중국의 반덤핑종료재심조사규칙(反倾销期终复审调 查规则) 초안에 관한 고찰 (Considerations on the Draft of Chinese Anti-Dumping Expiry Review Investigation Rules)

초록

글로벌 보호무역주의 확산 및 통상갈등으로 인하여 각국은 반덤핑, 상계관 세 등을 활용한 수입규제조치를 지속적으로 강화되고 있다. 세계무역기구 (WTO)의 통계에 따르면 1995년부터 2019년까지 우리나라가 받은 반덤핑조치 는 총289건으로 중국(1,033건)에 이어, 세계에서 두 번째로 많은 반덤핑 규제 를 받은 것으로 확인되었다. 중국은 세계적으로 무역구제조치를 가장 많이 받 는 나라인 반면에 무역구조제치제도를 자국 산업 보호 수단으로서 활발히 활 용하고 있는 나라이기도 하다. 더욱이 중국의 對한국 무역구제조치의 문제 중 하나는 반덤핑 종료재심을 통해 반덤핑 조치를 계속 연장하고 있다는 것이다. 이러한 장기 규제에는 다양한 원인이 있으나 그 중 하나로 꼽히는 것이 반덤 핑종료재심의 법규 미비를 들 수 있다. 이 문제에 대한 논의가 지속되던 중 2019년 7월 30일 중국정부는 「반덤핑종료재심조사규칙(反倾销期终复审调查 规则)」 초안을 발표하였다. 중국은 반덤핑 중간재심, 신규수출자재심, 관세평 가재심의 경우 별도의 잠정규정을 마련하고 있는 반면 종료재심은 예외로 「반 덤핑조례(反傾銷條例)」규정을 준용하고 있어 법규의 공백상태였다. 따라서 종료재심법규의 제정은 장기간의 규제조치로 힘들어하고 있는 우리 업계에 반 덤핑 조치의 명확화라는 점에서 긍정적인 역할을 할 수 있을 것이라는 기대가 있었으나 종료재심규칙 초안을 살펴본 결과 기존의 반덤핑조례 준용시와 비교 하여 큰 차이점은 없어 보인다. 따라서 중국은 향후 반덤핑종료재심을 운용함 에 있어 명확성과 투명성, 구체성을 좀 더 보완해야 할 것으로 사료된다. WTO 반덤핑협정에 따르면 반덤핑관세는 덤핑으로 인한 피해를 상쇄하는 데 필요한 기간 동안 필요한 정도 내에서 부과되어야 하며, 부과일로부터 5년 이내에 소 멸하는 것이 원칙이다. 비록 종료재심을 통해 조치 연장이 가능하나 보호무역조치가 아닌 객관적인 기준에 의한 타당한 평가에 근거해야 한다. 이에 우리정 부 및 관련기업들은 중국 상무부의 규제동향을 상시 모니터링 하고 주중대사 관, 및 자문로펌, 상무부 사이트를 통해 규제현황 및 신규조치 가능성 등에 미 리 대응해야 할 것이다. 아울러 민관 중국의 對 한국 수입규제 현안점검대책회 의, 전문가 간담회 등의 개최를 통해 규제현황 점검, 업계의견 수렴 및 민관협 력 대응전략을 논의하고 양자채널을 통해 부당한 수입규제에 대한 규제종료 및 조사자제 요청을 적극적으로 해나가야 할 것이다.

영어초록

With the spread of global protectionism and trade conflicts, each country continues to strengthen import restrictions using anti-dumping and countervailing duty. According to the World Trade Organization (WTO) statistics, Korea received total 289 anti-dumping measures from 1995 to 2019, followed by 1,033 measures against China, which suggested that Korea received the second largest anti-dumping measures in the world. China is a country that received the largest trade measures in the world and also makes active utilization of the trade remedy system as a means for its own industrial protection. Moreover, one of the problems in China’s trade remedy measures against Korea is that China continues to extend anti-dumping measures through anti-dumping expiry review. Such long-term restrictions have various reasons and one of the reasons is lack of legislation for anti-dumping expiry review. The discussions on this issue had lasted and in the meantime, on July 30, 2019, the Chinese government announced the draft of 「Anti-Dumping Expiry Review Investigation Rules (反倾销期终复审 调查规则)」. China prepared interim provisions for anti-dumping interim review, new exporter review, and customs valuation review, but in case of expiry review, 「anti-dumping ordinance (反傾銷條例)」is being applied as an exception and thus a vacuum of regulations. Therefore, there was an expectation that the enactment of expiry review rule would play a positive role in clarifying the anti-dumping measures to our business world suffering from long-term regulatory measures, but as a result of looking at the draft of expiry review rule, there was no big difference compared with the existing anti-dumping ordinance. Therefore, it is considered that China needs to supplement clarity, transparency, and concreteness a little more in managing the anti-dumping expiry review in the future. According to the WTO Anti-Dumping Agreement, anti-dumping duties should be imposed within the necessary limit for a period of time necessary for offsetting the damage by dumping and becomes extinct within five years from the date of imposition in principle. Although the measure extension is possible through expiry review, the measures should be based on fair assessment in accordance with the objective criteria rather than protectionist measures.
Accordingly our government and related companies will have to monitor the trends of the restrictions by the Chinese Ministry of Commerce all the time and respond to the present condition of regulation and potential new restrictions, etc in advance by visiting the websites of Embassy of the Republic of Korea in China, advisory law firm, and Ministry of Commerce.
At the same time, the present condition of restrictions should be investigated, companies’ opinions should be collected, and public-private cooperative response strategies should be discussed by holding a meeting on the measures for inspection of current issues of public-private China’s import restrictions against Korea and a meeting of experts, and ending unfair import regulations and refraining from investigation via both channels should be demanded very aggressively.
