건설 현장 산업재해 예방을 위한 안전관리 개선방안:법제도 및 관리 감독체계를 중심으로 (A Study on the Improvement of Safety Management for the Prevention of Industrial Accidents in Construction Sites: Focusing on the Legal System and Management Supervision System)

초록

본 연구는 건설 현장의 사망사고 감축을 위한 안전관리 제고 및 재해예방 정책의 방향성을 모색하고자 건설 현장 안전관리 실태와 문제점을 분석하였다. 기존의 건설 현장 안전과 관련한 연구들이 주로 안전 공학적 관점에서의 기술적 분석과 대안을 제시하였다면, 본 연구는 법 제도와 정부의 관리 감독 기능을 중심으로 거시적인 안전 관리체계를 다루었다. 건설 현장 산업재해 발생 수준이 개선되지 못하고 있는 상황에서 최근 3년간 정부는 대대적인 법제도 개편과 조직인력 확충을 통해 문제해결을 시도하였다. 본 연구는 이러한 정책 방향에 대한 실태와 문제점을 심층적으로 검토하여 향후 정책이 집중할 부분을 제시하였다.
첫째, 건설 사고의 현황을 분석하여 사망사고가 빈발하는 소규모 사업장, 추락 유형, 미숙련 근로자의 특성을 도출하였고 이에 자원을 집중하여 예산 투입, 안전기준 강화, 특성에 따른 안전교육 강화 등이 필요함을 제시하였다. 둘째, 법제도 측면에서는 고용노동부-국토교통부의 규제 중복의 문제와 형식적 서류 중심 규제의 문제, 그리고 책임 강화의 문제를 중심으로 검토하였다. 마지막으로 그동안 산업안전관리 조직이 실효성 없이 확대되는 경향이 있었기 때문에 향후 조직규모를 확대하기보다는 전문성 있는 현장 관리 감독조직으로 개선하는 기능의 합리화가 필요하다.

This study aims to examine legal and organizational conditions of disaster prevention at construction sites in order to make a policy recommendation, Particularly this study focuses on fatal accidents and identifies the problems in relevant regulations, governmental function of oversee, and behavioral defects of employees in construction industry. While existing studies approach from a technical perspective and suggest alternatives from a safety engineering perspective, this study deals with the safety management system from a macro perspective, focusing on the legal system and the government’s management and supervision functions.
Over the past three years, the government has attempted to solve the problem through extensive legal system reform and expansion of organizational personnel, but the level of industrial accidents at construction sites has not been improved. By examining in-depth problems of those policy directions, this study make recommendations as follows; First, this study analyzes the statistics of construction accidents, figuring out the most frequent accidents from small sites, fall types, and unskilled workers. It is recommended to focus resources on budget input, strengthen safety standards, and strengthen safety education.
Second, in terms of the legal system, the major problems this study addressees are the overlapping regulations between the Ministry of Employment and Labor and the Ministry of Land, Infrastructure and Transport, and too much formality in regulations.
Lastly, the industrial safety management organization has tended to expand without effectiveness. Rather than expanding the size of the organization, it is necessary to rationalize the function of supervision at construction sites and improve their expertise.
