중국 저작권법상 건축저작물 관련 규정 검토 (Review of regulations related to architectural works under Chinese copyright law)

초록

코로나19를 겪으며 사람들은 비대면에 대한 거리감과 이질감이 옅어지면서 메타버스에 대한 관심이 증가하였다. 메타버스(Metaverse)는 가상, 초월을 의미하는 '메타'(meta)와 세계, 우주를 의미하는 '유니버스'(universe)를 합성한 신조어다. 이런 메타버스 환경 중 거울세계는 현실세계를 사실적으로 디지털화하여 복제하고 재현한 방식으로, 바다와 산 같은 지형은 물론이고 건축물도 가상세계로의 복제가 이루어지게 된다. 이처럼 현실세계의 건축물이 가상세계에서 재현되면서 저작권 침해 여부에 대한 검토가 필요하게 되었다.
중국에서도 메타버스에 대한 산업이 급속히 발전하는 상황이다. 메타버스에서 현실 건축물이 재현되는 경우 이런 행위가 저작권법의 복제 행위에 해당하는지, 저작권 침해 행위인지에 대한 논의가 제기되고 있다. 따라서 본 논문에서는 중국 저작권법에서의 건축저작물과 관련한 규정 검토하고, 중국 내 대표 저작권 침해 사건을 소개한 후, 메타버스에서의 현실 건축물 재현행위시 발생할 수 있는 저작권 문제를 살펴보았다.
2020년 개정된 현행 저작권법은 건축저작물 정의 규정에 대한 수정은 없었지만, 파노라마의 자유 규정에서 공공장소의 범위를 실내외 모두로 포함하였고, 복제권 부분에서도 디지털화를 복제 행위의 한 유형으로 포함시켰다는 점에서 건축저작물과 관련된 부분의 규정은 상당한 개정이 있었다. 하지만 중국도 저작권법에서 메타버스상 현실 건축물 재현행위를 저작권 침해로 볼 수 있다거나 공정이용 행위로 볼 수 있다는 명시적 규정은 없다. 그렇다 보니 개별 상황에 따라 개별 요건을 검토하여 저작권 침해를 판단해야 하는 상황이다.
메타버스 기술이 빠르게 발전하고 이를 상업적으로 이용하는 경우가 많아지는 상황에서 더 많은 저작권 침해 문제들이 제기될 수 있기 때문에 중국에서도 권리자와 이용자 보호 및 관련 산업 활성화 측면에서 현행 법률 제도를 유연하게 해석하거나 새로운 관련 입법이 필요한 것은 아닌지와 관련한 고민이 계속되고 있다.

영어초록

Through COVID-19, interest in metaverse increased as distance and heterogeneity in non-face-to-face decreased. Metaverse is a new word that combines "universe" which means the world and the universe and “meta”, which means virtual and transcendent. Among these metaverse environment, the mirror world is a method that realistically digitizes and reproduces the real world. This replicates not only topography such as the sea and mountains but also architecture in the virtual world. As architectures in the real world are reproduced in the virtual world, it is necessary to review whether copyright is infringement.
The industry for metaverse is rapidly developing in China as well. When real architecture is reproduced in a metaverse, discussions are being raised on whether it is an act of reproduction or a copyright infringement under the Copyright Act. Therefore, this paper reviewed the regulations related to architectural works in Chinese copyright Act and introduced representative copyright infringement cases in China. I also looked at copyright issues that may arise when reproducing real architectures in the metaverse.
There was no amendment to the definition of architectural works in the current copyright law revised in 2020. Besides, the regulations related to freedom of panorama included the both indoor and outdoor, and in terms of reproduction rights included as a type of reproduction behavior, there have been significant revisions to the provisions related to architectural works. However, China does not have an explicit provision that the reproduction of real architecture in the metaverse can be viewed as copyright infringement or fair use. Therefore, it is necessary to determine copyright infringement by reviewing individual requirements and circumstances.
Metaverse technology is rapidly developing and is often used commercially. Since such rapid development can cause copyright infringement problems, it is necessary to flexibly interpret the current legal system in terms of protecting rights holders, users and revitalizing related industries, or to consider whether new related legislation is necessary.
