북한의 민사소송에 관한 소고 (A review on the Civil Procedure of North Korea)

초록

남북한의 관계는 현재의 최악의 국면에서 벗어나면 북한의 개혁·개방, 남북한의 평화공존과 교류협력, 남북한의 통일·통합의 방향으로 발전하여갈 것인데, 위와 같은 상황의 전개를 촉진하거나 이에 대비할 남북한의 다방면의 노력이 필요하다.
민사소송은 사법상 분쟁의 해결을 위한 절차적 제도로서, 위와 같은 상황의 전개에 따라 급증할 사법상 분쟁을 적정하고 효율적으로 해결할 수있도록 미리 남북한의 민사소송에 대한 이해·평가 및 정비를 진행하여야 한다.
북한 민사소송은 그 체제 내에서 일정한 기능을 수행하고 있지만, 위와 같은 상황의 전개를 촉진하거나 이에 부응하기에는 어려움이 있다. 이는 수령유일영도체제가 지배하는 사회주의국가인 북한의 체제와 이념이 북한 민사소송에 결정적 영향을 미치기 때문이다. 다만 이러한 요소를 제외 하면 북한 민사소송은 나름대로의 합리성과 통용력을 가지고 있다고 보인다.
북한 민사소송의 특징을 몇 가지 들어보면 다음과 같다. ①기관, 기업소, 단체, 공민의 민사상 권리와 이익의 보호라는 민사소송법의 사명이 명문으로 규정되어 있다. ②북한 민사소송의 기본 원칙으로서 재판소의 책임성에 소송당사자의 적극성을 배합하는 원칙, 민사소송활동을 인민대 중에 의거하여 진행하는 원칙 등이 강조되고 있다. ③민사소송상 신의칙은 일반원칙이 아니고 소송당사자의 의무로서 규정되어 있다. ④민사소송사항에는 가사소송사건이 포함되어 있고, 사실도 확인의 소의 대상이 되어 있다, ⑤판사와 함께 인민참심원이 재판소를 구성하고, 검사가 광범위하게 관여한다. ⑥직권주의가 지배적이고, 당사자처분권주의와 변론 주의는 배제·제한되어 있다. ⑦판사에 의한 재판준비가 철저하게 이루어 진다.
남북한의 통일·통합을 향한 일련의 과정에서, 북한 민사소송 중 북한의 체제와 이념을 직접 구현하는 제도와 절차는 가능하면 배제하거나 축소하여야 한다. 물론 북한의 정치체제와 경제체제의 전환이 이루어지고, 이를 반영하는 방향으로 실체사법의 제정이나 개정이 이루어지면 북한의 민사소송도 이에 따라 자연스럽게 변화·발전될 것이다. 이러한 변화·발전에 대비하거나 이러한 변화·발전을 추동하기 위해서도 북한 민사소송의 연구는 매우 중요하다.
북한이 그 체제와 이념을 어느 정도 유지하는 선에서 개혁·개방이나 한국과의 교류협력을 행하는 경우이더라도 북한 민사소송제도는 상당한 정도로 개선·정비되어야 하는데, 북한 민사소송의 연구는 그 개선·정비에 대한 지원을 위해서도 절실히 필요한 작업이다.
한편, 한국의 민사소송제도가 완벽한 것은 아니므로 북한 민사소송의 연구를 통하여 민사소송의 본질을 탐색하고 비교법적으로 한국의 민사소송제도나 구체적 절차의 문제점을 파악하고 그 개선책을 모색하는 것도 매우 유익한 일이 될 것이다.

영어초록

Reversing the current tensions in inter-Korean relations could lead to progress in the reform and opening of North Korea, peaceful coexistence and cooperative exchanges between the two Koreas, and the eventual unification and integration of the two Koreas, so that the two countries should exert themselves in various ways to facilitate or prepare for the development of such situations.
The civil procedure is a procedural system for resolving judicial disputes. The understanding, evaluating, and reorganizing the civil procedures of two Koreas must be carried out in order to ensure that judicial disputes, which are expected to increase rapidly as the above situations unfold, can be adequately and efficiently resolved.
In North Korea, the civil procedure performs certain functions within its system, but there are many difficulties in facilitating or responding to the development of the above situations because the system and ideology of North Korea, a socialist country dominated by Kim Jong-un’s monolithic leadership system, have a decisive influence on civil procedure of North Korea. However, except for that point, it seems that civil procedure of North Korea have their own rationality and are in common use.
The characteristics of civil procedure of North Korea are as follows. ①The mission of the Civil Procedure Code to protect the civil rights and interests of institutions, enterprises, organizations, and citizens is expressly stipulated in the text. ②As the basic principles of civil procedure of North Korea, the principle that the responsibility of the court is combined with the activeness of the parties in the civil lawsuits, the principle that the activities of the civil lawsuits are carried out based on the general public, and other principles are emphasized. ③the principle of good faith on the civil procedure is prescribed not as the general principle but as the duty of the parties in the civil lawsuits. ④The scope of civil procedure includes family litigation cases, and the confirmation of facts are also subject to the action for declaratory relief. ⑤Public lay judges constitutes the court with judge, and the prosecutor’s involvement is widespread. ⑥The ex officio principle is dominant, and the doctrine of disposition right and the principle of pleading are excluded and limited. ⑦Judges play a role thoroughly in trial preparation procedure.
In a series of processes toward the unification and integration of the two Koreas, institutions and procedures in civil procedure in North Korea that directly show the system and ideology of North Korea should be excluded or reduced, if possible. Of course, it is believed that if North Korea’s political and economic systems are transformed, and its substantive judicial system is enacted or revised accordingly, its civil procedure will naturally change and develop along with the tide of change. It can be considered very important that research on civil procedure in North Korea be conducted in order to prepare for or promote such changes and developments in North Korea.
Even if North Korea's reform and opening or its cooperation and exchanges with South Korea are carried out to the extent that its system and ideology are maintained to some extent, its civil procedure system should be significantly improved and reorganized. The research on civil procedure of North Korea is urgently needed in order to support the improvement and reorganization.
On the other hand, South Korea’s civil procedure system is not perfect, so it is clear that the process of exploring the nature of civil procedure, identifying the problems of the South Korea’s civil procedure system and concrete process, and seeking improvement measures for the problems will be very beneficial.
