헌법상 반부패조항으로서 헌법 제46조에 대한 헌정사적 비판 (Criticism of Article 46 of the Constitution from the perspective of the constitutional history of Korea)

초록

본 연구는 현행 헌법의 부패방지를 위한 근거 규정 중 하나인 헌법 제46조가 전체 공직 영역에 요청해야 할 청렴 및 반부패 의무를 ‘국회의원’에게만 한정하여 부과한 이유에 대한 설명의 필요성이 있다는 문제 의식를 가지고 출발한다. 현행 헌법 제46조의 도입 경로를 살펴볼 때, 당시 개헌의 주도권을 장악하고 있던 군인 독재세력이 헌법상 국회의원의 반부패 의무 규정을 도입한 것에는 국회를 중심으로 한 정치 세력을 부패세력으로 낙인찍고 군인 지배의 당위성을 확보하기 위한 선전 수단으로 동원한 의도가 있다는 의구심을 가질 수 있었으며, 본 연구는 이를 더 정확하게 확인하기 위한 헌법해석론적 관점 및 헌정사적 관점에서의 분석을 시도하였다.
그 결과를 정리해보면, 1)헌법해석론적 관점에서 헌법 제46조는 헌법상 반부패조항으로서 특별한 의의와 기능을 갖지 못하고 있다는 점, 2) 헌법 제46조 제1항 국회의원 청렴 의무 및 제3항 국회의원 지위 남용 금지 규정은 국회의원을 부정축재 및 부패의 위험 요인을 강하게 가진 기관으로 낙인찍어 군인 지배의 정당성을 확보하는 데 활용한 선전 도구로써의 성격을 갖고 헌법에 편입되었다는 점, 3) 헌법 제46조 제2항 국익우선 의무는 헌법이론적 층위에서 자유위임, 정당기속의 한계를 규율하는 의미를 부여받고 있지만 도입의도 면에서는 군인 지배의 정당성 확보와 연관을 갖는다는 점 등을 확인할 수 있었다.
부패 척결의 예리한 칼날은 민주적 헌법국가의 성공을 위해 반드시 필요한 도구이다. 하지만 때로는 이 도구가 부정의한 권력의 치부를 은폐하기 위한 도구로 동원되었다는 역사적 사실을 망각하지 않고 이를 비판적으로 바라보는 성찰도 필요하다. 그리고 이러한 성찰을 토대로 헌법 제46조를 다시 이해하고 그 존속을 논의할 필요가 있다.

영어초록

This study begins with with the awareness of the need to explain why Article 46 of the current Constitution, which is one of the provisions for preventing corruption, imposes the obligation of integrity and anti-corruption on "members of the National Assembly" only, instead of requesting it for the entire public sector. When examining the introduction path of Article 46 of the current Constitution, the following doubts could be raised. At that time, the military dictatorship, which had the initiative to amend the constitution, branded politicians such as members of the National Assembly as corrupt groups and used the constitutional amendment as a means of propaganda to secure the legitimacy of military rule. This study attempts to analyze this issue from a constitutional interpretation perspective and a constitutional history perspective to confirm this more accurately.
In summary, the results of this study are as follows: 1) from a constitutional interpretation perspective, Article 46 of the constitution does not have a special significance or function as a provision against corruption in the constitution, 2) the obligation of National Assembly members to maintain integrity in Article 46(1) and the prohibition of abuse of their position in Article 46(3) were included in the constitution as propaganda tools to label National Assembly members as a strong factor of corruption and abuse of power and to secure the legitimacy of military rule, and 3) the obligation to prioritize national interests in Article 46(2) is given the meaning of binding to the Political Party and free Mandate from a constitutional theory perspective, but is associated with securing the legitimacy of military rule in terms of its introduction.
The sharp blade of fighting corruption is a necessary tool for the success of a democratic constitutional state. However, sometimes it is necessary to reflect critically on the historical fact that this tool was used as a tool to cover up the unclean power. And based on this reflection, it is necessary to understand Article 46 of the Constitution again and discuss its existence.
