신변보호 담당관 역할의 개선방안:탈북민 범죄피해자 보호를 중심으로 (A Study on Improvement of Protection Officer’s Role:Focused on Protection of North Korean Defector Victims)

초록

이 연구의 목적은 탈북민의 범죄피해 발생현황 및 범죄피해 사례들을 살펴보고, 탈북민에 대한 심층면접 분석결과를 제시하고, 탈북민들이 범죄피해를 당하는 원인을 분석한 후 탈북민 범죄피해자 보호를 중심으로 신변보호 담당관 역할을 정립하기 위한 방안들을 제시하는 것이다.
먼저, 신변보호 담당관의 역할을 정립하기 위해서는 신변보호활동의 정당성이 확보되고, 탈북민과 접촉시 절차적 공정성이 확보되고, 신변보호 경찰관과의 지속적 연락이 유지되고, 범죄피해예방 거버넌스 협력체제를 구축해야 한다.
둘째, 신변보호 담당관의 범죄피해 예방활동과 관련하여, 맟춤식 범죄피해 예방 교육을 실시하고, 1:1 멘토링 서비스를 제공하고, 북한이탈 청소년 보호를 강화하고, 사례 중심의 범죄피해 예방 핸드북을 제작하고, 거주가옥의 범죄 취약성을 분석해야 한다.
셋째, 신변보호 담당관의 범죄피해자 보호활동과 관련하여, 신변보호 담당관의 조정자 역할을 확립하고, 법률 지원 시스템을 확립하고, 탈북 청소년 범죄피해 회복을 위한 가족 회합 프로그램을 활성화하고, ICT 기술 및 첨단 보안 시스템을 활용한 탈북민 피해자 보호활동을 실행해야 할 것이다.

영어초록

The purpose of this study is to analyze the current situation of crime victimization of North Korean defector, to investigate the main crime cases suffered by the North Korean defectors, to present the results of in-depth interview analysis of the North Korean defectors, to analyze the causes why the North Korean defectors become the crime victims, and suggest the measures to establish the role of the protection officer focused on protection of North Korean defector victims after presenting the problems of the protection officer role.
First, in order to establish the protection officers’ role, it is necessary to secure the legitimacy of the protection activity, ensure the procedural fairness when contacting the North Korean defectors, maintain North Korean defectors’ continuous contact with the protection officer, and establish a cooperation system for preventing crime victimization.
Second, in relation to the crime prevention activities of the protection officers, police departments should provide the customized prevention education of victimization, provide 1: 1 mentoring service, strengthen the protection of North Korean defector youngster, manufacture the case handbook for crime victimization prevention, and analyze the crime vulnerability of residential houses.
Third, in relation to the crime victim protection activities of the protection officers, it is necessary to establish the coordinator role of the protection officer, to establish the legal support system, to activate the family meeting program to recover the crime damage of North Korean defectors, and protect the North Korean defector victims through ICT technology.
