학교민주시민교육의 기본원칙 중 정치적 중립성 보장을 위한 개선과제 (A Study on the Improvement of Political Neutrality of Democratic Civic Education in Schools)

초록

학교민주시민교육은 헌법공동체의 민주주의 역량을 강화시키기 위한 전제이자 핵심 과제이다. 이러한 학교민주시민교육을 수행할 때 정치적 중립성을 보장하는 것은 특히 중요한 과제로, 이를 위해서는 교육당사자들의 의식 및 노력과 함께 이를 실질적으로 지원할 수 있는 절차와 제도가 필요하다. 여기서 정치적 중립성 원칙의 의미는 학교민주시민교육에서 당파성을 배제하고, 교육적 목적에서 벗어난 도구나 수단으로 전락하는 것을 예방하는 것이다. 나아가 이것은 교육과정에서 정치적 내용과 주제를 다루는 것을 금지하는 것으로 운용되어서는 안 된다. 현재 학교민주시민교육에 관한 조례를 두고 있는 13개의 시⋅도교육청 조례에는 모두 기본원칙으로 교육의 정치적 중립성과 관련된 내용이 규정되어 있다. 이것은 헌법 제31조 제4항에 규정된 교육의 정치적 중립성을 보장하는 차원에서 이해되어야 한다. 그 구체적 내용에는 논쟁성 재현의 원칙, 사적 이해관계나 특정 정치적 의견을 주장하는 것을 금지하는 원칙, 교화 및 일방적 주입 금지의 원칙, 자유로운 토론과 참여 보장의 원칙 등이 포함된다. 학교민주시민교육에 관한 정치적 중립성은 먼저, 교육활동의 사전적 조건으로 보장되어야 한다. 이것은 교육내용을 선정하고 교재를 선택할 때 파당적 교육을 배제하는 것에서 출발한다. 그리고 정치적 중립성은 학교민주시민교육이 수행되는 과정에서 준수되어야 하는데 여기에서 특히 교사의 역할이 중요하다. 교육방법상 정치적 중립성을 보장하는 교사의 역할과 책임을 설정할 때 교사의 모든 정치적 활동을 금지하는 조치는 재고될 필요가 있다. 이와 함께 교사의 자주성과 전문성을 존중하고 정치적 중립성을 침해하지 않으려는 다른 교육당사자들의 의식과 실천이 전제가 되어야 한다. 한편, 학교민주시민교육의 정치적 중립성은 교육결과적 측면에서도 기본원칙으로 기능하여야 한다. 이것은 정치적 중립성이 침해된 경우에 일회적 징계나 처벌에 그치지 않고, 학교민주시민교육의 본질과 목적에 따른 정상적인 교육상황을 회복하기 위한 절차와 제도를 보장하는 것을 의미한다. 그 과정에는 교육당사자뿐만 아니라 다양한 시민사회의 구성원들의 참여가 보장되어야 할 것이다. 이를 통해 장기적 관점에서 학교민주시민교육 과정에서 발생할 수 있는 다양한 정치적 중립성 침해 유형을 구별하고, 적절한 대안을 마련할 수 있다. 이와 함께 사회적으로 수용될 수 있는 학교민주시민교육의 정치적 중립성에 관한 평가기준과 내용을 구체화하기 위한 사회적 논의를 활성화하는 것이 중요하다.

영어초록

School democratic civic education is a prerequisite and a key task for strengthening the democratic capacity of the constitutional community. In order to ensure the political neutrality of school democratic civic education, procedures and systems are needed to support it, along with the consciousness and efforts of the educational parties. The meaning of the principle of political neutrality is to exclude partisanship from school democratic civic education, and to prevent education from degenerating into tools or means. Furthermore, it should not be operated as a ban on education from dealing with political content. The 13 municipal and provincial education offices’ ordinances on school democratic civic education all stipulate matters related to political neutrality. The specifics include the principle of reproducing contentiousness, the principle of prohibiting private interests or asserting specific political opinions, the principle of prohibition of brainwashing, and the principle of ensuring free discussion and participation. This political neutrality regarding democratic civic education in schools should first be guaranteed as a prior condition for educational activities. This starts with excluding partisan education when selecting educational content and selecting teaching materials. And political neutrality should be observed in the process of school democratic civic education, where the role of teachers is particularly important. Measures banning all political activities of teachers in setting up their roles and responsibilities to ensure political neutrality in educational methods need to be reconsidered. It is also important to respect teachers’ independence and expertise and to practice other educational parties’ willingness not to infringe on political neutrality. Meanwhile, the political neutrality of school democratic civic education should also function as a basic principle in terms of educational outcomes. This means not only one-off disciplinary action or punishment if political neutrality is violated, but also ensuring procedures and systems to restore normal educational conditions according to the nature and purpose of school democratic civic education. The process will require the participation of not only the educational parties but also members of various civil societies. Through this, we can distinguish various types of political neutrality infringement that may occur in the course of school democratic civic education from a long-term perspective, and come up with appropriate alternatives. In addition, it is important to activate social discussions to clarify the evaluation criteria and contents of the political neutrality of school democratic civic education that can be socially accepted.
