공익사업시행지구 밖 환경피해 구제의 한계 (A Study on the Limitations to the Relief of Environmental Damages Incurred Outside Public Works Implementation Areas)

초록

공익사업시행지구 밖의 환경피해는 공익사업의 시행 중 또는 공익사업의 완성 후 발생하는 소음ㆍ진동ㆍ수고갈ㆍ일조침해 등으로 인해 발생한 손실이다. 현재 공익사업시행지구 밖에서 환경피해에 대한 권리구제는 손실보상의 근거가 없다. 대부분 환경분쟁조정위원회 또는 국민권익위원회에 민원을 제기하거나 민사소송을 제기하는 방법으로 이루어지고 있다.
그러나 공익사업시행지구 밖의 환경피해의 권리구제는 민사상 손해배상이나 「국가배상법」상 손해배상의 경우 손실발생의 원인과 손실 사이의 인과관계를 규명하기가 어렵다. 또한 국민권익위원회의 시정권고나 의견표명은 직접적인 집행력이 없어 권리구제 수단으로는 한계를 노출하고 있다. 공익사업시행지구 밖의 환경피해는 손실보상과 손해배상의 중간영역에 위치하고 있다. 이로 인해 공익사업으로 인한 환경피해는 사실상 권리구제의 사각지대에 놓여 있다.
그러므로 공익사업시행지구 밖의 환경피해는 당초부터 예견되어 있고, 수인한도 내에 있다 하더라도 그로 인한 재산상의 손실은 특별한 희생에 해당된다. 이는 적법행위에 근거한 것으로, 국민의 권리보호라는 측면에 보다 중점을 두어 이를 손실보상의 대상으로 삼아 처리할 수 있도록 하는 것이 바람직할 것이다. 다만, 공익사업시행지구 밖 환경피해보상은 「토지보상법 시행규칙」에 법적 근거는 마련하되, 구체적 판단기준은 환경부 중앙환경분쟁조정위원회의 「환경분쟁사건 배상액 산정기준」을 활용하는 것이 합리적일 것이라고 판단된다.

영어초록

Environmental damages incurred outside public works implementation areas are losses which result from noise, tremors, depletion of water, encroachment of daylight, etc. that occur during the implementation and after the completion of public works. Currently, remedies against environmental damages incurred outside public works implementation areas do not have any basis to claim compensation for damages. Most cases are dealt with by submitting civil complaints with the Environmental Dispute Resolution Commission or the Civil Rights Commission, or by filing a civil lawsuit.
However, with respect to remedies against environmental damages incurred outside public works implementation areas, it is difficult to establish the causal relationship between the cause of the loss and the loss itself in the case of filing for compensation for damages under the State Compensation Act or under civil law. Also, corrective recommendations or opinions issued by the Civil Rights Commission display limitations as a legal remedy because of its lack of direct enforceability. Environmental damages incurred outside public works implementation areas are situated in a gray area between compensation for loss and compensation for damages. As a result, environmental damages caused by public works are in fact in a blind spot in terms of available remedies.
Therefore, environmental damages incurred outside public works implementation areas were foreseen from the beginning and even if they fall within the acceptable limits, the property losses resulting from such damages are considered to be of a special sacrifice. This is based upon lawful acts and it is advisable to deal with such damages by considering such act as the subject of loss compensation by placing more emphasis on the aspect of protecting civil rights.
However, if a compensation provision is newly enacted when the criteria for determining which cases of environmental damages incurred outside public works implementation areas form a special sacrifice is not clearly defined, side effects can be anticipated from such enactment. Therefore, it is determined that the legalization of compensation for environmental damages incurred outside public works implementation areas should be gradually progressed starting from the part where the environmental damages can be standardized in order to minimize any side effects.
