통신산업과 디지털콘텐츠산업 간 갈등 현안 및 관리 방안: 한국의 갈등 사례에 대한 정성적 고찰을 중심으로 (Conflict Issues and Management Strategies between ISPs and CPs: A Qualitative Study of Conflict Cases in Korea)

본 연구는 국내 인터넷서비스사업자(ISP)와 국내외 콘텐츠제공사업자(CP) 사이에 발생하는 갈등 현안을 심층적으로 고찰하고 주요한 갈등 현안을 관리하는 방안을 모색하기 위해 통신산업 및 디지털콘텐츠산업 관련 전문가들을 대상으로 심층 인터뷰를 시행한 후 그 결과를 제시하였다. 연구 결과, ISP와 CP 간의 갈등 요소 중 가장 주요한 현안은 망 이용료 문제로 나타났고 이의 해결을 위한 핵심적인 갈등 관리 방안은 국내외 CP의 망 이용료 합리화와 관련한 제도 개선 으로 거론되었다. 이와 함께 ISP와 CP 간 갈등 관리를 위해서는 갈등 당사자 상호 간의 이해와 협력, 그리고 정부의 적극적인 중재 역할이 필수적인 것으로 확인되었다. 본 연구는 통신산업과 디지털콘텐츠산업 간에 형성된 갈등의 본질 및 관리 특성을 유형화하고 실무적 해결방안을 모색 했다는 데 그 의의가 있다.

영어초록

The intensifying conflicts between domestic Internet Service Providers (ISPs) and both domestic and international Content Providers (CPs) pose a serious threat to the sustainable development of the telecommunications and digital content industries. Accurately diagnosing the core issues underlying these conflicts and seeking mutually beneficial solutions among stakeholders is an urgent task. As ISPs and CPs each exert significant influence on the telecommunications and digital content industries, respectively, it is crucial to identify their conflicts and examine appropriate management strategies. Failure to accurately understand and resolve these conflicts may lead to stagnation in market growth and negatively impact consumer benefits, which, in turn, can cause persistent conflicts between ISPs and CPs and further hinder economic growth across various sectors. Therefore, identifying the current issues in the conflicts between ISPs and CPs and seeking amicable solutions is of utmost importance.
The main findings of this study reveal that experts recognized the following as the primary points of contention between the two types of service providers: sharing of investment costs for the construction and installation of 5G infrastructure networks, differential imposition of network usage fees, and ISPs' entry into the value-added telecommunications business. Experts emphasized that while ISPs should bear the primary burden of investment costs due to their ownership and rights over the networks, the increasing demand for content and the public good characteristics of networks necessitate the active participation and role of CPs and the government. Moreover, the results of this study urged qualitative and quantitative improvements in both domestic and international communication networks, emphasizing the need for policy, financial, and diplomatic support from the government. In particular, while experts shared the perception that ISPs should bear the basic investment costs based on their network ownership, they called for government support in light of the increasing need for overseas network investment due to the rise in traffic caused by CPs and the growing demand for global content. Additionally, opinions were expressed that differential imposition of network usage fees is reasonable as long as it does not violate the principle of network neutrality. However, it was emphasized that clear criteria for calculating network usage fees are necessary, and scientific methods should be used as a basis for determining these criteria. Finally, most experts did not show significant differences in their opinions regarding the conflict issues and management strategies, suggesting that these research results can help narrow the differences in opinions among stakeholders and lead to social consensus.
The implications of this study are threefold. First, the results indicate that conflicts between domestic ISPs and both domestic and international CPs exist on various levels, and resolving these conflicts requires cooperation among multiple stakeholders and an active role of the government. Second, by providing experts' perceptions, this study offers important foundational data for establishing realistic implementation plans, which can contribute to domestic ISPs and CPs collaborating to gain competitiveness in the international telecommunications market. Third, by emphasizing that the government's role is even more crucial than the efforts of domestic ISPs in global network competition, this study can contribute to setting the policy direction for the domestic telecommunications and content industries.
