중국 국제민사소송법제의 최신 동향 - 2023년 개정 민사소송법을 중심으로 - (Latest Developments in Chinese International Civil Procedure Law Legislation - Focusing on the Chinese Civil Procedure Act 2023 -)

초록

섭외민사소송절차에 적용되는 특별규정을 대폭 수정 및 신설한 중화인민공화국 개정 민사소송법(이하 “2023년 민사소송법”)이 2023년 9월 1일 정식으로 공포되어 오는 2024년 1월 1일 시행을 앞두고 있다. 이는 중국 국제민사소송법제의 최신 동향을 시사하고 있는바, 내용상으로는 ① 국제재판관할에 관한 제24장에서 국제재판관할규칙, 국제적 소송경합과 국제재판관할권의 불행사에 관한 조문들, ② 송달, 증거조사에 관한 제25장에서 섭외 송달과 증거조사에 적용되는 조문들, ③ 사법공조에 관한 제27장에서 외국재판의 승인 및 집행에 관한 조문들을 수정 및 신설하였다.
이를 계기로 한국과 중국은 국제민사소송법의 영역에서 서방국가들의 입법만을 좇아 달려오던 과정에서 잠시 한 숨을 돌려 서로를 바라볼 수 있게 되었다. 전반적으로 보면 한국과 중국의 민사소송법제는 구조상 유사한 점이 매우 많으나 구체적인 내용을 들여다보면 상이한 부분들도 허다하다. 이를 정확히 파악하는 것은 한중 간 교류가 밀접해지고 민상사분쟁이 날로 증가하는 현 상황에서 매우 중요한 과제이다. 본 논문은 이와 같은 문제의식 하에 2023년 민사소송법의 개정 연혁과 주된 특징을 정리한 기초 위에(Ⅱ), 위의 내용들을 중국법 자체의 맥락에서 소개 및 평가하고(Ⅲ), 이에 비추어 한국법의 관점에서 비교법적, 실무적인 시각으로 다시 들여다봄으로써 한국 독자들의 실질적인 이해를 도모한다(Ⅳ). 마지막으로 논문의 전반을 개관하고 한중 국제민사소송법제의 비교법적 연구의 미래를 전망한다(Ⅴ).

영어초록

The new Civil Procedure Act of the People's Republic of China, which has significantly revised and newly established special regulations applied to international civil proceedings, was promulgated on September 1, 2023, and is expected to take effect on January 1, 2024. It suggests the latest developments relating to Chinese legislation of International Civil Procedure Law. In terms of content, ① Chapter 24 on International Adjudicatory Jurisdiction suggests international jurisdiction rules, provisions on international parallel proceedings, and on declining international jurisdiction by the doctrine of forum non conveniens, ② Chapter 25 on Service and Taking Evidence suggests some rules relating to international service of official documents and taking evidence abroad, ③ Chapter 27 on Judicial Assistance in Civil and Commercial Matters revised and newly established provisions on the recognition and enforcement of foreign judgments.
With this opportunity, South Korea and China took a breather and began to look at each other for a while instead of pursuing only the legislation of Western countries in the field of International Civil Procedure Law. On the whole, the civil procedure law legislation of South Korea and China have many similarities in structure and many differences in context instead. Especially in the current situation where exchanges between South Korea and China are getting closer and the number of civil and commercial disputes is increasing, comparative law research between South Korea and China seems inevitable. With this consideration, this paper is discussed as follows. Section Ⅱ summarizes the history and main characteristics of the Chinese Civil Procedure Act 2023, Section III introduces and evaluates the above contents in the context of Chinese law itself, and Section IV seeks a practical understanding of Korean readers by looking at it again from a comparative and practical perspective from the perspective of Korean law. Finally, Section Ⅴ gives an overview of the thesis and predicts the future of comparative legal research in the South Korean-Chinese international civil procedure law legislation.
