962 constitution which declared continuity of the special criminal act. This presupposition is arbitrary and illogical. The loyal judge should logically accept the normative priority of the current constitution in front of the collision between the 1962 constitution and the current constitution(1987).
The additional clause of 1962 constitution should be annihilated from the viewpoint of 1987 constitution and the retroactive criminal law should be declared void or unconstitutional. Nonetheless, the court declares Cho not guilty by restrictively interpreting the key concepts of the special criminal law. Such a restrictive interpretation results from perspective confusion or anachronism. The retrial court wrongly presupposed that the authoritarian version of the 1962 constitution is compatible with the alchemistic interpretation of retrial court. In conclusion, declaration of innocence is not available without dismissing the above-mentioned presuppositions of retrial court.
