팬데믹 상황에서 감염병 취약계층 보호를 위한 법제방안 -장애인 보호 문제를 중심으로- (Legislative Plan for the Protection of Vulnerable Social Groups of Infectious Diseases During a Pandemic Situation -Focused on Disabled Persons Protection-)

초록

코로나19로 인한 세계보건기구(WHO)의 팬데믹(Pandemic) 선포 이후 우리사회는 생각지 못한 많은 새로운 변화를 겪고 있다. 그동안의 감염병 상황과는 달리 코로나19에 대한 대응과정에서는 기본권 침해가 발생할 수 있는 사안에 대한 여러 가지 법적 검토가 적극적으로 요구되고 있다. 이번 코로나19 상황에서도 가장 큰 어려움을 겪고 있는 사회적 약자인 장애인 관련 문제 역시 코로나19 상황에서 여러 가지 공법적 논의를 촉발시키고 있다. 장애인에 대해서는 코로나19 상황에서 일반적인 장애인에 대한 서비스 제공상의 한계는 물론, 장애인 관련 시설의 폐쇄의 적절성 문제, 재난취약계층으로서 장애인의 정보접근상의 문제 등이 지적되고 있으며, 이는 일반적인 장애인 보호문제임과 동시에 재난불평등 해소 혹은 재난취약계층 보호 문제이기도 하다.
그럼에도 불구하고 이번 코로나19 상황에서는 장애인과 같은 취약계층에 대한 특별한 고려를 위한 법제 개편은 거의 이루어지지 못하였다. 이번 코로나19 사태는 재난취약계층도 재난의 유형별로 달라질 수 있다는 점을 보여주고 있으며, 노인이나 장애인과 같은 취약계층이 처한 어려움이 여실히 드러나고 있다는 점에서 감염병 재난상황에서 취약계층을 특별하게 고려할 수 있는 제도적 방안을 모색할 필요성이 어느 때보다도 강조된다. 그 중에서도 장애인에 대한 대책은 메르스 사태 이후 아직까지 크게 달라지지 못했다는 비판에 직면해 있으며, 장애인은 건강권 보장차원에서 감염병 재난 대책 마련의 필요성이 우선적으로 요구되는 취약계층이라고 할 수 있다. 그러므로 본 논문에서는 심각성이나 시급성 차원에서 볼 때 맞춤형 대책과 근본적인 법제개선이 필요한 재난취약계층을 장애인으로 한정하였다.
이번 코로나19 상황에서 논란이 있었던 기존 장애인 복지정책 등과 충돌될 수 있거나 발생할 수 있는 법제상의 한계를 검토한 결과 장기적으로 다음과 같은 방향으로 법제를 보완할 필요가 있다. 현행법제는 감염병 상황에서 재난취약계층을 보호하여야 하는 국가의 의무에도 불구하고 장애인을 충분하게 고려하고 보호할 수 있는 입법체계로는 한계가 있으므로, 감염병상황에서의 재난취약계층 보호를 위한 입법적 보완이 필요하다. 또한 감염병 대응과정에서 문제점으로 지적되었던 장애인복지시설등의 시설격리는 현행법상 장애인 시설이나 인력기준에 비추어 적절하게 이루어질 수 있는 상황이 되지 못하므로 감염병 상황을 대비한 시설등의 기준의 개편이 필요하다. 장애인돌봄서비스의 지속적인 제공을 위해 장애인 돌봄서비스와 관련된 법적 근거를 보완할 필요가 있으며, 장애인이 재난에 효과적으로 대응할 수 있도록 정보 접근에 관한 필요 항목들을 법제상으로 보완할 필요가 있다.

영어초록

Following the declaration by World Health Organization (WHO) of the COVID-19 pandemic situation, South Korean society has been experiencing many unexpected changes. Unlike previous infectious diseases, in the process of responding to COVID-19 cases where basic rights may be infringed have called for active review from a legal perspective. In addition, public debate has been triggered regarding the problems faced during the COVID-19 situation by the socially disadvantaged disabled persons. During the COVID-19 situation, the limitations in providing general services, closing of facilities for the disabled and the limited flow of information to socially vulnerable groups were criticized. These issues are not only general problems that are faced with regards to the protection of disabled persons, but also simultaneously matters of resolving issues regarding inequality and the protection of vulnerable social groups during disasters.
Despite this, during the COVID-19 situation, there has been very little legislative reform to protect the disabled and similar vulnerable social groups. The COVID-19 situation has shown that socially vulnerable groups can vary depending on the form of disaster and has highlighted the difficulties faced by the elderly, disabled and similar groups. This has put emphasis on the need to find ways take institutional measures to allow vulnerable socials groups to be given special consideration during disasters such as infection diseases. In particular, there has been criticism that measures for the disabled persons have not changed greatly since the MERS situation and in order to secure the health rights for the disabled there is a need to prepare infectious disease disaster countermeasures with the consideration that the disabled would be considered a priority vulnerable social group. Therefore, this paper, considering the factors of severity and urgency, has defined the vulnerable social group in need of customized measures and improvement in basic legislation in situations of disaster to the disabled.
After reviewing controversial issues that arose during the COVID-19 including those that could conflicting with pre-existing disabled person welfare policy or potential legislative limitations, it can be derived that the following methods are necessary to seek legislative measures to revise legislation in the long term. Despite the duty of the state to protect vulnerable social groups during disaster, as there are limitations to the current legislative system, there needs to be legislative improvement to protect such groups during situations of infectious diseases. In addition, the isolation or quarantine of facilities such as welfare institutes for the disabled has been criticized as a flaw in the process of responding to infectious diseases and under the current legal system in terms of facilities for the disabled and manpower standards is unable to appropriately respond to disaster situations. Thus, there is a need to reform the standards of facilities and etc. in order to prepare against situations of infectious diseases. In order to continue to provide disabled care services, legal groundings of such services must be revised and for disabled persons to respond effectively in disaster situations there needs to be legislative improvements in the defining the required items for accessing information.
