초록

이혼으로 혼인관계가 종료된 이후에 그 혼인의 성립에 흠이 있다는 점을 들어 혼인관계의 무효확인을 구하는 것이 허용되는지 문제된 사안에서, 최근 대법원은 이혼으로 혼인관계가 이미 해소되었더라도 특별한 사정이 없는 한 혼인무효의 확인을 구할 이익이 있다고 판단하였다.
대상판결의 타당성을 검토하기 위한 논의의 전제로서 혼인의 무효와 확인의 이익에 관하여 확인하였다. 혼인무효의 법적 성질과 관련하여 무효사유가 있는 혼인의 경우 그 혼인은 당연무효이고 혼인무효소송의 형태는 확인소송이라는 점을 살펴보았다. 확인의 이익과 관련하여 과거의 법률관계일 때 확인의 이익이 인정되는 요건을 살펴보았다.
대상판결의 각 논거 중 무효혼의 법적 효과가 다르다는 점, 가사소송법이 부부 중 일방의 사망으로 혼인관계가 해소된 경우 혼인관계 무효확인의 소를 제기하는 방법을 규정해 두고 있는 점, 협의파양으로 양친자관계가 해소된 이후 제기된 입양무효 확인의 소에서 확인의 이익을 인정한 점 등에 비추어 볼 때 이혼으로 혼인관계가 종료된 이후라도 혼인관계의 무효확인을 구할 소의 이익을 인정하는 것이 타당하다. 따라서 대법원의 결론은 납득할 수 있다.
다만 대상판결의 적용과 확장으로 인하여 제3자의 이익이나 거래안전의 보호가 문제될 수 있다. 하지만 이는 개별 사안에서 혼인무효의 확인을 소구하는 것이 신의칙에 위반하여 권리남용이 되는지를 검토하여, 이에 해당할 경우 확인의 이익을 부정하는 방식을 통해 해결할 수 있을 것으로 판단된다.

영어초록

In a recent case involving the issue of whether it is permissible to seek a declaration of nullity of a marriage after the marriage has been terminated by divorce on the grounds that the marriage was flawed, the Supreme Court held that there is an interest in seeking a declaration of nullity of marriage even if the marriage has already been dissolved by divorce, unless there are special circumstances.
As a prerequisite to the discussion of the validity of the subject judgment, the nullity of a marriage and the interest in its confirmation were confirmed. Regarding the legal nature of the invalidity of a marriage, we examined that a marriage is null and void when there are grounds for invalidity, and that the form of a nullity suit is a confirmation suit. Regarding the benefit of confirmation, we examined the requirements for the benefit of confirmation to be recognized in the case of a past legal relationship.
In light of the different legal effects of an invalid marriage, the fact that the Family Procedure Act stipulates how to file an action for annulment of marriage when the marriage is dissolved due to the death of one of the spouses, and the fact that the Family Procedure Act recognized the interest of confirmation in an action for annulment of adoption filed after the parent-child relationship was dissolved through a negotiated settlement, it is reasonable to conclude that there is an interest in seeking confirmation of the invalidity of a marriage even after the marriage is terminated by divorce. Therefore, the Supreme Court's conclusion is understandable.
However, the application and expansion of the subject judgment may cause problems for the protection of third-party interests or transaction security. However, we believe that this can be resolved by examining whether it is an abuse of rights in violation of the principle of good faith to seek confirmation of the invalidity of a marriage in individual cases and, if so, denying the benefit of confirmation.
