GATT 제21조 안보예외의 WTO 보조금협정 적용 가능성에 대한 고찰-GATT 제20조 일반예외 법리와의 유기적 분석을 중심으로- (A Study on the Applicability of Security Exceptions under Article XXI of the GATT to the WTO SCM Agreement)

초록

국가안보를 이유로 하는 예외규정은 그간 주장에 대한 확인이나 간접적인 비교로만 사용되고 그다지 적극적으로 원용되지 않았다. 하지만 최근 보호무역주의의 강화와 확산, 다자간 협력체제의 약화 속에 국가안보 예외규정, 특히 GATT 제21조 안보예외의 원용이 급증하고 있다. 이러한 추세는 국가안보의 보호를 이유로 미국이 취하고 있는 무역제한 조치에서 두드러지게 나타나고 있다. 이와 함께 산업보조금과 역외보조금 문제가 심화되면서 국제통상체제에서 보조금이 화두로 떠오르고 있다.
보조금은 WTO 보조금협정에 따라 규율되는데, 보조금협정은 일반예외 및 안보예외에 대한 규정을 두고 있지 않다. 관련하여 GATT 제20조 일반예외가 보조금협정을 위시한 다른 WTO협정에 적용되는지 여부에 대한 선행연구는 어느 정도 존재하지만, GATT 제21조 안보예외가 보조금협정에 적용되는지 여부에 대한 논의는 거의 있어 보이지 않는다. 이에 따라 본 논문은 보조금협정에 GATT 제21조 안보예외가 원용될 수 있는지 여부를 고찰해 보고자 한다. 이를 위해 본 논문은 먼저 GATT 제20조 일반예외가 여타 상품부속협정, 특히 보조금협정에 적용되는지 여부에 대한 논의를 학설과 판례를 중심으로 전반적으로 살펴본다. 다음으로 GATT 제21조의 적용과 해석에 대한 포괄적인 사법적 판단이 최초로 이루어진 2019년 Russia－Traffic in Transit 사건의 패널 판정을 바탕으로, 본 논문은 GATT 제21조 안보예외가 보조금협정 위반에 적용되는지 여부를 분석해 본다.

영어초록

Over the past decade, security exceptions were relied rather on sporadic and informal occasions, and were not invoked actively. However, in the midst of the expansion of trade protectionism and deterioration of multilateral cooperation system, the invocation of security exceptions, particularly under Article XXI of the GATT, has proliferated. The most obvious and consequential examples of this trend are the trade restrictive measures allegedly taken for the protection of national security by the United States. In the meantime, with the arise of industrial subsidies and transnational subsides, the issue of subsidies has recently come to the fore in the international trading system.
Subsidies are disciplined under the WTO SCM Agreement, but the SCM Agreement lacks general and security exceptions. The issue of the applicability of general exceptions under Article XX of the GATT to other WTO agreements, including the SCM Agreement, is appearing quite frequently before the WTO dispute settlement system, and thus over the recent years a lively discussion has emerged on this issue. However, the issue of whether security exceptions under Article XXI of the GATT would be available to justify measures inconsistent with the SCM Agreement, devoid of such exception, has still remained untouched. Accordingly, this paper aims to examine whether GATT Article XXI can apply to the SCM Agreement. This paper first introduces arguments in favor and against the applicability of GATT Article XX to the SCM Agreement, along with relevant cases. Then the paper analyzes the applicability of GATT Article XXI to the SCM Agreement, based on the ruling in the Russia–Traffic in Transit case in which, for the first time, security exceptions under Article XXI of the GATT have been interpreted and applied by a WTO Panel in 2019.
