초록

2007년 미국에서 발생된 금융위기가 세계적으로 확산되면서 각국 정부는 금융위기를 탈피하기 위한 금융입법상의 개혁을 단행하였다. 전형적인 계획경제의 금융체제를 갖추고 있던 중국도 1978년 개혁개방을 기점으로 발전을 거듭하며 금융법체제를 정비해 왔는데, 특히 2002년 WTO 가입으로 금융개혁을 급속히 진행하여 금융법체제의 틀을 확립하게 되었다. 구체적으로 중앙은행을 중심으로 다양한 금융기관 간의 상호협력을 바탕으로 하는 혼합 금융체제를 구축하여 금융거래․금융조직 및 금융감독 관련 법규를 포함하는 포괄적인금융법체제를 갖추게 되었다. 전통적으로 중국은 금융업 간 분업주의를 원칙으로 하였으나 최근 세계 금융시장이 분업화가 아닌 겸업화 추세를 취하고 있고 이에 중국 금융시장에서도 제한적인 범위 내에서금융업 간의 겸업이 실행되고 있다. 그러나 중국은 금융업 전체를 통합․감독하는 기관을별도로 구비하고 있지 않을 뿐만 아니라 최근 실무적으로 금융지주회사 방식을 통하여 겸업을 행하는 종합 금융기관들이 늘어났음에도 불구하고 그 법적 근거나 규제가 미약했기때문에 이에 관한 효과적인 대처방안을 정부 및 학계에서 논의하고 있는 실정이다. 게다가최근 중국 금융시장의 영향력이 세계적으로 확대되고 있고 중국과의 무역거래 내지 금융거래도 폭발적인 증가 추세를 보이고 있으며 특히 국내의 은행이나 보험사들이 중국에 현지 법인을 설립하거나 영업소를 개설하는 등 대중국 투자를 확대하고 있는 실정이다.따라서 이러한 시기에 중국 금융법제를 이해한다는 것은 대중국 금융시장에 대한 성공적인 투자라는 실무적인 필요 측면에서 충분한 의의가 있다고 본다.

영어초록

Governments shuffled to the urgent financial reform policy in order to overcome thefinancial crisis as the financial crisis that occurred in the United States in 2007 spreadaround the world. China was equipped with financial system of traditional plannedeconomy. But China has experienced the maintenance of the finance legal system whilepassing through reform and opening-up in 1978. Especially China has progressed reformrapidly as an opportunity to WTO accession in 2002 and as a result the basic frameworkof the finance legal system was formed in China. Specifically on the basis of co-operationbetween the various financial institutions with a focus on the central bank,comprehensive mixed finance legal system that was including to regulations of financialtransactions․financial organizations and financial supervision was able to be built. Traditionally the financial sector in China has been the principle of division of labor. But global financial market trends are taking a diversification rather than specializationrecently. Therefore the financial sector within the limited range have been madediversification in the Chinese financial market. But China does not place of a separateagency to integrate and oversee the whole of each financial. Especially China has discussed in order to provide an efficient countermeasures because there is no legal basisand regulations in spite of many comprehensive financial institutions have combinedbusiness through a financial holding company. Latest the influence of the Chinesefinancial market is expanding in the world and China trade and financial transactionsshowing a trend of explosive growth. In particular, domestic banks or insurancecompanies expand investments for China through establish as a legal entity or open asales office. Therefore, I think that the understanding of the China finance legal system shalltimely and sufficient significance also for the comparative legal studies as well as thepractical needs in order to gauge effective regulatory measures for combined businessof the Chinese government and to lead a successful investment in China.
