정책의 법제화 소요기간 영향요인 분석: 지방정부의 조례안 발의 이후 정치적 과정을 중심으로 (Analysis of Factors Affecting the Time Required for the Legislation of Policies: Focused on the Political Process after the Proposal of the Bill of an Ordinance in Local Governments)

기관대립형 구조를 채택하고 있는 우리나라 지방자치는 정책들이 입법행위(조례)를 통해 구현된다. 본 연구는조례 제정안을 지방자치단체의 정책으로 간주하고, 조례안이 발의된 이후 지방의회에서 처리되는 정치적 과정을 중심으로 법제화 소요기간의 영향요인을 규명하였다. 이를 위해 제주특별자치도와 세종특별자치시 및자료이용이 불가능한 전라북도를 제외한 우리나라 전체 광역자치단체를 대상으로 2002년 7월 1일부터 10 년간 조례 제정안 2,876개를 대상으로 실증분석을 실시하였다. 분석 결과 모형 1(상임위원회까지 처리 소요기간 모형)과 모형 2(본회의까지 처리 소요기간 모형) 모두에서 유의미한 영향을 미치는 요인은 조례안 처리결과, 조례안 발의시점, 정부구성형태로 분석되었다. 의원 1인당 사무직원 수는 상임위원회까지 처리 소요기간 모형에서, 전국단위 선거 실시 여부는 본회의까지 처리 소요기간 모형에서 각각 유의미한 요인으로 판별되었다. 본 연구는 광역자치단체 정책의 법제화 또는 조례안 처리 소요기간에 영향을 미치는 요인으로 정부구성형태, 전국단위 선거 실시 여부 등과 같은 정치적 요인을 새롭게 발견하고 연구대상의 외연을 확장했다는데그 의의가 있다. 또한 분석결과를 토대로 우리나라 지방자치제도의 발전을 위한 정책적 함의를 제시하였다.

영어초록

In local governments of South Korea, which adopt the structure of the presidential system, policies are implemented through legislative activities (ordinances). This study regarded the bill of enacting an ordinance as a policy of a local autonomous entity and investigated the factors affecting the time required for legislation, with a focus on the political process for handling the bill of an ordinance at the local assembly after the proposal of the ordinance. For this purpose, with the exclusion of Jeju Special Self-Governing Province, Sejong Metropolitan Autonomous City, and Jeollabuk-do Province, for which data could not be used, this study employed data from all metropolitan councils in South Korea to conduct an empirical analysis of 2,876 bills for enacting ordinances from July 1, 2002, for 10 years. The analysis shows that the point in time of the proposal for an ordinance and the formation of the government were the factors having significant impacts in both Model 1 (model of the time required for handling the bill till it reaches the standing committee) and Model 2 (model of the time required for handling the bill till it reaches the plenary session). The number of clerical employees per assemblyperson was found to be a significant factor in both the model of the time required for handling the bill till the standing committee and whether a national election is held and in the model of the time required for handling the bill till the plenary session. This study has significance in that it has discovered new policy factors, such as the formation of the government and the implementation of a national election, as factors affecting the legislation of policies in metropolitan councils or the time required for enacting an ordinance, and has expanded the scope of the subject of study. In addition, based on the results of the analysis, this study proposes policy implications for the development of the local government system in South Korea.
