WTO 반덤핑협정의 피해 유형 중 ‘국내산업 확립의 실질적 지연’에 관한 법적·실무적 쟁점 연구 (A study of Legal and Practical Issues on “Material Retardation of the Establishment of Domestic Industry” under the WTO Anti-Dumping Agreement)

초록

1994년도 관세 및 무역에 관한 일반협정 제6조의 이행에 관한 협정(Agreement on Implementation of Article Ⅵ of the General Agreement on Tariffs and Trade 1994, 이하 ‘반덤핑협정’ 또는 ‘협정’)은 ‘피해’를실질적 피해, 실질적 피해의 우려, 또는 국내산업 확립의 실질적 지연이라는 세 개 범주로 정의하고 있는반면, 실질적 피해나 피해의 우려와 달리 ‘국내산업 확립의 실질적 지연’의 구체적 판단 기준을 제공하고있지는 아니하다. 본 고는 ‘국내산업 확립의 실질적 지연’ 유형의 피해판정을 최초로 다룬 Morocco - Hot Rolled Steel 사건의 주요 판정 내용을 검토하고, 현행 WTO 판정과 해석을 ‘산업 확립의 실질적 지연’ 유형의 피해조사에 적용 시 발생가능한 실무적 쟁점과 WTO 판정의 규범적 한계를 비판적으로 고찰한다.
판례법상 피해의 유형에 관계없이 모든 경우에 적용되는 반덤핑협정 제3.1조 내지 3.4조 상의 검토 의무는일부 ‘국내산업 확립의 실질적 지연’ 유형의 피해를 분석함에 있어 내재적 어려움을 발생시킨다. 동 유형과관련된 반덤핑협정의 규범적 공백은 앞으로도 협정의 법적 해석과 실무적 적용 간의 괴리를 일정 부분야기할 것으로 예상된다. 무역구제제도가 ‘확립 중인 산업’에 대해 적극적으로 활용될 가능성을 배제할수 없는 현시점에서 ‘국내산업 확립의 실질적 지연’ 유형의 피해조사와 관련한 정제된 검토 기준의 수립이다자적으로 공유되고 논의될 필요가 있다.

영어초록

The Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994, hereinafter referred to as the “Anti-Dumping Agreement” or the “Agreement,” defines “injury” in footnote 9 of Article 3 as three categories: material injury, threat of material injury, or material retardation of the establishment of a domestic industry. This paper examines issues that may arise in determining injury under the type of “material retardation of the establishment of a domestic industry” by analyzing the Panel ruling in Morocco – Hot-Rolled Steel, which first dealt with the determination of injury of this type, as well as relevant rules and practices of major countries, and reviews the normative limits of the Anti-Dumping Agreement.
The current Anti-Dumping Agreement lacks a definition of “establishment of a domestic industry” or specific criteria for determining “material retardation.” On the other hand, the obligation to examine under Articles 3.1 to 3.4 of the Anti-Dumping Agreement, which applies in all cases regardless of the type of injury under case law, poses inherent difficulties in analyzing the injury of some types of “material retardation of the establishment of a domestic industry.” Normative gaps in the Anti-Dumping Agreement related to this type are expected to cause some discrepancy between legal interpretation and practical application of the Agreement in the future. Given the possibility that trade remedy systems may be actively utilized for “industries in establishment,” it is especially necessary to start the multilateral discussion on the refined standard for investigations of injury under the type of “material retardation of the establishment of a domestic industry."
