주택법상 주택공급질서와 미분양ㆍ미계약분의 처리 (Housing Supply Order and Processing of Unsold and Uncontracted Units)

초록

주택공급질서는 「주택법」에 의해 특허를 받은 건설업자들의 주택공급과정을 통제하기 위해 만들어진 제도이다. 공급된 아파트를 무주택자나 실수요자에게 적정한 가격으로 고르게 분배하기 위하여 입주자 선정 절차, 선정방법, 입주자 자격기준 등을 주요 내용으로 주택공급규칙을 마련하고 있다. 이를 통해 아파트 가격이 상승할 때 법령이 정하고 있는 규제를 피해 가격상승의 이익을 부당하게 얻으려고 하는 투기 세력을 막고자 하는 것이 규제의 핵심 내용이다.
규제의 실효성을 확보하기 위하여 「주택법」은 주택공급질서를 교란하는 행위를 포괄적으로 규정하여 제재를 가한다. 주택공급질서상 제재뿐만 아니라 형사처벌도 이루어진다는 점에서 죄형법정주의 및 법치주의 원칙에 위배되는 부분이 발생한다. 주택공급질서를 구성하는 다양하고 포괄적인 규제 중 어느 한 부분만을 위반해도 일률적으로 3년 이하의 징역 또는 3천만 원 이하의 벌금 대상이 될 수 있기 때문이다. 이는 주택공급질서가 규율하는 주된 대상이 아닌 미분양･미계약분에 관한 공급과정도 예외일 수 없다.
미분양･미계약분은 주택공급질서가 정하는 절차와 자격기준, 입주자 선정방법이 모두 동원되고 나서 남는 물량이며, 건설업자의 입장에서 보면 자금회수에 대한 중대한 장애 사유이다. 국가도 미분양･미계약분의 물량이 누적되면 주택시장에 대한 부담으로 인식하고 이를 해소해야 한다는 압박을 느끼게 된다. 주택공급질서가 정하는 제한은 ‘선착순 모집’ 또는 ‘공개모집’과 같이 간이한 규제일 뿐, 주택공급질서가 정하는 전형적인 입주자 선정방법과는 차원이 다르다.
특히 형사처벌이라는 관점에서, 미분양･미계약분에 대한 강력한 규제는 주택가격 상승 시에 필요한 것이어서 시기적으로 오래가기 어렵고, 그 규제를 신설할 때도 즉각적인 규제 필요 때문에 신중하게 여러 측면을 고려하기 어렵다. 따라서 이렇게 만들어진 조항에 위반되는 행위를 형사처벌하는 경우에도 그 구성요건을 엄격하게 해석해야 하고, 또 한시법과 유사하게 일정한 시점 이후 신설되거나 폐지되는 조항에 대한 처벌도 시간적으로 제약되어야 한다.
미분양･미계약분의 처리에 관하여 규율을 유추하고 제한하여 해석하게 되는 가장 큰 이유는 결국 규율의 공백 때문이다. 미분양･미계약분에 관한 실무상 용어도 통일되어 있지 않고, 법령상 정의도 존재하지 않는다. 주택공급질서의 주요 구성요소, 즉 미분양･미계약분의 입주자 선정방법, 선정 절차, 자격기준에 관한 명시적인 규제도 부족하다. 체계에 부합하지 않는 규제는 시장에 혼선을 야기할 뿐만 아니라, 형사제재와 결합되었을 때 헌법에 합치되지 않는 결과로 이어질 가능성이 크다.
반 세기가량 아파트 공급이 이루어지면서 주택시장은 다양한 규제와 변수들로 움직이는 거대하고 복잡한 유기체로 발전하였다. 미분양･미계약분과 같은 다양한 주택시장의 요소에 대하여 법체계적인 규정을 마련하고, 이에 대응하는 제재 또한 세분화하여 합헌적인 주택공급질서를 구축해야 할 시점이다.

영어초록

The housing supply order is a system created to control the housing supply process of builders who received preferential treatment under the Housing Act. In order to distribute newly built apartments at an appropriate price to those who do not have a home or who will actually live in them, “Housing Supply Rules” were enacted with the main contents including the resident selection process and selection method, and the resident qualification criteria. Through this, the core content of the regulation is to prevent speculative forces who are trying to unfairly profit from the price increase when apartment prices rise.
In order to secure the effectiveness of regulation, the Housing Act comprehensively stipulates and imposes sanctions on acts that disrupt the order of housing supply. In terms of the housing supply order, not only sanctions but also criminal punishments occur, which violates the principles of criminal justice and the rule of law. This is because even if only one part of the various and comprehensive elements that make up the housing supply order is violated, it can be uniformly subject to imprisonment for up to three years or a fine of up to 30 million won. The supply process for unsold and uncontracted units, which are not the main targets regulated by the housing supply order, cannot be an exception to this.
Unsold and uncontracted units are the amount left over after all of the resident selection procedures, qualification standards, and resident selection methods set forth in the housing supply order are used, and from the viewpoint of the builder, it is a significant obstacle to fund recovery. The government also recognizes the accumulation of unsold and uncontracted stock as a burden on the housing market and feels pressure to resolve it. Regulations imposed on unsold or uncontracted units in the “Housing Supply Rules” are simple, such as ‘first-come-first-served recruitment’ or ‘open recruitment’, and are different from the typical resident selection method stipulated by the housing supply order.
In particular, from the point of view of criminal punishment, strong regulation on unsold and uncontracted units is necessary when housing prices rise, so it is difficult to last for a long time. Even when establishing the regulation, it is difficult to carefully consider various aspects due to the immediate need for regulation. Therefore, even in the case of criminal punishment for violations of these provisions, the requirements must be strictly interpreted, and punishment for new or abolished provisions must also be time-limited.
The biggest reason for inferring and limiting the regulation regarding the handling of unsold and uncontracted units is the lack of regulation. Practical terminology for unsold and uncontracted units is not unified, and there is no statutory definition. There is also a lack of explicit regulation on the main components of the housing supply order, that is, the method of selecting residents for unsold or uncontracted units, selection procedures, and qualification standards. Regulations that do not conform to the system not only cause confusion in the market, but are also likely to lead to unconstitutional results when combined with criminal sanctions.
With the supply of apartments for about half a century, the housing market has developed into a huge and complex organism that moves with various regulations and variables. It is time to establish a constitutional housing supply order by preparing legal and systematic regulations for various housing market factors such as unsold and uncontracted units.
