자유무역협정(FTA)과 반덤핑 발동에 대한 실증연구 (An Empirical Investigation on FTAs and Antidumping Filings)

초록

FTA 체결로 관세 및 비관세 장벽이 제거되고 이로 인해 FTA 회원국으로부터 수입이 급증하면 국내기업의 반덤핑 제소가 더욱 빈번해져서 반덤핑 조사 건수가 많아 질 수 있다. 또한 반덤핑 발동 여부는 반덤핑 조사 당국의 자의적 판단에 크게 의존하는데, 양국의 교역을 촉진하기 위해 FTA를 체결하기 때문에 FTA 회원국에 대한 반덤핑 조사는 자제될 수 있다. 이렇듯 FTA로 인해 반덤핑 조사를 증가시키는 요인과 감소시키는 요인이 동시에 존재하기 때문에 이론적인 관점에서 볼 때 FTA와 반덤핑 사용 빈도의 관계는 불분명하다.
본 연구는 자유무역협정(FTA)의 체결이 반덤핑 조사의 발동에 미치는 영향을 전 세계 주요 FTA를 대상으로 실증분석하였다. 반덤핑에 영향을 미치는 거시경제적 변수를 분석한 선행연구에서 공통적으로 지적하고 있는 과거 3년간 평균성장률, 실업률 및 실질환율 등을 포함하였다. 또한 본 연구의 실증분석은 반덤핑 조사 건수라는 가산자료(count data)을 이용하기 때문에 포아송 회귀분석(Poisson regression)과 음이항 회귀분석(negative binominal regression)을 적용하였다. 또한 반덤핑의 연도별 절대적 건수는 그 시기에 따라 크게 달라질 수 있다. 이러한 가능성을 검토하기 위해 반덤핑 조사 건수 대신에 피제소 국가가 제소국가의 전체 반덤핑 조사 건수에서 차지하는 비율을 종속변수로 설정하여 FTA가 이에 미치는 영향을 분석하였다.
본 연구의 분석 결과, FTA 체결이 반덤핑 조사 건수를 증가시키는 것으로 나타났다. 이는 FTA 체결로 증가된 수입에 대응하기 위해 국내기업이 반덤핑을 적극적으로 활용하고 있다는 것을 시사한다. 이러한 분석 결과는 우리나라 기업이 반덤핑 조사의 주요 대상국이 되는 국가와 FTA를 체결할 경우에 회원국에 대한 반덤핑 적용을 면제하는 규정을 FTA 협정에 포함하여 반덤핑 조사 대상에서 제외되어야만 FTA로 인한 수출 증가효과를 실질적으로 누릴 수 있다는 것을 함의한다.

영어초록

We observe the remarkable phenomena in the recent world trade trends: sharp increase of antidumping and proliferation of regional trade agreements (RTAs). As traditional tariff barriers have come down worldwide in recent decades, the usage of ‘unconventional’ trade protection measures has grown. In particular, antidumping (AD) investigations have risen rapidly and have growing impact on world trade flows. In addition, the second wave of regionalism has been spreading over a globalizing world economy, i. e. regional trade agreements are proliferating.
While a number of studies have documented the incidence of antidumping cases across users of antidumping laws and the motivations of proliferating RTAs, there has been little examination of how FTAs affects on the decision of antidumping investigations.
This paper studies the impacts of FTAs on the antidumping filings. From the theoretical perspectives it is difficult a prior to evaluate the effects of FTAs on antidumping filings since there exist two forces simultaneously that increase and decrease antidumping investigations. The elimination of the tariffs and the non-tariff barriers by an FTA leads to the increase in imports which may induce the increase of antidumping petitions by the import-competiting industries. Although the WTO agreements provide a framework that outlines implementation of antidumping policies for member countries, there is much room for discretion by the government authorities charged with implementing antidumping despite these detailed laws and ongoing legal rulings, since countries with established antidumping laws have elaborate legal statutes that go beyond these WTO agreements to address implementation in great detail. Considering that FTAs are designed to promote the bilateral trade, then the initiations of antidumping investigations may be restrained after FTA.
In this paper the relationship between FTAs and antidumping investigations are empirically tested by using the data on the worldwide antidumping during the period 1995-2000. Since the number of antidumping filings is the count data, the estimation of the OLS is biased. Therefore this paper employes the Poisson and negative binominal regression techniques. Furthermore, the number of antidumping investigations might not be the appropriate proxy for antidumping intensity, since the absolute number of antidumping may fluctuate from year to year. In order to resolve this problem, we introduce the alternative measure of antidumping intensity defined as the share of antidumping of a country among the total number of antidumping investigations.
We find the evidence that FTAs tends to increase antidumping investigations on member countries. This means that the domestic industries use actively antidumping to protect them from the increased imports caused by FTAs. These results imply that to promote the trade among FTA members the provisions abolishing the antidumping investigations on the member countries should be included in the FTA. If it is not, the expected trade effects of FTAs may be offset by the increased protection of antidumping.
