현행 압수·수색제도의 문제점과 개선방안: 정보저장매체의 특성을 중심으로 (Issues with the Current Search and Seizure System and Its Improvement: Focusing on Characteristics of Information Storage Media)

초록

본고는, 각종 정보저장매체의 특성과 이에 기한 압수·수색제도의 문제점을살펴보고, 실제로 현행 정보저장매체에 관한 압수·수색제도의 효율성 제고 및피처분자 등(소유자 등)의 기본권 보호 그리고 적법한 절차를 확보할 수 있는입법적 개선방안을 제시하였다. 즉, 정보통신기술의 발달로 인하여 각종 정보저장매체에 관한 압수·수색의 중요성을 고려해 볼 때「형사소송법」상에서 정보저장매체에 관한 압수·수색의 효율성을 제고하면서도 피처분자 등(소유자등)의 기본권을 보호할 수 있도록 하는 내용으로 그에 관한 압수·수색의 권한과 한계를 명확히 규정할 필요가 있다. 이에 따라, 2011.7.18.「형사소송법」 상에, 정보저장매체 등에 관한 압수의 범위와 방법을 명시하고(§106➂), 그 정보주체에게 해당사실을 알리도록 하는 내용(§106➃)의 정보저장매체 등의 압수에 관한 규정이 신설되었다. 그러나 이러한 입법적 노력에도 불구하고, 정보저장매체에 관한 현행 압수·수색절차는 압수의 범위와 방법(§106➂), 정보주체에 대한 통지(§106➃) 및 영장기재 사항(§114①단서) 등 신설된 규정이 적용되는 몇몇 절차를 제외한 다른 절차는 기존의 압수·수색에 관한 규정에 따라집행되고 있고, 그 압수·수색에 관한 기존의 규정들은 대량성, 비가시성·비가독성 등 정보저장매체의 특성을 제대로 반영하지 못한 문제가 있었다. 이에 본고는, 각종 정보저장매체의 특성(대량성, 비가시성·비가독성, 전문성등)과 일본의입법례(원격접속 및 복사 후 압수: §99②·218②➤⑴, 기록명령부 압수: §99조 의2➤⑵, 전자적 기록과 관련한 기록매체 압수에 갈음하는 처분: §110조의2➤ ⑵, 협력요청: §111조의2➤⑶ 등)를 반영하여, 현행 압수·수색제도의 효율성을제고하면서도 피처분자 등(소유자 등)의 기본권을 보호할 수 있는 ⑴ 연결정보에 대한 압수·수색, ⑵ 정보명령에 대한 압수·수색, ⑶ 정보협력에 대한 압수·수색, ⑷ 정보복제에 대한 참여권 보장, ⑸ 복제정보에 대한 반환 및 폐기절차의 합리적 입법보완을 위한개선방안을 제시하였다.

영어초록

The current study is to examine characteristics of various information storage media and problems associated with current search and seizure systems and to propose various ways to improve efficiency of current search and seizure systems regarding information storage media, protect fundamental rights of a person who is executed and the like(owner and the like), and secure legal procedures. Considering the importance of search·seizure regarding various information storage media due to development of information technology, it is necessary to clearly define authority and limit of search·seizure, protect fundamental rights of a person who is executed and the like(owner and the like) and improve efficiency of search·seizure concerning information storage media in「Criminal Procedure Act」 . Accordingly, on July 18, 2011 in「Criminal Procedure Act」 , provisions about scope and method of seizure concerning information storage media and the like (§106➂), and a notification of relevant facts to data subject (§106➃) were newly established.
However, despite such efforts, current search and seizure procedures concerning information storage media are executed according to existing provisions about search·seizure except some procedures that newly established provisions are applied such as scope and method of seizure(§106➂), notification to data subject(§106➃) and matters to be written in warrant(§114① proviso) and existing provisions concerning search·seizure do not reflect characteristics of information storage media such as massiveness, invisibility and unreadableness. This paper presented ways to improve ⑴ search·seizure concerning ‘linking information’ ⑵ search·seizure concerning ‘information order’ ⑶ search·seizure concerning ‘information cooperation’ (4) guarantee of rights to participate in ‘information reproduction’ and (5) return and destruction procedures for ‘reproduction information’ by reflecting characteristics of information storage media(massiveness, invisibility· unreadableness, expertise) and legislation cases in Japan(seizure after remote access and reproduction: §99②·218②➤⑴, seizure of record order copy: §99-2➤⑵, execution in lieu of seizure of record media concerning electronic record: §110-2➤⑵, request for cooperation: §111-2➤⑶) that can improve ‘efficiency’ of current search·seizure and protect ‘fundamental rights’ of a person who is executed and the like(owner and the like).
