한미자유무역협정의 미국 국내적 효력과 이행절차 검토 (Implementing the Korea-U.S. Free Trade Agreement in the United States)

초록

한미자유무역협정(“한미FTA”)은 24.5조에 따라 협정상 합의사항을 국내적으로 이행하기 위한 법적 절차를 마무리한 이후 발효될 예정이다. 따라서 현 단계에서 우리는 협정에 맞게 국내법령 개정작업을 진행함과 아울러 미국이 협정상 의무를 이행법률에 제대로 반영하고 있는지를 점검할 필요가 있다.
이와 관련, 두 가지 이슈를 생각해 볼 수 있다. 첫 번째 질문은 한미FTA가 미국 국내적으로 어떤 법적 지위를 가지고 있으며, 국내법과의 관계는 어떠한가이다. 그동안 미국은 이행법률에 미국 국내법이 국제협정에 우선한다는 규정을 포함시켜 왔는데 이를 어떻게 해석해야 하는지에 대한 물음이다. 두 번째는 절차적 측면에서 한미FTA가 어떻게 미국 국내법으로 반영되는지이다. 이는 우리가 미국의 협정 이행상황을 점검하기 위해서는 언제 어떤 문서를 확인해야 하는지에 대한 힌트를 제공해 줄 것이다.
동 보고서는 미국의 한미FTA 이행에 관련된 위 두 가지 질문에 중점을 두고, 관련 국제법 및 미국 국내법과 판례들을 체계적으로 소개하고자 하였다. 이러한 과정을 통해 보고서는 다음과 같은 결론에 도달하게 된다.
한미FTA는 의회입법 행정협정이지만 조약과 동일한 지위를 가진다. 다만, 비자기집행조약이기 때문에 의회의 이행법률을 통해 미국 국내적으로 적용되는데, 협정 이행에 있어 자기집행 여부는 논의실익이 크지 않다. 국내법이 협정보다 우선한다는 미국 무역협정 규정들의 의미는 협정 이행에 있어 의회의 역할을 강조한 것으로 보아야 한다. 협정상 의무 이행사항을 규정한 이행법률 자체가 연방법이고 한미FTA 협정문 또한 국내법정에서 중요한 해석수단으로서 간접적인 효력을 가지고 있다. 중요한 것은 한미FTA 이행법률 및 행정조치계획 작성과정에서 우리에게 필요한 사항이 누락되지 않도록 해야 한다는 점이며, 정부와 학계에서도 이에 대한 보다 많은 관심과 연구가 있어야 할 것으로 생각된다.

영어초록

In accordance with the Article 24.5 of the proposed Korea-U.S. Free Trade Agreement (hereafter "the Agreement"), the Agreement will enter into force only after both parties complete their respective applicable legal requirements and procedures. In this regard, paralleled with bringing domestic laws into compliance with the Agreement, attention should be given to monitor whether the United States correctly reflects its obligations into the forthcoming implementing bill of the Agreement.
Two issues are dispositive. The first issue relates to the following questions: what the legal status of the Agreement in the U.S. domestic legal system is, how the relationship between the Agreement and U.S. domestic laws will be set up, and what the standard provision about such a relationship, which can be found in any trade agreement of the United States, means in the practical sense. Another issue deals with exactly what procedures will be taken for implementing the Agreement. It could provide a useful tip to effectively monitor the implementation status of the Agreement.
This study, focusing on those two questions, tries to introduce and analyze all relevant legal instruments and jurisdictions in a comprehensive and organized way. In doing so, the paper reaches the conclusion which can be summarized as follows:
The Agreement is a congressional-executive agreement, which can be regarded as a legitimate alternative to a treaty in all cases. It is true that the Agreement is a non-self-executing treaty, so the congressional implementation procedure is required for the Agreement to be an effective instrument in domestic courts; however, the difference between self-executing and non-self-executing is not substantial. With respect to the relationship provision contained in implementing bills, the precise understanding will be that the provision purports to limit judicial activism rather than to defy the legal status of the Agreement as a supreme law of the land. It should be considered that the implementing bill, which will contain all international obligations of the U.S. arising from the Agreement, is a federal statute itself, and that the Agreement will affect, even indirectly, rulings of domestic courts as a supplemental instrument. More importantly, we should be wary not to let the United States omit any applicable legal procedure in the implementing bill.
