미등록 이주아동 의료접근권에 관한 고찰 (A Study on the Right to Access to Health Care for Undocumented Migrants)

초록

국내 체류 중인 외국인은 급속히 증가하고 있으나, 우리의 외국인 포용에 대한 사회적 인식과 정책적 배려는 현실을 따라가지 못하는 것 같다.
우리 헌법 제6조 제2항에는 외국인의 인권도 보장해야 할 것을 규정하고 있다. 그리고 우리는 다양한 인권장전 조약을 비준함으로서 인간에 대한 보편적 인권을 보장하겠다고 국제사회에 표명을 하였다. 특히, 우리는 아동권리협약을 비준하여, 동 협약 상의 아동권리가 우리나라에 체류하는 미등록 이주아동 포함한 모든 아동에게 보장되어야만 한다.
그럼에도 불구하고 현재 국내에 체류하고 있는 수많은 미등록 이주아동이 생존과 밀접한 관련이 있는 최소한의 의료서비스 조차도 받기 어려운 실정에 놓여있다.
미등록 이주아동에게 의료접근 권리를 보장한다는 것은 우리 사회에서 가장 차별받는 약자에 대한 인도주의적인 배려라는 점과 비준된 아동권리협약 상의 국가책무라는 점에서 접근되어야 한다. 그리고 미등록 이주아동의 의료접근 권리를 보장하는 문제는 임신한 미등록 이주민에 대한 모성보호 정책, 미등록 이주민 출입국 정책 등 미등록 이주아동을 포함한 미등록 이주민에 대한 권리보장체계 전체와 밀접한 관련을 가지고 있다. 그래서 미등록 이주아동의 의료접근 권리 보장을 위한 정책 도출에 있어서 미등록 이주아동에 대한 의료서비스 접근 보장 방안과 더불어 미등록 이주민의 의료권리 보장정책도 함께 논의되어야 할 필요가 있다.
여기에서는 우리가 비준한 인권장전 조약을 통하여 미등록 이주아동에게도 의료서비스를 제공되어야 할 당위성을 찾아보고, 현재 우리의 미등록 이주아동에 대한 의료서비스 제공 현황 및 관련 법제를 검토하도록 할 것이다. 그리고 이를 토대로 미등록 이주아동의 의료접근 권리 보장의 방향에 대하여 제시하도록 할 것이다.

영어초록

The National Assembly of South Korea ratified many treaties e.g. Universal Declaration of Human Rights; International Covenant on Economic, Social and Cultural Rights; International Convention on the Elimination of All Forms of Racial Discrimination; Convention on the Rights of the Child.
South Korea government must protects the Human Rights of Migrant Children according to the Convention on the Rights of the Child, which applies regardless of nationality. Because the Convention on the Rights of the Child specifically protects the rights of all children in its first chapter. And this specification can be interpreted as a protection of the right to health care for undocumented children in particular. Article 24 of the Convention on the Rights of the Child states that “States Parties recognise the right of the child to the enjoyment of the highest attainable standard of health and to facilities for the treatment of illness and rehabilitation of health. States Parties shall strive to ensure that no child is deprived of his or her right of access to such health care services.”But, in South Korea, undocumented children face considerable obstacles to accessing health care. Their physical and mental health is apt to worsen because of poor access to health care services and the continual fear of being discovered and expelled. Undocumented children encounter similar difficulties in accessing a high standard of health care, in terms of bureaucratic impediments, a lack of adequate information and the fear of being caught.
Undocumented children are the oppressed, persecuted, powerless minorities of our society. Protecting the right to access of undocumented children is the moral obligation as well as the legal liability of all civilized countries.
When many people act politically to counter policies restricting the right to health care of undocumented children on the Convention on the Rights of the Child, South Korea government can make strides towards providing undocumented children with equal access to health services on the Convention on the Rights of the Child.
