초록

최근 국토의 합리적 이용 및 지역 균형발전을 위해 토지수용이 증가하고 있다. 지난 2002년‘대전용두1지구 재개발 사업’에서는 피수용자와 사업시행자 간의 보상협의가 되지 않아 마찰을 빚었다. 당시LH공사(대한주택공사)는 철거용역 350여명을 동원한 강제집행으로 물리적 충돌과 함께 사상자가 발생하였으며, 피수용자들은 대전 중구청 앞에서 무려 500일 동안 천막 노숙하며 집단시위를 벌였다.
또, 지난 2009년「용산4구역 재개발사건」에서 알 수 있듯이 조합원과 세입자간의 보상갈등과 대립이‘용산참사’로 이어져 수많은 인명피해가 발생했다. 이러한 집단 시위 사건 이후 원활한 공익 사업추진을 위한 제도 개선이 이뤄지고 있으나, 끊임없는 보상갈등이 잠재(潛在)되어 있는 현실이다. 본 연구는 사업시행자와 피수용자들 사이에 보상갈등 문제점을 밝혀 개선해야 할 필요에 의해 시작되었다.
공익사업 보상행정에서 나타난 보상제도의 문제점을 개선하기 위해 대전광역시 보상현황 및 토지수용 실태를 분석하고, 사업단계별 보상 만족도 측정을 통해 불만요인을 밝혀냈다. 정책 대안 도출을 위해AMOS(Analysis MOment Structure) 모형으로 경로분석 및 만족도를 분석한 결과, 실증적 시사점으로는 공익사업시행시 피수용자의 만족도는 △사업준비 M=3.99, △사업시행 M=3.76, 보상계약 =3.55으로 나타났다. 성별 만족도는 남자가 M=3.95점으로 여자 M=3.66보다 높게 나타났으며 t=2.103, p=.37로 유의수준 p<.05 수준에서 유의하게 나타났다. 또한 연령에 따른 만족도는 50~59세에서 M=4.10으로 F=3.15, P=.015 유의수준 p<.05 수준에서 유의하게 나타났다.
사업단계별 개선방안으로 준비단계에서는 △보상담당 전문능력 배양 △잔여지 매수규정 완화 및 적극매수이다. 시행단계에서는 △공시지가 현시가 반영 △ 공정한 보상평가 제도 확립이며, 보상계약 단계에서는 △성실한 보상협의 △공익사업 보상중재 규정 마련이 필요하다.

Recently, land expropriation increases for the rational use of land and the balanced regional development.
There was a conflict in “Redevelopment project of Yongdoo District 1, in Daejeon" in 2002, because the compensation scheme was agreed between those who are expropriated and the developers. The compulsory execution by the Korean National Housing Corp that mobilized 350 service-people for tearing-down caused physical confrontation and casualties. And those who are expropriated held mass protest, sleeping in the tents,in front of Daejeon-Jungguchung for almost 500 days. Also, as known in "The Yongsan District 4 Incident”in 2009, the conflict and the confrontation between the union members and the tenants, regarding the compensation scheme lead to “Yongsan Disaster”, resulting in many casualties. Since the mass protests like these, some improvement of system have been made for the seamless progression of projects. However, there is still the possibility of potential conflicts about compensation. This research was conducted to investigate the conflicts regarding the compensation between those who are expropriated and the developers. Thus, this research analyzed the state of the compensation in Daejeon and the state of land expropriation and discovered the conflicting factors through the measurement of the satisfaction level about the compensation by the phase of the project, in order to improve the problems regarding the compensation system that appeared in the administrative works for the compensation. To derive the alternative policies, a path analysis was conducted and the satisfaction level was analyzed using AMOS(Analysis Moment Structure). As a result, with respect to the empirical implications, the satisfaction level of those who were expropriated was: △ preparation for projet:M = 3.99, △ project implementation: M = 3.76, compensation agreement = 3.55, respectively. The satisfaction level by gender was : Men: M = 3.66 and Women: M = 3.95. With t = 2.103, and p = .37, it was observed significantly within the level of significance of p <.05 level. With respect to the improvement schemes by the phase of project, the phase of preparation requires △training the experts specialized in the compensation,△alleviating the regulations on the rights to purchase the residual land and aggressive land purchase. The phase of implementation requires △the officially assessed land price should reflect the actual land price △the establishment of fair compensation evaluation system. And the phase of compensation agreement requires △ faithful negotiation for the compensation and △ the preparation of the arbitration provisions regarding the compensation arising from the public works.
