초록

본 논문은 북한 발명·특허법과 제도의 현황을 살펴보고, 개선이 필요한 영역을 파악하며, 남북 간 특허 협력 가능성을 모색한다. 북한은 여러 지식재산권 조약에 가입하고 발명법을 제·개정했음에도 불구하고 글로벌 기준에 비해 낙후되어 있다. 주요 문제로는 세부 규정과 지침의 부족, 북한 특허 관리의 기술적 역량에 대한 의문, 그리고 국내외 특허 출원 건수의 저조함 등이 있다. 남북합의서 또한 지식재산권 보호에 대한 명목상의 협력에 관한 내용이 포함되어 있지만, 실질적인 이행은 정치적 민감성과 현재의 남북관계 경색으로 인해 어려움을 겪고 있다. 그럼에도 북한 특허 환경을 이해하고 향후 협력 방안을 모색하는 것은 남한의 발명을 보호하고 남북 간 장기적인 경제협력을 촉진하는 데 중요하게 작용할것이다.
구체적으로 본 연구는 북한의 법률 문서와 특허 공보 등 1차 자료를 활용하여북한 발명법과 특허심사 절차를 심층 분석한다. 구체적으로 북한 발명법을 비롯하여 특허절차를 살펴보고 최근 특허 동향을 살펴본다. 본 논문은 북한에서 자신의 지식재산권을 보호하고자 하는 남한 발명가들을 위한 잠재적 전략으로 국제특허협력조약(PCT) 출원을 제안한다. 다른 가능한 협력 메커니즘으로는 실용신안 제도가 다루는 소발명부터 시작하여 특허 유효성을 인정하는 남북합의 등이있다.
본 논문은 북한 특허 제도에 적극적으로 관여하고 남북 간 지식재산권 협력의문을 열어두는 것이 북한의 국제 규범 준수를 장려하고, 향후 남북 관계 개선 시남한의 경제적 이해관계를 보호하며, 장기적으로 안정적이고 통합된 한반도 전역의 혁신 생태계에 기여할 수 있다고 결론 짓는다. 이러한 노력은 특허가 다른 형태의 기술 교류에 비해 정치적 민감도가 낮다는 점에서 더욱 의의가 있다. 정책수립에 정보를 제공하고 남북 협력의 건설적인 방안을 모색하기 위해서는 북한지식재산권 환경에 대한 지속적인 분석이 필요하다.

영어초록

This article examines the current state of North Korea’s patent laws and system, identifies areas for improvement, and explores the potential for inter-Korean patent cooperation.
Despite acceding to several international intellectual property (IP) treaties and enacting a domestic Invention Law, North Korea’s patent system remains underdeveloped compared to global standards. Key issues include the lack of detailed rules and guidelines, questions over the technical capacity of North Korean patent officials, and low numbers of domestic and international patent applications.
While inter-Korean agreements have included nominal commitments to cooperate on IP protection, substantive implementation has been hindered by political sensitivities and the current worsening relations. Nonetheless, this article argues that understanding the North Korean patent landscape and exploring avenues for future cooperation is important for both protecting South Korean inventions and fostering long-term inter-Korean economic collaboration.
Specifically, the study conducts an in-depth analysis of North Korea’s Invention Law and patent examination procedures, drawing upon primary sources including North Korean legal documents and journals. It also examines recent trends in North Korean patent filings by technology sector and inventor demographics. The article suggests filing international Patent Cooperation Treaty (PCT) applications as a potential strategy for South Korean inventors seeking to protect their IP rights in North Korean jurisdiction. Other possible cooperation mechanisms include an inter-Korean agreement to recognize patent validity, starting with minor inventions covered by utility model systems.
The article concludes that actively engaging with the North Korean patent system and keeping the door open for inter-Korean IP cooperation can incentivize North Korea’s compliance with global norms, protect South Korean economic interests in any future rapprochement, and contribute to a stable and integrated peninsula-wide innovation ecosystem over the long term. Such efforts have added significance given the lower political sensitivities around patents compared to other forms of technology exchange. Ongoing analysis of the North Korean IP landscape is warranted to inform policy and to identify constructive avenues for inter- Korean cooperation.
