제로웨이스트 달성을 위한 폐기물 수입규제조치의WTO TBT협정 합치성에 관한 연구 : 중국 고체폐기물 수입금지조치를 중심으로 (Analysis on WTO TBT Agrement Consistency of Waste Import Regulations to achieve Zero Waste: Focusing on the China’s Solid Waste Import Ban Measure)

초록

‘제로웨이스트’는 세계의 환경규제 흐름에 있어 주목되는 키워드 중 하나이다. 2021년1월부터 제14차 ‘유해폐기물의 국가간 이동 및 그 처리의 통제에 관한 바젤협약(BaselConvention on the Control of Transboundary Movements of Hazardous Wastes)’ [이하“바젤협약”] 당사국총회에서 채택된 개정안이 발효되어 플라스틱 폐기물의 국가 간 이동이제한되었다. 중국은 ‘고체폐기물 환경오염 예방․퇴치법(中华人民共和国固体废物污染环境防治法)’ [이하 “고체폐기물법”] 개정에 근거하여 ‘고체폐기물 전면수입금지에 관한 사항고시(关于全面禁止进口固体废物有关事项的公告)’ [이하 “고체폐기물 수입금지조치”]를 실시하고 모든 고체폐기물의 수입을 금지하였다. 한국은 2030년까지 일부 품목을 제외한 모든 폐기물의 수입을 금지하는 내용의 ‘모든 폐기물 원칙적 수입 금지․제한 단계별 이행안’[이하 “2030 로드맵”]을 발표하였다. 바젤협약과 고체폐기물 수입금지조치 및 한국의 2030로드맵은 전부 폐기물로 인한 오염으로부터 인간의 건강과 안전을 지키고, 환경을 보호하는 것을 주된 목적으로 한다.
그러나 폐기물의 수입을 금지하는 규제조치는 국가 간 자유무역질서를 보장하는 세계무역기구(World Trade Organization: WTO) 체제하에서 허용되지 않는 규제로 판단될 가능성이 있다. 특히 ‘무역기술장벽협정(Agrement on Technical Bariers to Trade)’ [이하“TBT협정”]상의 불필요한 무역제한금지 원칙이나 국제표준과의 조화 원칙을 위반할 가능성이 있다. 이에 본고는 중국 고체폐기물 수입금지조치의 TBT협정 합치성 여부를 고찰하는 것을 주된 목적으로 하였다. 검토 결과 중국의 조치는 TBT협정 제2조가 적용되는 기술규정으로서 TBT협정 제2.2조 의무를 위반할 가능성이 있다는 점을 확인하였다. 중국의 조치보다 덜 무역제한적이면서도 목적 달성에 동등하거나 더 많은 기여를 할 수 있는 대체조치의 존재여부에 따라 TBT협정 제2.2조의 합치성이 결정될 것이다. TBT협정 제2.4조 합치성 검토 과정에서는 중국의 조치가 관련 국제표준인 바젤협약에 기초하여 실시된 조치인지 여부가 핵심 쟁점이 되었다. 중국의 조치는 ‘유해폐기물의 국가 간 이동통제’와 비교하여 다소 상이한 점은 있지만, 바젤협약을 기초로 사용한 조치로서 TBT협정 제2.4조에 합치한다고 판단하였다.
중국 고체폐기물 수입금지조치의 TBT협정 합치성 검토는 한국이 예고한 2030 로드맵에대하여 시사하는 바가 크다. 한국이 폐기물에 관한 자유무역체제를 해하지 않으면서 무역과 환경이 조화를 이루는 정당한 폐기물 수입규제조치를 통해 지속가능한 사회로 나아가기 위해서는, 우선 ‘폐기물 제로수입’을 폐기물 수입의 기본원칙으로서 법률로 구체화할 필요가 있다. 또한 다른 국가들과 함께 중국의 고체폐기물 수입금지조치를 ‘상호인정’하는 방안을 고려할 수 있으며, ‘자의적이거나 정당화될 수 없는 차별’ 혹은 ‘국제무역에 대한 위장된 제한’을 구성하지 않는 방식으로 조치가 행하여질 것을 보장하여야 할 것이다.

영어초록

‘Zero Waste’ is one of the notable key words in the global environmental regulationtrend. As of January 2021, the amendment to Anexes entered into force, which wasadopted by the Conference of the Parties to the ‘Basel Convention on the Control ofTransboundary Movements of Hazardous Wastes and Their Disposal’ [hereinafter “BaselConvention”] on the work of its 14th meting in 2019, the movement of plastic wastewas restricted. China has implemented a complete ban on the import of al solid wastethrough the ‘Anouncement No. 53 (2020) on Maters Concerning the Complete Ban onthe Import of Solid Waste’ [hereinafter “Solid Waste Import Ban Measure”] based on therevision of the ‘Solid Waste Environmental Polution Prevention and Control Law’[hereinafter “Solid Waste Act”]. Korea anounced a road map that prohibits the importof al waste except for some products by 2030 [hereinafter “2030 Road Map”]. The BaselConvention, Solid Waste Import Ban Measure, and Korea’s 2030 Road Map are bothprimarily aimed at protecting human health, safety and environment from polutioncaused by waste.
However, regulatory measures prohibitng the import of waste are likely to be judgedas unaceptable regulations under the ‘World Trade Organization’ [hereinafter “WTO”]system which ensures the international fre trade order. There is a posibilty, especialy,of violating the principle of prohibiton of unecesary obstacles to trade orharmonization based on international standards under the ‘Technical Bariers to TradeAgrement’ [hereinafter “TBT Agrement”]. For this reason, the main purpose of thisstudy is to examine whether China's Solid Waste Import Ban Measure is consistent withTBT Agrement. As a result of the review, it was found that the China’s measure, asa technical regulation to which TBT Agrement Article 2 aplies, may violate theobligation of Article 2.2 of the TBT Agrement. The consistency of Article 2.2 of the TBTAgrement wil be determined by the existence of alternative measure which is lestrade-restrictive than those of China and achieve equivalent or greater degre ofcontribution to the objective at the same time. In the proces of reviewing the consistencyof Article 2.4 of the TBT Agrement, the key isue is whether China’s measure wasimplemented based on the Basel Convention as a relevant international standard. Eventhough the Solid Waste Import Ban Measure difers somewhat from the ‘control of thetransboundary movement of hazardous wastes,’ it was found that the China’s measure,based on the Basel Convention, conforms to the obligation of Article 2.4 of the TBTAgrement.
The review of the consistency of the TBT Agrement on the China’s Solid WasteImport Ban Measure has great implication for the Korea’s 2030 Road Map. In order forKorea to move toward a sustainable society without disturbing the fre trade order onwaste trade through legitmate waste import regulation in harmony with trade andenvironment, it is necesary to clarify the objective of ‘Waste Zero Import’ as the basicprinciple of waste import by law, to ‘mutualy recognize’ China’s Solid Waste ImportBan together with other States, and to ensure the measures are taken in a maner thatdo not constiute a means of ‘arbitrary or unjustifable discrimination’ nor ‘disguisedrestriction on international trade.’
