미등록 디자인의 보호법제 개선에 관한 연구 (A Study on the Improvement of the Law System for Protection of Unregistered Designs)

초록

디자인보호법상 디자인에 대한 보호는 특허청 등록을 전제로 하지만 현행 지식재산 보호법제 하에서는미등록 디자인이라 하더라도 보호받을 수 있는 여러장치들이 마련되어 있다. 그 예로서 신규성 상실의 예외주장이나 부정경쟁방지법상 상품형태의 보호 등이있으며, 응용미술저작물에 해당하거나 상표의 역할을하는 디자인이라면 각각 저작권법과 상표법에 의해서도 보호도 가능하다. 다만 이러한 보호가 과연 적절한수준으로 이루어지고 있는지에 대해서는 연구의 필요성이 제기된다.
이에 본 연구에서는 우선 미등록 디자인에 대한 여러 법률상의 보호 가능성을 정리하고 그 과정에서 발생하는 한계와 쟁점으로서 디자인보호법상 신규성 유예기간의 적절성, 부정경쟁방지법상 상품형태의 보호기간과 제2조 제1호 파목의 적용범위, 응용미술저작물과 디자인의 관계를 검토하였다.
그리고 이러한 한계와 쟁점에 대한 개선방안으로서디자인보호법상 주지⋅저명성을 획득한 디자인의 등록을 인정하는 방안과 신규성 유예기간을 12개월 이상으로 확대하는 방안, 부정경쟁방지법상 상품형태의보호기간을 3년 이상으로 확대하는 방안과 보충적 일반조항인 제2조 제1호 파목의 적용범위를 제한적으로해석하는 방안, 저작권법상 응용미술저작물이 보호받는 범위를 제한하는 방안을 검토하였다.
다양한 방안을 분석한 결과 부정경쟁방지법 제2조제1호 파목의 적용범위를 제한적으로 해석하는 것이미등록 디자인에 대한 무분별한 보호의 가능성을 낮추고 보호와 이용사이의 균형을 유지할 수 있는 가장 타당한 개선방안이라 판단되었다. 아울러 본 연구의 결과로서 제시하고 있는 부정경쟁방지법 제2조 제1호 파목의 개정안은 디자인산업 생태계의 균형발전과 우리법제가 나아가는 방향에 이바지할 것으로 기대된다.

영어초록

Under the Design Protection Act, protection of a design is premised on registration at the Korean Intellectual Property Office, but under the current intellectual property(IP) law system, there are several mechanisms that can protect designs even if they are unregistered. For example, there is claim for grace period under the Design Protection Act or protection of product form the Unfair Competition Prevention and Trade Secret Protection Act, and if it is an applied art work or a design that serves as a trademark, it can also be protected under the Copyright Act and the Trademark Act However the need for research is raised as to whether such protection is being provided at appropriate level.
In this study, the possibility of protection under the IP laws for unregistered designs is summarized, and then the following limitations and issues are reviewed as existed in the process of protection: the appropriateness of the grace period for novelty under the Design Protection Act, protection period for product types and the scope of application of Article 2 Subparagraph 1(m) under the Unfair Competition Prevention and Trade secret Protection Act, and the relationship between applied art works and designs.
In addition, various improvement plans for these limitations and issues were discussed: to allow registration of designs that have widely and remarkerbly recognized by consumer, to extend grace period to more than 12 months, to extend the protection period of product form to more than 3 years, to limit the application scope of Article 2 Subparagraph 1(m) of the Unfair Competition Prevention and Trade Secret Protection Act, to limit the protection scope for applied art works under the Copyright Act As a result of analyzing improvement plans contemplated in order to resolve such limitations and issues, the amendment to Article 2 Subparagraph 1(m) of the Unfair Competition Prevention and Trade Secret Protection Act is suggested as the most reasonable measure. This amendment, which restricts scope of application, could lower the possibility of indiscriminate protection for unregistered designs and maintain a balance between protection and use. In addition, the amendment is expected to contribute to the balanced development of the design industry ecosystem and the direction of IP law system in Korea.
